[1973 Code § 45-15]
The Governing Body shall have power to appoint annually an Animal Control Officer, whose duty it shall be to enforce the provisions of this chapter and the provisions of Chapter 151 of the Laws of New Jersey for 1941 and any supplements and amendments thereto provided. The Governing Body shall also have the power to appoint one (1) or more persons, who may impound unlicensed dogs or cats which are running at large in violation of the provisions of this chapter.

The Governing Body may enter into negotiations and may contract for Animal Control Services for a period not exceeding one (1) year, for collection, keeping for redemption, destroying or disposing of all dogs running at large or unlicensed or stray dogs or cats required to be licensed found within the Borough limits, and for sheltering and feeding such dogs or cats during the redemption and to defray the costs thereof.

a. 
The Animal Control Officer or other person designated by the Governing Body shall take into custody and impound or cause to be taken into custody and impounded, and thereafter destroyed and disposed of:
1. 
Any dog or cat off the premises of the owner or of the person keeping or harboring said dog or cat which the official or his agent or agents have reason to believe is a stray dog or cat or which is running at large.
2. 
Any dog off the premises of the owner or of the person keeping or harboring the dog without a current registration tag on his collar where the same is required to be licensed.
3. 
Any female dog or cat in season off the premises of the owner or of the person keeping or harboring the dog or cat.
b. 
Dogs so taken into custody shall be impounded, destroyed or disposed of as provided in N.J.S.A. 4:19-15.16.
c. 
Cats so taken into custody shall be impounded, destroyed or disposed of in the same manner as is herein provided for the impounding, destruction or disposal of dogs.

Any officer or agent authorized or empowered to perform any duty under this chapter is hereby authorized to go upon any premises to seize for impounding any dog or cat which he may lawfully seize and impound when such officer is in immediate pursuit of such dog or cat, except on the premises of the owner of the dog or cat if said owner is present and forbids the same.

No person shall hinder, molest or interfere with anyone authorized or empowered to perform any duty under this chapter.

a. 
License fees and other moneys collected or received under the provisions of this chapter, except registration tag fees, shall be placed in a special account separate from any of the other accounts of the Borough and shall be used for the following purposes only: for collecting, keeping and disposing of dogs liable to seizure under this chapter; for local prevention and control of rabies; for providing antirabic treatment under the direction of the local Board of Health for any person known or suspected to have been exposed to rabies; for all other purposes prescribed by the Statutes of New Jersey governing the subject, and for administering the provisions of this chapter. Any unexpended balance remaining in such special account shall be retained therein until the end of the third fiscal year following and may be used for any of the purposes set forth in this section. At the end of the said third fiscal year following, and at the end of each fiscal year thereafter, there shall be transferred from such special account to the general funds of the Borough any amount then in such account which is in excess of the total amount paid into said special account during the last two (2) fiscal years next preceding.
b. 
The New Jersey State Fees collected for each dog or cat license shall be forwarded within thirty (30) days after collection by the Municipal Clerk to the State Department of Health.

Any person who is convicted of violating any provision of this chapter shall be subject to such fine and general penalty as set forth in Section 1-5, General Penalty, of the Code of the Borough of Rockleigh, within the discretion of the Municipal Court Judge.

The provisions of this chapter are supplementary to and in addition to the provisions of Chapter 151 of the Laws of New Jersey for 1941, as supplemented and amended.
