[HISTORY: Adopted by the Township Council of the Township of East Brunswick on 8-14-84 as Ordinance 84-597; amended in its entirety 12-12-05 by Ord. No. 05-38]
No person shall cut, tear, deface, disfigure, damage, destroy or illegally copy any library materials. No person shall deface, disfigure, damage or destroy any library equipment or furnishings, the library building, or any other library property.
1. 
A person commits the offense of theft of library property when he or she does any of the following acts:
a. 
Knowingly and intentionally removes any library material or property from the premises of the library without authority to do so; or
b. 
Knowingly and intentionally borrows any library material by:
i. 
Using a library card not in compliance with library policy and procedures; or
ii. 
Using a library card knowing that it is revoked, cancelled or expired, or
iii. 
Using a library card knowing that it is falsely made, counterfeit, materially altered, or stolen; or
c. 
Fails to return library materials in compliance with current library policy.
2. 
Library managers, library staff responsible for the circulation of library materials, and/or library security officers may question any person(s):
a. 
To ensure that a person is removing any library material or property with authority to do so or borrowing it in accordance with library policies and procedures; or
b. 
When the theft detection system alarm sounds as that person proceeds through said system.
The Library shall display the library Circulation Policy in a conspicuous place in the library building.
The Library Director and/or the Library Manager(s) who oversee(s) circulation are authorized to file a complaint in the Municipal Court under the following conditions:
1. 
When the cost of damages or unreturned library property exceeds $25.00; or
2. 
When the cost of unreturned and/or damaged materials and/or property, and/or unpaid fines and/or fees is $25.00 or greater.
1. 
Any person who violates or refuses to comply with the provisions of this chapter shall, upon conviction thereof, be subject to a minimum fine of one hundred ($100.00) dollars or twice the cost of the unreturned and/or damaged material(s) and/or property and/or unpaid fines and/or fees, whichever is greater, in accordance with N.J.S.A. 2C:43-3.
2. 
For the second and each succeeding offense in which a violation occurs or continues upon conviction thereof, the individual will be subject to a minimum fine of two hundred ($200.00) dollars or twice the cost of the unreturned and/or damaged material(s) and/or property and/or unpaid fines and/or fees, whichever is greater, in accordance with N.J.S.A. 2C:43-3.
