Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police or, in his/her absence, disability or inability to act, the ranking member of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a. above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Lake Como are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

a. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

The effectiveness of this subsection is contingent upon signs being erected as required by law.
d.

a. 
Prohibitions. Whenever there is snow covering any street in the Borough, the following prohibitions will take effect:
1. 
Parking of all vehicles on the north and east sides of the Borough streets is prohibited until after the snow has stopped and the street has been plowed; then, 12 hours after the snow has stopped all vehicles must be moved to the north and east sides of the Borough streets to allow the Public Works Department to plow the south and west sides of the streets.
2. 
The two-hour parking limit on Main Street shall be suspended during any snow emergency for a period of 48 hours after the snow has stopped.
3. 
The parking restriction on Parkway shall be suspended during any snow emergency from the time the road becomes snow covered until 12 hours after the snow stops.
4. 
Any vehicle parked in violation or abandoned on a public street shall be deemed to be a nuisance and a menace to public safety and any public safety officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage of a vehicle before redeeming possession thereof.
5. 
During a snow emergency, if off-street parking is available, any vehicle shall not be parked on any street.
6. 
Any owner or owners, occupant or occupants, tenant or tenants, building superintendent, rental agent or person in charge of premises abutting or bordering upon any public street, in the Borough shall remove all snow and ice from the abutting sidewalks of such streets, or in the case of ice which may be so frozen as to make removal impracticable, shall cause the same to be thoroughly covered with sand or ashes, within 24 hours of daylight after the same shall fall or be formed thereon.
b. 
Exceptions. This subsection shall not apply to B Street or Sixteenth Avenue as to parking of vehicles. However, the regulations regarding sidewalks shall apply.
c. 
Penalty. The penalty provisions of Section 1-5 shall apply to a violation of this subsection. In addition, the Police Department shall have the option of towing any vehicle in violation at the owner's expense.
d. 
Removal Costs. In addition to the provision for penalties herein made for violations of this subsection, and in case such snow or ice shall not be removed from such sidewalks by the owner or owners, tenant or tenants, occupant or occupants, building superintendent, rental agent or person in charge of any premises as provided in subsection 7-7.4a1, the same shall be removed forthwith and under the direction of the Public Works Superintendent and the cost of such removal as nearly as can be ascertained shall be certified by the Public Works Superintendent to the Governing Body. The Governing Body shall examine such certification and, if found to be correct, shall cause such cost to be charged against such real estate so abutting or bordering upon such sidewalk or street and the amount so charged shall forthwith become a lien and a tax upon such real estate or land and be added to, recorded and collected in the same manner as the taxes next to be levied and assessed upon such premises and shall bear interest and be enforced and collected by the same officers and in the same manner as other taxes.
e. 
Depositing Snow on Street Restricted. No person, firm or corporation, the owner, tenant or occupant of any premises abutting on any street shall throw, place or deposit any snow or ice into or on any street, in the Borough, it being the intent and purpose of this provision to prohibit all such persons from throwing, casting, placing or depositing snow and ice, which accumulated on the private property abutting the street or sidewalk, on the sidewalks or streets of the Borough.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Borough of Lake Como, in the County of Monmouth, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least 2 emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police Department. If it is determined by the Officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County Jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation twenty (20) days after passage and publication as prescribed by law.

b. 
Temporary parking; permits.
1. 
Permission may be granted by the Police Department for the temporary parking of any such trucks or vehicles during the hours when parking is prohibited as specified above and under such terms and conditions as specified by the Police Department.
2. 
No commercial vehicle may park on streets within the Borough of Lake Como between the hours of 9:00 p.m. and 7:00 a.m., seven days a week, without a permit issued in accordance with this chapter. "Commercial vehicle" is defined as any commercial motor vehicle which is registered or is required to be registered as a commercial motor vehicle either by the State of New Jersey or the state in which the vehicle is registered.
3. 
Permits shall be issued by the Borough Administrator, or their designee, under the following conditions:
(a) 
The vehicle registration and applicant's driver's license must bear the same address within the Borough of Lake Como under which the permit is to be issued.
(b) 
No more than one permit shall be issued per residence or postal address.
c. 
There shall be no parking of any boat trailer or trailers at any time upon any of the public streets or parts thereof within the Borough.
Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets as described are hereby designated as route for vehicles OVER four tons. All trucks having a total combined registered gross weight of vehicle plus load in excess of four tons shall be excluded from all streets, except for those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pickup and delivery of materials.

In any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5, N.J.S.A. 52:27D-119 et seq., or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle. State, county, or municipal law enforcement officers or parking enforcement officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped on both public and private property.
No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful.

The owners of the premises referred to in subsections 7-35.3 and 7-35.4 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Lake Como. The owner shall be responsible for the repair and restoration or replacement of same.

Pursuant to P.L. 1989, C 201, the penalties for violations of this Section 7-35 must be $250 for a first offense and for a subsequent offense must be a fine of at least $250 and up to 90 days community service on such terms and in such form as the Court shall deem appropriate, or any combination thereof.

Restricted parking spaces for handicapped persons in all parking facilities within the Borough of Lake Como are hereby provided pursuant to Title 39, New Jersey Motor Vehicle and Traffic Regulations:
Article 23, Special Privileges, 39:4-197.5, 39:4-197.6, and 39:4-207.7.
In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.

For a violation of the provision of this Section 7-37 or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both; except that for a violation of N.J.S.A. 39:4-80 et seq., N.J.S.A. 39:4-105 et seq., N.J.S.A. 39:123 et seq. or N.J.S.A. 39:4-140 et seq., the offender shall be liable to a penalty of not less than $50 or more than $200 or imprisonment for a term not exceeding 15 days, or both.
