Editor's Note: On March 23, 1998, the Commissioner of Transportation approved the Traffic Chapter as submitted.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the City.

a. 
The Police Chief or, in his absence, disability or inability to act, the Mayor and, in the event of his absence, disability or inability to act, then the Chief of Police of the municipality, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Police Chief and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed fifty ($50.00) dollars.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than forty-eight (48) consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted to a violation of a provision of this ordinance or any supplement thereto shall be liable to a penalty of not more than two hundred ($200.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.

If any part of parts of this ordinance are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the City of Summit are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any chapter hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, or to provide for general public safety, there shall be no parking upon streets or sections of streets where temporary NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency or to effect a plan to direct the posting of said NO PARKING signs when weather conditions, accidents, fires and public celebration dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Wherever possible, notification that the NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal, before regaining possession of the vehicle.
c. 
The application of this subsection is contingent upon the signs being erected in the affected areas.

a. 
Removal. Whenever snow has fallen and the accumulation is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Definitions. As used in this section:

MERCHANT "CUSTOMER REWARDS" COUPON
Shall mean:
Coupons purchased in bulk by merchants in the Central Retail Business District for distribution to their customers for use in the Park & Shop Lots. The cost of said coupons shall be determined by resolution of the Common Council.
PARKING METERS
Shall mean:
(a) 
A meter placed on a pole whose time display is activated by the deposit of appropriate coin(s), the insertion of a prepaid Summit SmartCard or through a pre-registered pay-by-cell account.
(b) 
An electronic pay station either on- or off-street, where payment for hourly or daily parking is done by entering the parked vehicle's license plate number and zone, the deposit of appropriate coin(s), dollar bills, the insertion of a credit card, or through a pre-registered pay-by-cell account.
(c) 
Revenue access control equipment (gated system) whereby a parker takes a ticket upon entry to the parking lot, and upon exiting pays for time parked by either cash, credit card, merchant "customer rewards" coupon and/or a pre-registered pay-by-cell account.
PAY-BY-CELL
Shall mean:
Parker has a pre-registered account with a City designated "pay-by-cell" provider whereby user has authorized funds in advance in said account to pay for parking in the City of Summit at any street meter, multi-space meter or through revenue access control equipment.
SMARTCARD
Shall mean:
A chip card preloaded with funds from which, upon insertion into a street meter, the parking fee is deducted from and remitted to the City.
2. 
Parking Zones. The following described streets or parts of streets are hereby designated as parking zones.

(a) 
No person shall park a vehicle for longer than the time limit shown in this subsection at any time except Sundays between the hours limited in this subsection or parts of streets described in this subsection.
(b)

(c)

(b) 
Parking Beyond Fixed Time Periods.

(1) 
The parking of any vehicle in any of these zones beyond the time period fixed in the above schedule is prohibited irrespective of whether or not the parking meter for the vehicle was activated. Each vehicle parking beyond the time period fixed in the above schedule, whether paid or unpaid, shall be deemed in violation and if the vehicle continues to park and pays for the space for any time over the initial time period shall be deemed a separate violation of this paragraph (b)(1).
(2) 
The parking of any vehicle at any meter or meters in Zone A for more than a total of ninety (90) minutes, as set forth in paragraph (c), Days of Operation, shall be deemed a separate violation of paragraph (b)(1) of this section.

Each year there may be parking holidays based upon City Hall holidays whereby City offices are closed. These dates vary from year to year and will be posted on the City's website and at all pay stations.
4. 
Parking Meters.
(a) 
Installation, Control and Operation. The Common Council is hereby authorized to provide for the installation, regulation, control, operation and use of the parking and electronic multi-space meters, or revenue access control equipment provided for in this paragraph b., and to maintain the meters in good workable condition, and is hereby authorized and empowered to enter into a contract, after approval of the terms and conditions thereof by the Mayor and Common Council, for the purchase and/or installation of parking and electronic multi-space meters, or revenue access control equipment, together with extra coin boxes, service kits, extra units, and other accessories. The Common Council is further authorized and empowered to enter into a contract or contracts, after the approval of the terms and conditions thereof by the Mayor and the Common Council, for such protection and maintenance of such parking and electronic multi-space meters, or revenue access control equipment as may be necessary to maintain the same in good operating condition.
(b) 
Location and Type.

