Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a.
The
Chief of Police or his designee, is hereby authorized to provide by
regulation for the closing of any street or portion thereof to motor
vehicle traffic on any day or days during specified hours on any day
or days whenever he/she finds that such closing is necessary for the
preservation of the public safety, health or welfare.
b.
Any
regulations promulgated by the Chief of Police and in accordance with
paragraph a above shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
c.
Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed fifty ($50.00) dollars.
d.
Any
regulation adopted that mandates the closing of any street for a period
greater than forty-eight (48) consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any Police Officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute
or in this chapter, every person convicted of a violation of a provision
of this chapter or any supplement thereto shall be liable to a penalty
of not more than fifty ($50.00) dollars or imprisonment for a term
not exceeding fifteen (15) days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Township of Edison are
hereby repealed, and all ordinances or parts of ordinances in conflict
with or inconsistent with the provisions of this chapter are hereby
repealed, except that this repeal shall not affect or prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The Governing Body hereby finds and declares that problems of
traffic control occur and traffic must be moved through or around
street construction, maintenance operations, and utility work, above
and below ground which requires blocking the roadway and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote the public health, safety, peace and welfare, it is necessary
to establish controls and regulations directed to the safety and expeditious
movement of traffic through construction and maintenance zones and
to provide safety for the work force performing these operations.
The Township of Edison, in the County of Middlesex, State of
New Jersey, does hereby adopt the current Manual on Uniform Traffic
Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented
and amended, as it controls and regulates whenever construction maintenance
operations of utility work obstructs the normal flow of traffic. Any
person, contractor, or utility, who fails to comply with the provisions
of M.U.T.C.D. while performing such work is in violation of this section.
It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under a public utility
agreement, wishing to conduct work on, under or above the roadway
to contact the Police Department of the Township in order to arrange
a preconstruction meeting in order to submit plans for the safe movement
of traffic during such period of construction work. Any person, contractor
or utility who fails to comply with this section prior to the start
of such work or whose plans are not approved by the Police Department
is in violation of this section.

The person, contractor, or utility shall provide the Police
Department with at least two (2) emergency contact phone numbers to
be called in case of emergency problems at the construction or maintenance
site prior to the start of any work. If for any reason emergency contact
cannot be reached, or if the emergency contact person does not respond
to the call from the Police Department to correct a hazardous condition,
the Township may respond to correct such hazardous condition. The
reasonable fees for such emergency service by the Township shall be
charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Township before the hour of 9:00 a.m. or
after 4:00 p.m. This time limit may be adjusted to permit work prior
to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Township
Police Department. If it is determined by the Officer in charge that
the construction or maintenance operations prior to 9:00 a.m. or after
4:00 p.m. would substantially delay traffic or cause a safety or health
hazard, the work shall then be permitted only between 9:00 a.m. and
4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Township Police Department.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Township Police Department that same
is necessary to provide for the safety and expeditious movement of
traffic.

The Township Police Department shall have the authority to stop
work, including the removal of equipment and vehicles, stored material
within the street right-of-way, back filling of open excavations and/or
other related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, lights, devices and pavement markings are
installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than one hundred ($100.00) dollars nor more than
five hundred ($500.00) dollars and/or be imprisoned in the county
jail for a term not exceeding ninety (90) days. For a second offense,
the person, contractor or utility shall, upon conviction thereof,
pay a fine of not less than two hundred and fifty ($250.00) dollars
and/or be imprisoned in the County Jail for a term not exceeding ninety
(90) days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a.
Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Chief of Police or his/her designee, in his/her
absence, the ranking Police Officer is authorized to declare an emergency
and to direct the posting of EMERGENCY NO PARKING signs when weather
conditions, accidents, road construction, fire or public celebrations
dictate or require avoidance of hazards or other conditions which
interfere with the free flow of traffic. Notification that EMERGENCY
NO PARKING signs are being or will be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of the signs.
b.
The
effectiveness of this subsection is contingent upon the signs being
erected as required by law.
c.
Any
unoccupied vehicle parked or standing in violation of this subsection
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal, before regaining possession
of the vehicle.

a.
Whenever snow has fallen and accumulation is such that it covers
the street or highway, an emergency shall exist and no vehicles shall
be parked on public streets or highways within the boundaries of Edison
Township.
The parking prohibitions listed above shall remain in effect
after the snow has ceased, until the streets have been plowed sufficiently,
and to the extent that parking will not interfere with the normal
flow of traffic.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession
of the vehicle.

