The Council shall appoint a Clerk for the term of three years or until the appointment and qualification of his or her successor. Prior to appointment, the Clerk shall have been qualified by training and experience to perform the duties of office. He or she shall serve as Clerk of the Council and have such other functions, powers and duties as are provided for by the charter and Code.

The Clerk shall:
A. 
Keep the minutes and records of the proceedings of the Council and of the proceedings of any special Council committee upon request of the chairman of the committee.
B. 
Preserve and compile all ordinances and resolutions, and at the close of each year, with the advice and assistance of the Department of Law, the Clerk shall compile, codify and bind all the ordinances and resolutions then in effect and shall properly index such compilation or codification and provide for its publication.
C. 
Have and take custody of all the official books, papers and documents of the municipality for which no other repository is provided by the charter or ordinance and preserve and keep them safely.
D. 
Provide secretarial and clerical services for Councilmen in the discharge of their official duties.
E. 
Receive and open public bids pursuant to notice thereof at a specified time during the regular working office hours in the Township of East Brunswick, which are 9:00 a.m. to 5:00 p.m. on Monday through Friday, except holidays.
F. 
Receive and process all tax appeals served and filed in accordance with N.J.R.S. 54:3-21.

G. 
Maintain and administer records of vital statistics including births, deaths and marriages, in accordance with state law and issue marriage licenses pursuant to law.

The Clerk shall cause the Municipal Seal to be affixed to instruments and writings when specifically authorized by law or when necessary to exemplify any document or record in his office or to certify an act or paper which, from the records of his office, shall appear to be a true copy of any public record or proceeding. He shall not affix the seal or cause or permit it to be affixed to any instrument, writing or other paper except as provided in this subsection, unless required by law.

A. 
Purpose. The purpose of this chapter is to control and regulate the use of the logo of the Township of East Brunswick.
B. 
Definitions. For the purpose of this chapter the following terms shall have the meanings set forth herein
TOWNSHIP OF EAST BRUNSWICK
The Township of East Brunswick, its officers, employees, and duly authorized agents and representatives.
LOGO OF THE TOWNSHIP OF EAST BRUNSWICK
The symbol, or any part thereon, officially adopted to be used by the Township of East Brunswick which includes a graphic design with the words "home, education and commerce" written thereon and the words "plan, purpose and progress" written on a ribbon underneath said design, encircled by a border with the following written words thereon, "Township of East Brunswick, N.J. Heart of Middlesex County" as contained in the Municipal Seal.
PERSON
Any individual or individuals, corporation, trust, partnership, board, council, commission, committee or any other entity.
C. 
Permitted Use of the Logo of the Township of East Brunswick. It shall be lawful for the Township of East Brunswick to use and display the logo of the Township of East Brunswick to identify the conduct of official business of the Township of East Brunswick as defined in this chapter and to signify attestation of the Township of East Brunswick, as required by the Local Bond Law, N.J.S.A. 40A:2-25 and any other law.
D. 
Prohibited Uses of the Logo of the Township of East Brunswick. No person shall use or display the Township logo in an offensive, slanderous or other manner which would degrade the Township of East Brunswick.
The Clerk shall publish ordinances as required by law and shall file in his office the requisite proofs of such publication.

The Clerk shall issue and deliver, with the assistance of the Department of Public Safety, if needed, all notices of meetings required to be given to the Council within the time prescribed by law and shall promptly inform Council members of action taken by the Mayor with respect to any ordinances. The Clerk shall also deliver with the assistance of the Department of Public Safety, if needed, all documentation reasonably needed by the Council concerning items or matters scheduled for discussion or action at any Council meeting. Such documentation shall be delivered to Council members at least 70 hours prior to any Council meeting at which the item or matter is scheduled for discussion or action. The Council President, or in his/her absence, the Council Vice President may waive this 70 hours prior notice requirement if he/she believes that such a waiver is in the best interest of the public. Any such waiver shall be in writing and shall include a brief explanation of the reason for the waiver and filed with the Municipal Clerk. Failure to deliver the documentation within the required time period shall not invalidate any action taken by the Council. The consideration by the Council of added starters is to be discouraged, however, added starters may be considered and acted upon provided that the added starter is accompanied by a written explanation of why documentation regarding the same was not delivered to the Council within the above required time period.
The Clerk shall administer licenses pursuant to ordinance and general law. The Department of Public Safety shall assist in inspection and enforcement procedures required for such licensing.

The Clerk shall receive and transmit all written communications directly or indirectly connected with official Township business, including but not limited to any memoranda, correspondence, notes, reports, e-mail, facsimile transmission, or any other writing to or on behalf of the Township Council in accordance with the Handling of Communications Policy as adopted by Council resolution. The Handling of Communications Policy shall be kept on file with the Clerk and may be amended by Council resolution from time to time.
The list of written communications listed above is not intended to serve as an all-inclusive list of communications. Other types of written communications may apply to this section.
All written communications directly or indirectly connected with official Township business shall be deemed to be public record in accordance with the Open Public Records Act, P.L. 2001, c. 404 (Jan. 8, 2002).
The Clerk shall charge and receive for the use of the municipality such fees for transcripts and certifications as shall be authorized by the Council.
The Clerk shall also:
A. 
Perform all the functions required of municipal clerks by the General Election Law and any other law or ordinance and receive for municipal use the fees prescribed therefor.

B. 
Perform such functions as are vested in municipal clerks by state law and ordinances relating to bingo and raffles licensing.
C. 
Have such other different and additional functions, powers and duties as may be prescribed by law or ordinance.
D. 
The Township Clerk is hereby designed as the "issuing authority" pursuant to N.J.A.C. 13:47-1.1 and is authorized and directed to issue licenses as permitted by law without the consent of the governing body. The Township Clerk on behalf of the Township Council, shall make an investigation of the application to confirm that the applicant meets all requirements required by statute, forward a copy to the law enforcement agency of this municipality, and if the application is deemed compliant, and the Control Commission has not taken action on the application within 14 calendar days after mailing the application and licensing fee to the Control Commission, the application is deemed approved, and the Township Clerk shall issue the license, as per N.J.S.A. 13:47-4.3.

The Clerk shall be the depository and custodian of all official surety bonds furnished by or on account of any Township office, officer or employee, except his own bond which shall be placed in the custody of the Township Treasurer; all insurance policies upon or with respect to risks insured for the benefit of the Township or to protect it against any claims, demands or liability whatsoever; and all formal contracts for work, labor, services, supplies, equipment and materials to which the Township may be a party. The Clerk shall also have custody of all leases of property owned by the Township. The Clerk shall be the depository for and have custody of all performance bonds running to the Township as obligee and other forms of noncash security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the Township.
There may be Deputy Municipal Clerks appointed by the Council who shall have, exercise and perform the functions, powers and duties of the Clerk in the absence or upon the direction of the Clerk.
