[HISTORY: Adopted by the Township Council of the Township of East Brunswick 10-13-64 and as Sec. 19-2 of the Revised General Ordinances. Amendments noted where applicable.]
A code regulating the location, construction, alteration and operation of swimming pools, the issuance of permits to locate, construct, alter or operate a swimming pool and declaring certain swimming pools to be nuisances is hereby adopted in accordance with the authority granted by N.J.R.S. 26:3-69.1 to 26:3-69.6. A copy of the code is annexed to and made part of this chapter without the inclusion of the text herein.

The code adopted by this chapter is commonly known as the "New Jersey State Sanitary Code Chapter IX Public Recreational Bathing 2004" and is sometimes referred to in this chapter as the "Swimming Pool Code."
Three copies of the Swimming Pool Code have been placed on file in the office of the Township Clerk and shall remain on file there for use and examination by the public.

The Swimming Pool Code is hereby amended to substitute the words "Director of Construction Inspection or Chief Construction Official" for the words "Board of Health" wherever they appear in the code.

No person shall locate, construct, alter or operate a swimming pool as defined in the Swimming Pool Code without obtaining a permit to do so from the Division of Construction Inspection or Chief Construction Official.
A. 
The fees for permits required by this chapter shall be as follows:

Permit to operate a commercial swimming pool as part of a swim club, hotel, motel, health club, or other commercial facility, or as part of a homeowners association, condominium association or townhouse association, one hundred fifty dollars ($150.00).

B. 
Permits to operate a swimming pool shall be for a term of one (1) year, from July 1 to June 30. Permits issued after January 1 of the permit year may be obtained at half the annual fee.

Permits may be revoked by the Division of Construction Inspection or Chief Construction Official for failure to comply with this chapter or with the Swimming Pool Code.