b.
Residential Parking Permit System. No vehicle shall be parked on the streets or parts of streets designated in this Section 7-17 during the days and hours designated in the schedule unless the vehicle falls under one (1) of the exceptions to the parking ban or:
1.
The vehicle is owned or operated on a regular basis by a resident
of that street;
2.
The vehicle has displayed on the front driver's side window in the
lower rear corner, two (2) inches from the bottom of the window when
in a rolled up position, a current residential parking permit so as
to be closely examined by an officer;
3.
The resident's vehicle displaying a residential parking permit is
consistently parked within the immediate block of the resident owner's
home.
c.
Exempt Vehicles. The following vehicles shall be exempt from this
parking permit chapter:
1.
Contractors', Service and Delivery Vehicles. Contractors', service
and delivery vehicles bearing the name and address of a commercial
business may park without a permit during the time they are rendering
service to a residence within the permit parking area.
2.
Emergency Vehicles. Emergency vehicles and public utility vehicles
may park within the permit parking area during the time they are rendering
service or repairs within the area.
3.
Visitors.
(a)
A vehicle displaying a current visitor parking permit, which shall
be a hang tag from the rear view mirror, may park a maximum of three
(3) days, provided that the operator is a bona fide guest of a resident
within the parking area. If a visitor must park beyond the three-day
limit, the host-resident must notify the police to this effect and
supply the vehicle identification information requested. The police
shall not enforce this section against a visitor for up to but not
exceeding fourteen (14) days if this procedure is followed.
(b)
A visitor's vehicle must be parked on the same block as the host-person's
residence.
d.
Basis for Determination. Whenever the Mayor or his or her designee
shall determine that certain streets exclusively or primarily servicing
residential land uses, or portions of such streets, are being used
for parking by the operators of vehicles who do not reside on the
streets, and that the average number of such vehicles parking in such
manner is in excess of twenty-five (25%) percent of the number of
parking spaces on such streets and that the total number of parking
spaces actually occupied exceeds sixty-five (65%) percent of the total
number of parking spaces on such streets on the weekdays of any month,
as disclosed by an engineering or traffic study, then the Mayor or
his or her designee shall recommend to the Municipal Council that
such streets be included within this section.
e.
Applications. Application for parking permits under this section
shall be made in writing on forms provided by the Department of Health.
Permits shall be issued without charge only under the following terms
and conditions:
1.
Residential permits shall be renewed every three (3) years and the
current year's sticker must be affixed to the registered vehicle by
January 15 of the first year the permit is issued. Permits bearing
the year 2010 are extended and effective through December 31, 2012,
thereafter all permits will be renewed for a three (3) year term.
As part of the renewal process, residents shall be required to show
their issued visitor permits in order to obtain a color-coded residential
sticker for the particular zone.
2.
Three (3) visitor permits shall be issued to each residential unit
on any street or portion thereof upon which parking is restricted
by this section.
f.
Violations—Penalties. Any person, firm or corporation who or
which shall violate any of the provisions of this section, or any
supplement thereto shall, upon conviction, be punished by a fine not
to exceed one thousand two hundred fifty ($1,250.00) dollars, and
each violation of any of the provisions of this section and each day
that a violation continues shall be deemed and taken to be a separate
and distinct offense.

Permit Applications.
1.
Applications for special handicapped parking permits under this section
shall be in writing, on a form provided by the Division of Licenses
and Permits. The permits shall be issued to the handicapped person
who resides at the location specified in this section. Such permits
shall only be issued to persons who can prove ownership and operation
of the motor vehicle and residency at the location specified therein.

The permit shall be five and one-half (5 1/2) inches by eight
and one-half (8 1/2) inches in size, shall bear an appropriate
certification of authenticity, shall be displayed prominently within
the vehicle, and shall identify the specific motor vehicle and the
location where it is to be parked.

following off-street parking spaces are designated as handicapped
parking areas. Such spaces are for use by persons who have been issued
special identification cards, plates or placards by the Motor Vehicle
Commission, or a temporary placard issued by the Chief of Police.
No other person shall be permitted to park in these spaces.
In any space on public or private property appropriately marked
for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5,
N.J.S.A. 52:27D-119 et seq., or any other applicable law unless the
vehicle is authorized by law to be parked therein and a handicapped
person is either the driver or a passenger in that vehicle. State,
county, or municipal law enforcement officers or parking enforcement
officers shall enforce the parking restrictions on spaces appropriately
marked for vehicles for the physically handicapped on both public
and private property.
No person shall move a vehicle not lawfully under his control
into any such prohibited area or away from a curb such distance as
is unlawful.

