A. 
All Class Five cannabis retailers, as defined in the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (P.L. 2021, c. 16[1]), are hereby prohibited from operating anywhere in the Borough of Middlesex. Such retail establishments are a prohibited use in all zones.

B. 
The remaining classes of cannabis businesses are only permitted to operate to the extent allowed by the Borough's Zoning Ordinance, Chapter 420, in the zones in which such uses are expressly permitted. However, nothing shall prohibit the delivery of cannabis items and related supplies by a delivery service, as stated in the Act.
Nothing in this chapter shall prohibit the operation of alternate treatment centers ("ATC") pursuant to the New Jersey Compassionate Use Medical Marijuana Act, N.J.S.A. 24:6I-1 et seq., provided that no ATC shall also hold a license as a marijuana retail establishment for the purposes of dispensing marijuana for recreational consumption.
