[Ord. No. 78-8 § I]
As used in this chapter:
ADULT
shall mean a person who has attained the age of twelve (12) years.
BOROUGH
shall mean the Borough of Woodland Park.
CHILD
shall mean a person who has not attained the age of twelve (12) years.
FAMILY
shall mean mother, father, husband, wife and children residing in the same household.
GUEST
shall mean a person who is a bona fide guest of a resident.
RESIDENT
shall mean a person who is domiciled in the Borough of Woodland Park.

a. 
All playgrounds and ball fields which are part of the public school system and the Borough-owned playgrounds on Bergen Boulevard at or near the intersection of Mount Pleasant Avenue and Overmount Avenue, in, at or near the intersection of Mount Pleasant Avenue and Woodrow Avenue shall be opened daily from dawn to dusk.
b. 
The Borough-owned parks commonly known as the Bicentennial Park on McBride Avenue, the Morris Canal Park along Mt. Pleasant Avenue and the Frank D. Zaccaria Park on Rifle Camp Road shall be open daily from dawn to dusk. The Borough-owned park commonly known as the Rose Place Park shall be open daily from dawn to dusk between October 31 and April 30 of each year and from May 1 to November 1, it shall be open from dawn to 9:30 p.m.
c. 
The Borough-owned Frank D. Zaccaria Park, located on Rifle Camp Road, shall be closed to the public from 9:00 a.m. to 3:00 p.m., Monday through Friday during Summer Camp sessions.

The sale and/or consumption of alcoholic beverages in Borough-owned parks and playgrounds is expressly prohibited except upon the obtaining of a permit from the Mayor and Municipal Council for organized group picnics.

a. 
Speed limits for motor vehicles upon all Borough-owned playgrounds and parks entrance ways, exits and parking areas is five (5) miles per hour.
b. 
No commercial vehicles are permitted upon Borough-owned playgrounds, parks, their entrance ways, exits or parking areas except for those necessary for and being used to service and maintain the playgrounds and parks.
c. 
No motor vehicles including but not limited to mopeds, motorbikes and motorcycles are permitted in any area except those areas specifically designated for parking, entrance ways and exits to and from parking areas on Borough-owned playgrounds and parks.
d. 
The parking and standing of motor vehicles within the parking areas, entrance ways and exits to Borough-owned parks and playgrounds when the park or playground is closed is expressly prohibited.

a. 
No pets, other than dogs, are permitted within any Borough-owned playgrounds, school grounds and parks.
b. 
No person owning, keeping or harboring any dog shall suffer or permit it to be upon any park, playground, school grounds unless the dog is accompanied by a person over the age of twelve (12) years and is securely confined and controlled by an adequate leash not more than six (6) feet in length.
c. 
Any person owning, keeping or harboring a dog within any Borough-owned playgrounds, school grounds or parks, must maintain a distance of at least twenty-five (25) feet from any playground equipment or areas where children are playing.

Littering in Borough-owned playgrounds and parks is prohibited.

Cooking and all open fires are prohibited in all Borough-owned parks and playgrounds.

All vendors, hawkers and peddlers are prohibited within Borough-owned playgrounds and parks except upon obtaining a permit from the Mayor and Municipal Council for organized group picnics.

A particular Borough-owned playground or park may only be used for an organized group purpose upon the obtaining of a permit from the Mayor and Municipal Council. The use of a playground or park for an organized group purpose without such a permit is prohibited.

Swimming in Borough-owned parks is prohibited.

Ice skating in Borough-owned parks is restricted to specifically designated areas and is prohibited unless there is a Borough-employed attendant on duty.

Ballplaying is prohibited in picnic areas within Borough-owned parks.

The intentional damaging of shrubs, flora and/or trees within Borough-owned playgrounds and parks is prohibited.

The use of Borough-owned tennis courts at the Rose Place Park shall be limited to those persons who purchase seasonal badges, unless such requirement is waived by the Governing Body (via resolution), from the Borough in accord with the fee schedule set forth herein. The use of these facilities shall also be in accord with such additional rules and regulations conspicuously posted thereon.