(1) 
Parking meters installed in the parking zones established in paragraph b2 of this subsection shall be placed within 200 feet of the parking places or at appropriate and convenient locations in the several public parking lots or parking garages hereinafter described.
(2) 
Each poled parking meter shall be placed or set in such manner as to show or display by a signal facing the street that the parking space adjacent to such meter is or is not legally in use. Each poled parking meter installed shall indicate by proper legend the legal parking time established by the City, and when activated, shall indicate the duration of the period of legal parking for each payment made and on the expiration of such period, shall indicate illegal or over parking.
(3) 
Each electronic pay station, when activated, shall alternately display the parking space number or the license plate number and the expiration time.
(4) 
Revenue access control equipment (gated system) whereby a parker takes a ticket upon entry to the parking lot and upon exiting pays for time parked by either cash, credit card, merchant "customer rewards" coupon and/or a pre-registered pay-by-cell account.
(c) 
Installation Location Not Inclusive. Parking meters should not be installed in those areas wherein parking is prohibited by State law pursuant to N.J.S.A. 39:4-138.

5. 
Parking Regulations.
(a) 
Designation of Parking Space. The Council is hereby authorized to have lines, or markings or numbers painted at the beginning and end of a legal block of a pay station controlled area or placed on poles, the curb and/or the street, and in the parking lots adjacent to each parking meter controlled area for the purpose of designating the parking space for which the meter or number is to be used. Each vehicle parked within the pay station controlled area or adjacent or next to any parking meter or numbered area shall park within the lines or markings so established. It shall be unlawful and a violation of this paragraph b to park any vehicle across any such line or marking or to park the vehicle in such position that the same shall not be entirely within the area so designated by such lines or markings.

(b) 
Parallel and Diagonal Parking. When parking space in any parking zone is parallel with the adjacent curb or sidewalk, any vehicle parking in such parking space shall be so parked that the foremost part of such vehicle shall be nearest to the parking meter controlled area. When a parking space in any parking zone is diagonal to the curb or sidewalk, any vehicle parked in such parking space shall be so parked that the foremost part of such vehicle is nearest to the parking meter controlled area.

(c) 
Parking Period. When any vehicle shall be parked in any space adjacent to which a parking meter controlled area is located in accordance with the provisions of this paragraph b., the operator of the vehicle shall upon entering the parking space, immediately activate the parking meter in accordance with subsection 7-8.5b3.
The failure to activate the parking meter shall constitute a violation of this paragraph b and shall subject such person to the penalty described in subsection 7-8.5b8 hereof. When any such vehicle shall remain parked in any such parking space for a period beyond that fixed in the schedule set forth in subsection 7-8.5b3 hereof, each overparking for each additional time period, which is the same as that established for that zone in the schedule set forth in subsection 7-8.5b3, shall constitute a separate violation of this paragraph b and shall subject such person to the penalty described in subsection 7-8.5b8 thereof for each separate violation.
Upon the activation of such meter, the parking space may be lawfully occupied by such vehicle for the time period indicated in subsection 7-8.5b3 hereof. When the vehicle shall remain parked in any such parking space beyond the maximum time period fixed in subsection 7-8.5b3 for such zone whether or not the meter is activated, such vehicle shall be considered as parking overtime and each overtime parking for each additional time period which is the same as established for that zone shall constitute a separate violation of this paragraph b and shall subject such person to the penalty described in subsection 7-8.5b3 hereof for each separate violation.