Submission of plan. The Chief of the Division of Fire and the Chief
of Police or his/her designee of the Township shall jointly provide
the Director of Public Safety with an individual plan for each privately
owned public parking area to which this section shall be applicable.
The plan shall contain the outline of each parking area and shall
clearly designate areas of traffic flow and areas or zones in which
there shall be no stopping, standing or parking of vehicles.

2.
Adoption of plans; Amendment procedures. Upon receipt of each individual
plan the Director of Public Safety shall file such plan with the Township
Clerk and with the Clerk of the Municipal Court, to be kept as a part
of the permanent records of each office. Each such plan so filed shall
be included herein and made part of this section and shall also be
forwarded to the Department of Transportation of the State of New
Jersey. Amendments and changes to such plans may be made by forwarding
the proposed change(s) to the Department of Transportation of the
State of New Jersey for approval; and, after notice of approval, the
changed or amended plans shall be immediately filed with the Township
Clerk and the Clerk of the Municipal Court.

3.
Responsibilities of owners. An appropriate copy of each plan shall
be provided to the owner and/or operator of each individual privately
owned public parking area. The owner and/or operator of each such
area shall then at his, her or its own cost and expense cause the
parking area to be painted with stripings in accordance with the plan
provided to each such individual owner, operator or corporation. In
addition, appropriate signs shall be provided and installed by the
owner and/or operator at his, her or its own cost and expense. Each
sign and the placement therefor shall conform to the State of New
Jersey standard traffic sign criteria and must be in strict accordance
with the plan provided.

for failing or refusing to comply herewith, be subject to a fine of

The owners of the premises referred to in this subsection 7-40.2, 7-40.3 and 7-40.5 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the "Manual of Uniform Traffic Control Devices for Streets and Highways." The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Edison. The owner shall be responsible for the repair and restoration or replacement of same.

a.
Installation.
1.
The Township hereby determines to install and utilize a traffic control
signal monitoring system (the "system") at various intersections within
the Township as approved by the Commissioner of Transportation pursuant
to P.L. 2007, Chapter 348 (the "Act").
2.
The System to be installed shall be approved by the Township Council
by resolution.
3.
The Township shall have the authority to enter into a contract, following
a lawful procurement process, for the installation of the System.
Any contract that shall contain provisions contrary to the Act shall
not be deemed invalid but rather reformed to conform to the Act.
4.
The signs notifying drivers that the System is being utilized shall
be approved by the Township Engineer, and shall be placed on each
street converging into the affected intersection as required by the
Act.
5.
The Township Engineer shall inspect and certify the System at least
once every six (6) months from the date of its installation.
b.
Issuance of the Summons. The Division of Police of the Township shall
review the recorded images produced by the System, to determine whether
sufficient evidence exists demonstrating that the traffic control
signal violation has occurred and shall issue summons when appropriate
in accordance with the Rules of the Court.
c.
Use of Recorded Images.
1.
Except as otherwise provided in this section, the recorded images
produced by the System shall be available for the exclusive use of
the Division of Police for the purpose of discharging his or her duties
under the Act.
2.
Any recorded image or information produced in connection with the
System shall not be deemed a public record in N.J.S.A. 47:1A-1 et
seq., or common law. The recorded images shall not be: (i) discoverable
as a public record by any person, entity, or governmental agency,
except upon a subpoena issued by a grand jury or a court order in
a criminal matter, or (ii) offered as evidence in any civil or administrative
proceeding not directly related to a traffic control signal violation.
3.
Any recorded image or information collected in connection with a
traffic control signal violation shall not be retained after sixty
(60) business days following the collection of any fine or penalty.
4.
If a summons is not issued within forty (40) business days following
the traffic control signal violation, all recorded images and any
information collected with respect to the traffic control violation
shall be removed by the Division of Police within two (2) business
days.
5.
The Township shall certify compliance of this section by filing a
report with the Commissioner of Transportation in accordance with
the Act.
d.
Owner's Liability. The liability of the owner and operator of a motor
vehicle for a traffic control signal violation summons pursuant to
the System shall be joint, subject to provisions of the Act.