The fees or charges for seasonal badges for use of Borough-owned tennis courts are hereby established as follows:
Tennis — Rose Place Park
$20 per family per season
$10 per adult per season
$5 per child per season
$15 per guest per season — must play with person that purchased badge.
$3 each for replacement of badge.

a. 
The Borough may act to temporarily close or limit the use of parks, recreational facilities, municipal and Board of Education fields and lots, and public sidewalks, whenever, in the judgment of any of the appropriate enforcing authorities, such action is deemed necessary or desirable for the protection of public health or safety.
b. 
As used in this section, the term "lightning risk warning" shall mean notice to the Borough of a lightning risk, the activation of the lightning warning system siren or strobe or the happening of any event deemed by any of the appropriate enforcing authorities to be a risk to health and safety due to lightning.
c. 
If a lightning risk warning occurs, all parks and recreational facilities will be closed including but not limited to municipal and Board of Education fields, lots and other areas.
d. 
If a park or recreational facility is closed, as provided in this chapter:
1. 
All activities within such park or recreational facility shall immediately cease until the lightning warning system provides the all-clear sound or any of the appropriate enforcing authorities authorizes the facility(ies) to re-open; and
2. 
All persons within the park or recreational facility when the lightning risk warning occurs shall immediately exit the park or recreational facility and not return until the lightning warning system provides the all-clear sound or any of the appropriate enforcing authorities authorizes the facility(ies) to re-open. "All persons" shall include all employees of the Borough of Woodland Park, volunteers, coaches, team members and their families and umpires/referees as well as all members of the public.
e. 
Organized Activities.
The person or persons seeking issuance of such a permit shall be responsible to ensure all coaches, umpires, referees, and or coordinators shall sign the Borough of Woodland Park Lightning Safety Policy.
The umpire, coach, coordinator or adult in charge is responsible to ensure that their group follows the Lightning Safety Policy. Disregarding the policy subjects the umpire, coach, coordinator and adult in charge to a suspension, up to and including a lifetime suspension, from all Woodland Park Recreation activities, and privileges including using the fields and parks for organized activity.
f. 
Unorganized Activities.
Members of the public informally using the parks, fields, lots, sidewalks, or other facilities are also subject to the terms of this chapter.
g. 
Nothing in this chapter is intended to negate the authority of the appropriate enforcing authorities, as defined herein and in Chapter V of the Code of the Borough of Woodland Park, to take such action as deemed necessary or desirable for the protection of the public's health or safety.
h. 
Enforcing Authorities.
Members of the Police Department of the Borough of Woodland Park, members of the Woodland Park Fire Department, designated agents of the Parks and Recreation Department and the Mayor and Council shall be the "enforcing authorities" authorized to enforce the terms of this chapter.

a. 
Any person who violates or neglects to comply with any provision of this chapter shall be liable for a penalty not exceeding fifty ($50) dollars for each violation. Each day on which a violation exists or continues shall be considered to be a separate and distinct violation and subject to the imposition of a separate penalty for each day of the violation.
b. 
If the Code of the Borough of Woodland Park provides for the licensing or permitting of any person or entity who/which violates the terms of this chapter, the Mayor and Council of the Borough of Woodland Park reserve the right to revoke such permit or license.