(d) 
Overtime Parking. It shall be unlawful and a violation of the provisions of this paragraph b for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the maximum period of legal parking time established for any parking zone as herein described.
(e) 
Parking in Space Presently in Violation. It shall be unlawful and a violation of the provisions of this paragraph b for any person to permit a vehicle to remain or be placed in any parking space adjacent to any parking meter controlled area in which the meter displays a signal indicating that the vehicle occupying such parking space has already been parked beyond the period of time described in subsection 7-8.5b3 for such parking space.
(f) 
Special Event Parking is defined as an event occurring when specific municipal parking lot areas are not necessary for daily resident commuter, downtown employee or normal shopper parking and which require additional City of Summit Parking Services Staff.
Special Event Parking Fees shall be established by resolution of the Common Council prior to the Special Event, which resolution shall be posted in a conspicuous place at the municipal parking areas and on the City's website.
Special Parking Fees shall be within range of $5 to $30 for each vehicle parked for a definite period, including a one-time Special Event Daily Fee, Special Overnight Parking Fee, Special Event Weekend Parking Fee.
Payment shall be made at the electronic pay station located in the municipal parking lot. The machine shall be programmed for each Special Event. Use of the City's cell phone parking payment app provided will be used if applicable. No cash shall be accepted.
Those vehicles which remain in the municipal parking lot after the authorized period of the Special Event are subject to a prohibited parking violation and to being towed at the vehicle owner's expense.

6. 
Prohibited Acts.
(a) 
Deposit of Substitute for U.S. Coins. It shall be unlawful and a violation of the provisions of this paragraph b to deposit or cause to be deposited in any parking meter, any slug, device, or any substitute for a coin of the United States, except that magnetic strip cards will be accepted by electronic multi-space meter boxes if so equipped.
(b) 
Destruction or Tampering with Parking Meters. It shall be unlawful and a violation of the provisions of this paragraph b for any person to deface, injure, tamper with, open or willfully break, destroy, or impair the usefulness of any parking meter installed under the provisions of this paragraph b.
7. 
Miscellaneous Provisions.
(a) 
Enforcement and Reports. It shall be the duty of the Parking Enforcement Officers acting in accordance with the instructions issued by the Parking Services Manager to report, via issuance of a summons:
(1) 
The number of each parking meter controlled area which indicates that the vehicle occupying the parking meter is or has been parked in violation of any of the provisions of this paragraph b.
(2) 
The State license number of such vehicle.
(3) 
Any facts, a knowledge of which is necessary to a thorough understanding of the circumstances, attending such violations.
(b) 
Collection and Disposition of Receipts. The receipts and revenues collected from the parking meters herein provided for shall be handled in accordance with the following procedure:
(1) 
Collection from the meters shall be made by the Parking Services Agency and a record kept by the Treasurer showing:
i. 
Date of collection.
ii. 
Meter areas included in collection and amount of receipts.
(2) 
Receipts shall be counted via a method approved by the City Auditor, City Treasurer, and Finance Committee and the revenues deposited in the Parking Utility Account of the City.
(3) 
The Parking Services Manager shall maintain a record of yearly collection showing the date, and the amount collected, the designated area from which the collection was made, and the total amount deposited and report monthly to the City Treasurer all monies collected from all street meters and payment machines.
(c) 
Responsibility of the Parking Services Manager. The Parking Services Manager shall be responsible for the maintenance of the parking meters in good workable condition, the proper collection of all coin containers, and the enforcement of all provisions of this paragraph b.
8. 
Penalty.
(a) 
Unless another penalty is expressly provided in New Jersey Statutes, every person convicted of a violation of a provision of this paragraph b or any supplement thereto shall be liable to a penalty of at least fifty ($50.00) dollars and not more than two hundred ($200.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.
(b) 
The registered owner of a vehicle convicted of a violation of subsection 7-8.5b3 and 5(c)(e) shall be liable to penalties of twenty-five ($25.00) dollars for each overtime violation.
(c) 
Impounding of Vehicles in Violation. Whenever any member of the Summit Police Department finds a vehicle upon the public highway or in the municipal parking lots in the City in violation of this paragraph b., such member of the Police Department may move or secure the removal of such vehicle to such garage or place for the impounding of such vehicle, and such vehicle shall be there retained and impounded until the person owning such vehicle shall pay the cost of such taking and removal together with a reasonable garage charge for each and every day such vehicle is retained and impounded.

No vehicle shall be parked on any street during any night of the year between the hours of 2:30 a.m. and 5:00 a.m. except for certain municipal streets listed in Subsection 7-25.4g5(d). No overnight parking is allowed on any street in Summit when there is a forecast of snow.

