The Township of East Brunswick recognizes the right to farm, subject to the provisions of the Zoning Ordinance, and subject also to the restrictions and regulations which may affect farming and agriculture, as set forth in all health and sanitary codes of the Federal Government, the State of New Jersey, the County of Middlesex and the Township of East Brunswick.
The right to farm as it is used in this section includes the use of large irrigation pumps and equipment, serial and ground seeding and spraying, large tractors, numerous farm laborers and the application of chemical fertilizers and products for the control and elimination of insects, pests, weeds, fungus and other substances injurious to the farming process or for the purpose of producing from the land agricultural products, such as vegetables, grains, hay, fruits, fibers, potatoes, wood, trees, plants, shrubs, flowers and seeds. This right to farm shall also include the right to use land for grazing by animals, subject to the restrictions contained elsewhere in this Code for raising livestock.
The foregoing uses and activities permitted in the Rural Preservation Zone, when reasonable and necessary for the particular farming, livestock or fowl production, and when conducted in accordance with generally accepted agricultural practices as the same may be determined and promulgated, from time to time, by the Rutgers University School of Agriculture, may occur on holidays, Sundays and weekdays, and the odors, dust and fumes that are caused by the farming activities are specifically permitted as part of the exercise of the right to farm in the Rural Preservation Zone.
It is expressly found that whatever temporary inconveniences may be caused to others by such uses and activities so conducted, they are more than offset by the benefits from farming to the neighborhood and community and to society in general, by the preservation and continuance of farming operations in East Brunswick Township and in New Jersey as a source of agricultural products for this and future generations.