a. 
Fees and times of the Splash Park:
1. 
Saturday through Sunday: Fees and times for residents and nonresidents and operating times shall be determined by resolution.
2. 
Monday through Friday (when camp in session): Fees and times for residents and nonresidents and operating times shall be determined by resolution.
3. 
Monday through Friday (when camp is closed): Fees and times for residents and nonresidents and operating times shall be determined by resolution.
4. 
Adult supervision: Fees for residents and nonresidents are to be determined by resolution.
b. 
Rules and regulations.
1. 
Footwear, such as water shoes, is recommended at all times.
2. 
Children under 12 years of age must be supervised by an adult.
3. 
Swim diapers are required for children under four years of age. Cloth and ordinary diapers are not permitted.
4. 
Changing of diapers is prohibited inside Splash Park area. Soiled diapers should be disposed of in a proper manner.
5. 
Drinking the water is prohibited.
6. 
Climbing, hanging, swinging or pulling on Splash Park play equipment is prohibited and is grounds for immediate removal from the Splash Park.
7. 
Pets, animals, smoking, tobacco products, and food/beverages are not allowed inside Splash Park area.
8. 
Skateboards, bicycles, scooters or roller blades, and carriages are not allowed in the Splash Park area.
9. 
No glass containers or breakable objects are allowed inside the Splash Park area.
10. 
No food and/or food containers are permitted in the Splash Park area.
11. 
Littering is strictly prohibited.
12. 
No sun tan/sunscreen lotions, soap, shampoos, conditioners, body lotions or body washes are allowed near the splash pad features or Splash Pad area.
13. 
No running, rough play or horseplay is permitted. No blocking or obstructing the water is permitted. Athletic equipment, balls, bats, beach balls, noodles, etc., are not permitted in the Splash Park area.
14. 
Everyone must immediately clear the area and vacate the park when conditions for thunder, lightning or inclement weather are possible.
15. 
Beach chairs are allowed only on grass areas.
16. 
Hanging of clothes or towels on trees, fences, walls or structures is prohibited.
17. 
Electronic equipment is not allowed in the Splash Park. The Borough is not responsible for items that are damaged, lost or stolen.
18. 
No spitting, spouting of water, nose blowing or otherwise introducing contaminants into the Spray Park area.
19. 
Persons with diarrhea or nausea will not be allowed in the Splash Park area.
20. 
Persons with skin, eye, ear or respiratory infections will not be allowed into the Splash Park.
21. 
Persons with open cuts, sores, infections, lesions, wounds or diseases that may be transmitted by the water will not be allowed into the Splash Park.
22. 
Persons under the influence of alcohol or illegal drugs will not be permitted in the Splash Park area.
23. 
Swimsuits and/or appropriate attire must be worn at all times, i.e., shorts and/or bathing suits. Thong bathing suits and transparent-colored bathing suites are not allowed. Water shoes are suggested.
24. 
All participants must conduct themselves in a courteous, safe and family-oriented manner.
25. 
Any bracelet may be revoked for the failure to observe the Splash Park rules and regulations or for dangerous, improper or immoral conduct.
26. 
There is to be no use of the Splash Park facilities by any member for the purposes of group day care, preschool or nonBorough camp purposes or non-Borough-sponsored programs unless prior approval is obtained by the Recreation Department and/or Mayor and Council.
27. 
Running, ball playing, profane language, disrobing, unsanitary action, property damage, towel snapping, abuse of personnel in the conduct of their duty, or any behavior causing annoyance is prohibited.
28. 
The Borough of Woodland Park, through its designated agents, reserves the right to remove or cause to be removed a participant and/or spectator from the park for violating any of the above rules or engaging in unsafe, disruptive, dangerous, improper, immoral, destructive, inappropriate, or illegal behavior. Abuse of personnel in the conduct of their duty or any behavior causing annoyance to personnel is also grounds for removal.
29. 
ID is required for use of the Splash Park.
30. 
The Recreation Department and its designees (camp counselors and/or Site Administrator) are also vested with all necessary discretion to make decisions while this facility is in use, for the health, welfare and safety of its users/patrons.
c. 
Penalties. Violations of this section could subject the offender to lose his/her privileges to use the Splash Park, as well as any other penalties that are reasonable under the law.

Fees for the Recreation Summer Camp and After-Care Program.
a. 
Early registration. Dates and fees shall be determined by resolution.
b. 
Regular registration. Dates and fees shall be determined by resolution.
c. 
After-Care Program.
1. 
Time for the Program is 3:30 p.m. through 5:30 p.m. for seven weeks.
2. 
Fees for After-Care Program shall be determined by resolution.
d. 
Late registration fees. For the recreation summer camp and After-Care Program, there shall be a late registration fee of $50 for registrations made after the last date of regular registration.

The provisions of this section are applicable to the following locations:
1. 
Charles Olbon School: 50 Lincoln Lane, Woodland Park, NJ 07424
2. 
Beatrice Gilmore School: 1075 McBride Avenue, Woodland Park, NJ 07424.
3. 
Memorial School: 15 Memorial Drive, Woodland Park, NJ 07424.
4. 
Building formerly known as School #1: 665 McBride Avenue, Woodland Park, NJ 07424.
b. 
Trespassing. No trespassing is permitted on aforementioned Board-of-Education-owned properties or fields while school is in session. Written permission for the use of the fields when school is not in session must be obtained from the Woodland Park Board of Education, the Mayor of the Borough, or the Council of the Borough or an authorized representative of those entities. Use of the playgrounds on Board of Education property is permitted when school is not in session from dawn to dusk.
c. 
Penalty. Any person who violates any provision of this section shall be liable to a penalty of $100.

The provisions of this section are applicable to the type(s) and pricing of merchandise to be offered for sale at public celebrations by the Borough of Woodland Park:
a. 
Type(s) of merchandise to be offered for sale at public celebrations by the Borough of Woodland Park at a given specific event shall be established by resolution.
b. 
Pricing for merchandise to be offered for sale at public celebrations by the Borough of Woodland Park at a given specific event shall be established by resolution.

a. 
No organization shall utilize a recreational facility without first obtaining a permit from the Department of Parks and Recreation.
b. 
The application package promulgated by the Borough of Woodland Park Department of Parks and Recreation shall be completed in connection with obtaining a permit.
c. 
The fee structure for using the parks shall be as follows:
