No person shall operate a vehicle at any time upon the streets or roadways of the Township of East Brunswick if:
a. 
Such vehicle is being used for the purpose of hauling or transporting solid waste; and
b. 
Such waste may consist of hazardous toxic waste or chemical waste as defined by the Regulations of the Bureau of Solid Waste Management within the New Jersey Department of Transportation; and
c. 
If the operator of such a vehicle does not have proper documentation indicating the contents of the vehicle, a permit for the transportation of the waste and a permit to dispose of the waste at a designated solid waste facility, all as required by the Regulations of the Bureau of Solid Waste Management.

Any person or entity who owns or operates a commercial facility within the Township of East Brunswick which stores, manufactures, mixes, processes or in any way has in their possession any material, including but not limited to flammable, combustible, corrosive poisonous or hazardous, as classified in accordance with 49 CFR of the Code of Federal Regulations, shall have at least one (l) recovery drum upon their premises. The drum will be maintained and used for the sole purpose of control and containment of any of the aforementioned materials in the event of a leak, spill or container failure. The recovery drum shall have the following minimum standards of construction:
1. 
Have a minimum capacity of 85 gallons (322 liters);
2. 
Overall height (over lock ring): 38-5/8" (98l MM);
3. 
Overall diameter (over the roll loops): 26-7/8" (708 MM);
4. 
Cover, bottom and body structure: 16 ga. common grade carbon steel;
5. 
Exterior paint: Yellow with black stripes, imprint "RECOVERY DRUM".

The provisions of § 150-7 shall be enforced by the Municipal Fire Inspectors.

Any person who violates any provision of this Article shall, upon conviction in the East Brunswick Municipal Court, be punished by a fine not to exceed five hundred ($500.00) dollars or imprisonment in the County Jail for a period not to exceed ninety (90) days or by both such fine and imprisonment, and each violation of any of the provisions contained in this Article and each day the same is violated, shall be deemed and taken to be a separate and distinct offense.
