This section shall be known and cited as "Mandatory Recycling
Regulations of the Borough of Rockleigh."

As used in this section:
Shall mean recyclable aluminum cans.
Shall mean all products made from silica or sand, soda ash
and limestone which are transparent or translucent and used for packaging
or bottling of various matter and all other material commonly known
as glass; excluding, however, blue and flat glass commonly known as
window glass.
Shall mean and include such rules, implementation dates,
schedules of times and such other requirements approved by the Borough
Council as may be necessary to carry out the purposes and objectives
of this chapter.
Shall be deemed to include all garbage and rubbish regularly
placed out by the residents and by the commercial occupants of the
Borough for regular collection by the Borough Scavenger.
Shall mean any white typing paper, ledger paper, white note
pad paper, carbonless computer paper and print-outs, Xerox paper,
manila tab cards and manila file folders.
Shall mean and include paper of the type commonly referred
to as newsprint and distributed at stated intervals, usually daily
or weekly, having printed thereon news and opinions and containing
advertisements and other matters of public interest. Expressly excluded,
however, are all magazines or similar periodicals as well as all other
paper periodicals of any nature whatsoever.
Shall mean and include leaves, grass clippings and brush.

a.
The following materials are designated as recyclable under the Rockleigh
Mandatory Program for residential properties.
1.
Newspapers;
2.
Glass beverage containers;
3.
Aluminum cans;
4.
Ferrous scrap;
5.
Leaves;
6.
White goods;
7.
Tin (ferrous) cans;
8.
Grass;
9.
High-grade paper;
10.
Household generated batteries;
11.
Construction and demolition debris (concrete, brick, tree parts,
nonferrous/ferrous metal, asphalt, corrugated cardboard; where practical);
12.
Corrugated cardboard;
13.
Mixed paper;
14.
Type 1 and 2 plastic containers.
b.
The following materials are designated as recyclable under the Rockleigh
Mandatory Program for commercial properties.
1.
Newspaper;
2.
Glass beverage containers;
3.
Aluminum cans;
4.
Ferrous scrap;
5.
Leaves;
6.
White goods;
7.
Corrugated cardboard;
8.
High-grade paper;
9.
Mixed paper;
10.
Construction and demolition debris (concrete, brick, tree parts,
nonferrous/ferrous metal, asphalt, corrugated cardboard; where practical);
11.
Type 1 and 2 plastic containers.
c.
All persons, except those physically disabled, who are owners, lessees
and occupants of property in the Borough shall separate used newspapers,
aluminum and glass from any other trash, garbage, solid waste and
yard waste produced by any such residences. Trash, garbage and solid
waste shall be separately bundled for pickup, collection and recycling,
in accordance with all applicable regulations. Yard waste shall not
be picked up.

Between the dates of September 1 and December 31 in each year,
it shall be the responsibility of each property owner to dispose of
leaves which fall on his property by composting same or by having
his landscaper dispose of same in a manner other than by putting their
leaves with the solid waste to be picked up by the Borough Scavenger.

All separate recyclables shall be placed for pickup, collection
and recycling in strict conformity with the following regulations:
a.
Used newspapers and high grade paper shall be separated and secured
in bundles; not to exceed twelve (12) inches in height. Such bundles
shall not be contained in plastic bags.
b.
Aluminum shall be separated and secured in suitable reusable containers
supplied by the owner, lessee or occupant.
c.
Glass shall be separated and contained in suitable, reusable containers
supplied by the owner, lessee or occupant. Containers constructed
of paper or cardboard materials shall not be deemed suitable for this
purpose.
d.
Other materials shall be separated and secured in suitable, reusable
containers supplied by the owner, lessee or occupant.

The Borough Council shall promulgate regulations establishing
the commencement dates for mandatory separation of recyclables and
the manner, dates and times for the collection of same in accordance
with the terms of this chapter. Any such schedule shall be approved
by the Borough Council and may be changed, modified, repealed or amended
in whole or in part by majority vote of the Borough Council. A copy
of such regulations as approved, modified or amended, shall be available
for public inspection at the Office of the Municipal Clerk during
regular office hours.

From the time of placement for pickup, collection and recycling
or delivery to the Transfer Station, recyclables shall be the property
of the Borough of Rockleigh or its duly authorized agent. No person
unauthorized by the Borough of Rockleigh shall collect or pick up
or cause to be collected or picked up any such recyclables. Each collection
or pickup of recyclables in violation hereof from any one or more
residences shall constitute a separate and distinct offense.

No provision herein shall be construed to prohibit groups or
individuals who have been authorized by the Borough from collecting
or picking up recyclables at curbside or otherwise in such manner
and under such terms and conditions as shall be prescribed by the
Borough Council. No such collection or pickup shall conflict or interfere
with pickup and collection by the Borough and its duly authorized
agents.

The Administrator or his duly authorized designee is hereby
designated and authorized as the Enforcement Officer of this chapter.

Any person, firm or corporation who violates or fails to comply
with any provisions of this chapter or of any regulation promulgated
pursuant thereto, shall upon conviction thereof be punished by a fine
not to exceed:

This section establishes a yard waste collection and disposal
program in the Borough for the protection of the public health, safety
and welfare and to prescribe penalties for the failure to comply.

For the purpose of this section, the following terms, phrases,
words and their derivations shall have the meanings stated herein
unless their use in the text of this Chapter clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
The placement of yard waste in a trash can, bucket, bag or
other vessel, such as to prevent the yard waste from spilling or blowing
out into the street and coming into contact with stormwater.
Any individual, corporation, company, partnership, firm,
association, or political subdivision of this State subject to municipal
jurisdiction.
Any street, avenue, boulevard, road, parkway, viaduct, drive,
or other way, which is an existing State, county, or municipal roadway,
and includes the land between the street lines, whether improved or
unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas, and other areas within the street lines.

Sweeping, raking, blowing or otherwise placing yard waste that
is not containerized at the curb or along the street is only allowed
during the seven days prior to a scheduled and announced collection,
and shall not be placed closer than 10 feet from any storm drain inlet.
Placement of such yard waste at the curb or along the street at any
other time or in any other manner is a violation of this section.
If such placement of yard waste occurs, the party responsible for
placement of the yard waste must remove the yard waste from the street
or said party shall be deemed in violation of this section.

This section shall be enforced by the Police Department providing
police services to the Borough of Rockleigh and/or Borough of Rockleigh
Building Department.

Any person who is convicted of violating any provision of this section shall be subject to such fine and general penalty as set forth in § 1-5, General Penalty, of the Code of the Borough of Rockleigh, within the discretion of the Municipal Court Judge.

The owner or occupant of any property, or any employee or contractor
of such owner or occupant engaged to provide lawn care or landscaping
services, shall not sweep, rake, blow or otherwise place yard waste,
unless the yard waste is containerized, in the street. If yard waste
that is not containerized is placed in the street, the party responsible
for placement of yard waste must remove the yard waste from the street
or said party shall be deemed in violation of this section.
