The Department of Public Works shall consist of a Superintendent
of Public Works, two Assistant Superintendents, and such other employees,
who shall be known as "DPW crew members," as may from time to time
be authorized by resolution of the Mayor and Council. Their compensation
shall be as authorized by ordinance.
A.
A person holding office, position or employment as full-time Municipal
Superintendent of Public Works who has held the office, position or
employment continuously for five years or more shall continue to hold
the office, position or employment during good behavior and efficiency
and shall not be removed therefrom for political or other reason except
for good cause.
B.
This provision shall be applied retroactive for present employees.
The Superintendent shall be appointed by the Mayor, by and with
the consent of the Council, and shall hold office until the first
day of January next succeeding his appointment and until his successor
is appointed. If the Superintendent attains tenure pursuant to state
law, yearly appointments shall no longer be required. The Superintendent
shall, subject to the control of the Mayor and Council, be in charge
and control of the Department of Public Works. In the event of his
absence due to disability, the Mayor, with the consent of the Council,
shall appoint a successor. During the Superintendent's vacation
time or sick leave, the Superintendent shall designate a member of
his Department to assume his duties and powers and shall notify the
Mayor and Council of such designation, in writing.
