The code established by this chapter is commonly known as the
"Individual Sewage Disposal System Code of New Jersey (1978)" as more
particularly set forth in N.J.A.C. 7:9A-1 et seq. and is hereafter
referred to as the "Code."
Three (3) copies of the code have been placed on file in the
office of the Township Clerk and shall remain on file there for the
use and examination of the public.

A.
No person shall locate, construct or alter any individual sewage
disposal system until a permit has been obtained from the Division
of Health.
B.
No new individual sewage disposal system shall be placed in operation
and no new dwelling or building or addition to a dwelling or building
which relies upon such a system for sewage disposal shall be sold
or occupied until the Division of Health has issued a certificate
that it has been located and constructed in compliance with the code
and the terms of the permit issued.
C.
The application fee for the location or construction of individual
sewage disposal systems shall be one hundred dollars ($100.) per proposed/existing
lot for the new construction of a sewage disposal system, payable
prior to site evaluation. The application fee for the alteration of
an existing sewage disposal system shall be fifty dollars ($50.),
payable prior to site evaluation. The application fee for the renewal
of a license to operate shall be ten dollars ($10.00). The fee is
intended to defray costs incurred by the township in reviewing sketches
showing the property to be served, location of proposed sewage disposal
facilities and number of bathrooms, as well as those costs incurred
by the township in witnessing the plan review and percolation test
and attending to the site inspection, construction inspection and
issuance of certificate of compliance. The application fee is nonrefundable
and will not be returned if the certificate of compliance cannot be
issued.

Section 10.7 of the Individual Sewage Disposal System Code of
New Jersey (1963) is amended by the following: Applicants who submit
plot plans for properties which are designated by the Natural Resource
Inventory as marginal, or having a high water table and/or heavy clay
strata characteristics, will not be permitted to take percolation
tests or soil logs during the months of June, July, August and September.

The fee for inspection for cleaning of a subsurface disposal
system shall be fifteen dollars ($15.00) for each cleaning.

No person shall engage in the business of emptying or cleaning
septic tanks, cesspools, privies or other places used for the reception
and storage of human excrement without having first obtained a license
from the Division of Health. The fee for such a license shall be twenty
dollars ($20.) for each vehicle used in the conduct of the business.
The term of the license shall be from July 1 of each year to June
30 of the following year. Licenses issued after January 1 of the licensing
year may be obtained for half the usual fee.
In the event that any application for a license, permit or certificate required by this chapter is denied, suspended or revoked by the Division of Health, the applicant may request a hearing before the Director of Health and Welfare. The hearing shall be conducted in accordance with the procedure outlined in Chapter 3, Administration of Government, Article XV, and the Director of Health and Welfare may alter, affirm or reverse the denial, suspension or revocation. The Director shall announce his decision within fifteen (15) days of the date of the hearing.
The Director of Health and Welfare may order all further work
on any individual sewage disposal system which is being erected or
installed in violation of the code to be stopped immediately, except
for work necessary to remedy the violation. Once a stop-work order
is issued and served upon the permittee or any person working on or
about the sewage disposal system, no further work shall be done until
the violation has been corrected and the Director of Health and Welfare
has lifted the stop-work order.

Septic tanks and other subsurface waste disposal systems are
used extensively throughout portions of the Township of East Brunswick.
They are an adequate and beneficial system of domestic waste disposal
if properly installed, operated and maintained and are an economically
feasible alternative to costly sanitary sewer systems. However, they
presently constitute a problem in the township because a large percentage
of the systems are not properly installed, operated and maintained
or have failed, causing potential pollution of ground and surface
waters, potential contamination of potable water supplies, foul odors,
nuisance problems and hazards to public health. Therefore, an East
Brunswick septic system management area is created, including those
areas of the township where septic systems are used extensively as
specifically delineated on a Septic System Management Area Map dated
July 9, 1979, prepared by Carl E. Hintz, P.P., and which is on file
in the office of the East Brunswick Township Clerk.