No person or entity shall park or store any vehicle within any portion of a front or side yard except when such portion has been approved for such use by variance or approved site plan of the Planning Board or Zoning Board of Adjustment or on lawfully existing driveways. However, in the event of an emergency; parking shall be permitted on any portion of the front or side yard for a period of time not to exceed twenty-four (24) hours.
For the purposes of this subsection "emergency" shall be defined as an unforeseen combination of circumstances or the resulting state of circumstances that pose an immediate and dangerous threat of sufficient severity and magnitude to substantially endanger the health, safety, and property of an individual. An "emergency" also means any flood, hurricane, tornado, high water, fire, or explosion.
If possible or practicable, in the event of an emergency the property owner shall contact the Summit Police Department and request permission to park or store a vehicle on a front or side yard. The Police Department's permission shall not be unreasonably withheld.
The City's Police Department shall have jurisdiction to enforce the provisions of this subsection.

Any person or entity violating the provisions of subsection 7-8.9 shall be subject to a fine of $100. If the violation is of a continuing nature, each and every day during which it continues will constitute a separate and distinct offense.

The penalties for violations of this Section 7-24, subsections 7-24.1 through 7-24.6 shall be set forth as in N.J.S.A. 39:4-197 and any amendments thereto.

In accordance with N.J.S.A. 39:4-207, no penalty shall be imposed for the parking overtime of any motor vehicle which has displayed thereon a placard or wheelchair symbol license plates issued pursuant to the provisions of this act under any law or municipal ordinance now in effect or hereafter enacted unless such vehicle shall have been parked in one location for more than twenty-four (24) hours. This provision shall apply only when the person to whom the placard or special license plate has been issued is either the driver or a passenger of the vehicle.
In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education Property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate or park a vehicle in violation of the regulations indicated.

a. 
Definitions. As used in this section, the following terms shall have the following meanings:
CHARGING STATION
A location that is fitted with electric charging station equipment.
CHARGING STATION EQUIPMENT
The conductions, including undergrounded and grounded, and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, charging status or apparatus installed specifically for the purpose of delivering electrical energy from the charging station to the electric vehicle.
CHARGING STATION SPACE
A dedicated, marked and signed parking space that is fitted with charging station equipment and exclusively used for the charging of electric vehicles.
ELECTRIC SCOOTER and/or ELECTRIC MOTORCYCLE
A two-wheel or three-wheel electric vehicle that operates exclusively on electrical energy stored in the vehicle's batteries.
ELECTRIC VEHICLE
A vehicle that operates, either partially or exclusively, on electrical energy from the charging station or other electrical energy source that is stored in the vehicle's battery for propulsion purposes. "Electric vehicle" includes: a battery electric vehicle; a plug-in hybrid electrical vehicle; a neighborhood electric vehicle; and electric scooters or electric motorcycles.
NEIGHBORHOOD ELECTRIC VEHICLE
An electric vehicle that is a low-speed vehicle, built to have a top speed of 25 miles per hour and to have a maximum loaded weight of 3,000 pounds.
NONELECTRIC VEHICLE
A vehicle that does not meet the definition of "electric vehicle" as provided herein.
PLUG-IN HYBRID ELECTRIC VEHICLE or PHEV
An electric vehicle that contains an internal combustion engine and also allows power to be delivered to drive wheels by an electric motor; charges its battery primarily by connecting to a charging station or other electrical source not on board the vehicle; may additionally be able to sustain a battery charge using an on-board internal-combustion-driven generator; and has the ability to be propelled through the use of electricity.
SITTING
An electric vehicle remaining in a charging station space after charging is complete.
b. 
Designation of spaces.
1. 
Parking spaces at the following location(s) shall be designated exclusively for use as electric vehicle charging stations:
(a) 
Two spaces in Municipal Parking Lot #1 located at 40 Deforest Avenue.
2. 
Notice of reserved parking for recharging of electric vehicles shall be posted on a sign not less than 17 inches by 22 inches in size with lettering not less than one inch in height that clearly and conspicuously states the electric vehicle charging station space is for electric vehicles only and all others are subject to a violation and towing.
c. 
Fees. The following fees shall apply to each designated electric vehicle charging station:

