Editor's Note: The monetary penalty provision in
Section 16:1 of the Middlesex County Air Pollution Control Code, adopted
by the Township of East Brunswick, is hereby amended by increasing
the maximum monetary penalty from $500.00 to $2,500.00, pursuant to
N.J.S.A. 26:2C-22, as amended. If the monetary amount should be increased
by State Statute, the Township of East Brunswick penalty shall automatically
be increased to equal that amount.
Chapter 42, Air Pollution Control, adopted on 5-10-82 as Ord. No. 82-444 was repealed and rescinded on 11-26-84 by Ord. No. 84-612. The Middlesex County Air Pollution Control Code, which has been approved by the New Jersey Department of Environmental Protection, is hereby adopted in its place. A copy is on file in the Office of the Township Clerk and is incorporated by reference in the East Brunswick Code.
Section 18:2. Notwithstanding the content of any state statute,
and notwithstanding the provisions of Section 18.01 of the Middlesex
County Air Pollution Control Code, any private citizen may file a
complaint in the East Brunswick Municipal Court alleging violation
of the Middlesex County Air Pollution Control Code. No prior notice
to the alleged violator is required.
