Extensive commercial development within the Township has created a demand for services of armed security officers stationed in various locations throughout the Township. The primary intent of this ordinance is to prevent an accidental shooting situation involving an armed security officer and members of the East Brunswick Police Department. Requirements include properly identifying the security officer, the officer's authority and location and description of duties.
Armed Security Officer is any person authorized by law to carry a firearm within the State of New Jersey, including licensed private investigators and their authorized employees or Municipal, County, State and Federal Law Enforcement officers being paid by a commercial establishment to perform a security function while armed. East Brunswick Police Officers are exempt from this ordinance.
A. 
Identification. The armed security officer will complete an application for a photographic identification card. Applications are available at the East Brunswick Department of Public Safety. One card will be issued to the security officer, while copies of the officer's photograph are retained in file and disseminated to East Brunswick Police Officers.
B. 
Authority. Written documentation of authority shall be furnished with the security officer's application for a photographic identification card.
(1) 
Licensed Private Investigators shall furnish a copy of a valid Private Investigators License.
(2) 
Law Enforcement Officers shall furnish a copy of their agency issued identifications in addition to written documentation from their Chief/Director Prosecutor specifically stating that the officer has been granted authorization to accept private security employment, while armed, within the Township of East Brunswick.
C. 
Location and Description of Duties. The location of the employing commercial establishment shall be furnished, including complete identification of the person or persons seeking to employ the armed security officer.
D. 
Duties. The duties of an armed security officer shall be identified in the application, including, but not limited to, the following:
(1) 
Range of hours to be worked.
(2) 
Whether working at a fixed post, including exact location, or a transitory location.
(3) 
Parameters of responsibility including the following:
(a) 
Cash flow control.
(b) 
Escorts to bank.
(c) 
Employee internal investigations.
(d) 
Shoplifter detection.
(e) 
Inventory control.
(f) 
Other.
Any person as defined herein who violates any provision of this ordinance shall, upon conviction thereof, be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment for a term not exceeding ninety (90) days, or both, within the discretion of the Municipal Judge. A separate offense shall be deemed committed for each day during which a violation occurred or continues.