d. 
Use of designated electric vehicle charging station spaces.
1. 
Electric vehicles are authorized to park in spaces designated as electric vehicle charging station spaces only during the time when the vehicles are connected for electric charging purposes or up to four hours, whichever is less. Owners/operators shall be required to remove the vehicle from the charging station space within 15 minutes past the time the vehicle is no longer charging. Vehicles sitting in a charging station space past the fifteen-minute grace period shall be subject to a sitting fee, a violation, and further subject to towing at the owner's expense in accordance with § 7-4 of this chapter.
2. 
It shall be unlawful for any person to park or leave standing a vehicle in a stall or space designated for the recharging of electric vehicles unless the vehicle is connected for electric charging purposes. Any vehicle violating this requirement is subject to parking fees, a violation and towing at the owner's expense in accordance with § 7-4 of this chapter.
3. 
It shall be unlawful for any person to obstruct, block or otherwise bar access to a designated electric vehicle charging station.
e. 
Violations.
1. 
Any person in violation of Subsection 7-25.2A.1 shall be liable for additional parking fees and a penalty of $40.

It shall be unlawful to park any vehicle in the following parking areas of the City of Summit or the Board of Education except by employees of the City of Summit or the Board of Education or by persons having lawful business therein and during the time in which they transact such business. Vehicles permitted to park will be properly identified. No parking shall be permitted between the hours of 12:00 midnight and 6:00 a.m., with the exception of paragraph a for Summit Police Vehicles and paragraph b14(b) below.
a. 
Parking Area for Police Vehicles Only. Springfield Avenue from a point 120 feet east of the easterly curbline of Morris Avenue to a point 225 feet east therefrom between the hours of 12:00 midnight and 11:59 p.m. (Summit Police Vehicles Only).
b. 
Parking Area.

Junior High School located on Morris Avenue, Elm Street, Oakland Place and Maple Street.

Restrictions as set forth in this subsection.
(b) 
Commuters shall park in the designated area as long as it is needed and posted relative to providing spaces during the construction of the parking garage at the Broad Street lot with no parking permitted between the hours of 2:30 a.m. and 6:00 a.m.
c. 
Board of Education for Parking Area on the Senior High School Grounds, Kent Place Boulevard.
1. 
No vehicle shall be allowed to stop and stand on any road or driveway within the grounds of the Summit Senior High School.
2. 
Vehicles will be permitted to park only in authorized parking areas and only within the painted white stall lines.
3. 
Vehicles permitted to be parked shall be properly identified.
4. 
The driveway surrounding Parking Lot No. 1 is hereby designated as a one-way street in a counter clock direction as shown on plot plan which is made a part of this section.
5. 
The following intersection is hereby designated as a STOP intersection.
School Driveway-Weaver Street and the easternmost driveway of Parking Lot No. 1 STOP signs shall be installed on the southerly approach of the easternmost driveway of Parking Lot No. 1 as shown on plot plan which is made of a part of this section.
6. 
The parking regulations shall be effective at all times.
7. 
No through traffic shall be allowed.
8. 
A No Parking Zone shall extend from a point that is eighty-eight (88) feet along the easterly curbline of the circular driveway from the point formed by the intersection of the easterly extended curbline of the Ken Place Boulevard entrance driveway with the adjacent circular driveway curbline, to a point three hundred (300) feet along the easterly curbline of the driveway.
d. 
Housing Authority of the City of Summit for Parking Areas on the Grounds of the Glenwood Place Development, Weaver Street Development and Senior Citizen Housing Development.
1. 
No vehicle shall be allowed to park on any road or driveway within the grounds of the Housing Authority of the City.
2. 
Vehicles will be permitted to park only in authorized parking areas and only within the painted white stall lines.
3. 
Vehicles permitted to be parked shall be properly identified.

Times. The parking of any vehicle in any of the zones listed in subsection 7-25.2 above, beyond the time period fixed in subsection 7-25.2, is prohibited irrespective of whether or not the parking meter was activated for the vehicle. Each vehicle parking beyond the time period for an additional successive time period, that is the same as the initial legal maximum parking time period in such zone, shall be deemed a separate violation of this section.
c. 
Legal Operation.
1. 
When any vehicle shall be parked in any parking metered controlled area in accordance with the provisions of this section, the operator of the vehicle shall, upon entering the parking space, immediately activate the parking meter or pay station in accordance with subsection 7-25.2.
2. 
The failure to activate the pay station shall constitute a violation of this subsection and shall subject such person to the penalties described in subsection 7-8.5b8 of this chapter. When any such vehicle shall remain parked in any such parking space for a period beyond that fixed in the schedule set forth in subsection 7-25.2 thereof, each over parking for each additional time period shall constitute a separate violation of this section and shall subject such person to the penalties described in subsection 7-8.5b8 hereof for each separate violation.
3. 
Upon the activation of such meter, the parking space may be lawfully occupied by such vehicle for the time period indicated in subsection 7-25.2 hereof. When the vehicle shall remain parked in any such parking space beyond the maximum time period fixed in subsection 7-25.2 for such zone whether or not the meter is activated, such vehicle shall be considered as parking overtime and each overtime parking period which is the same as established for that zone shall constitute a separate violation of this section and shall subject such person to the penalties described in subsection 7-8.5b8 for each separate violation.
d. 
Parking Prohibited During Certain Hours. No vehicle shall be parked in the public parking lots shown in subsection 7-25.2a in the City between the hours of 2:30 a.m. and 4:30 a.m.
e. 
Parking Time Limited in Certain Public Parking Lots. No person shall park a vehicle for longer than the time limit shown in subsection 7-25.2a at any time between the hours listed of any day (except Sundays and public holidays) in any of the public parking lots described in the subsection.
f. 
Manner of Parking. All vehicles parking in any of the public parking lots or garages shown in subsection 7-25.2b in the City shall be parked with the front bumper to the curb or wall of a garage.
g. 
Overnight Parking Privilege in Public Parking Lots. Residents of the City will be allowed to park overnight in Parking Lots Nos. 1- 12 upon showing proof of residency and obtaining an overnight digital parking permit. A quarterly payment is required and due by the first day of the beginning of the quarter. The quarterly fees are specified below. All valid overnight parking permit holders can park from 3:00 p.m. until 8:00 a.m. All overnight parkers must remove their vehicles by 8:00 a.m. each night parked unless day parking is paid and a valid permit obtained.

Commercially registered vehicles belonging to residents or those who have a business establishment in Summit shall be allowed to park overnight only in Park and Shop Lot 4, and for the aforementioned fee. Applications may be obtained from the Parking Services Agency for issuance of a valid pre-paid quarterly overnight digital parking permit. All vehicles will park in only those areas assigned for this purpose. Such parking privilege will be allowed between the hours of 3:00 p.m. and 8:00 a.m. At all other times parking in the lots indicated will be in accordance with the meter fee, or time restrictions listed in this section.
4. 
United States Postal Service vehicles, per a contract with the City, shall be permitted to park overnight only in Lot 11, Railroad Avenue Lot. In the event of a snowfall of greater than one (1") inch, as determined by the Parking Services Manager, all United States Postal Service Vehicles shall be moved from the Railroad Avenue Lot to the bottom area of the Board Street Garage from where they shall be removed by 9:30 a.m.
5. 
On-Street Overnight Parking.

(a) 
Overnight parking on certain City streets listed in Subsection g5(d) below that are part of multidwelling units with 10 or more units is permitted from 3:00 p.m. to 8:00 a.m. upon obtaining a valid pre-paid overnight digital permit. The permit fee must be paid by the first day of each calendar quarter. The vehicle must be moved each morning if the street has hourly time limited parking.
(b) 
Each quarter the Parking Services Agency will provide the Police Department with a list of valid quarterly overnight permit holders. Any vehicle without a valid overnight parking permit will be subject to a parking violation for each occurrence.
(c) 
At no time, if there is a forecast of snow, may a vehicle be left on any street in the City of Summit. All street must be clear of vehicles for snowplowing.
(d)

Restricted Use.

1. 
No person, other than a person residing or owning real property in the City of Summit, or having a place of business or being regularly employed in the downtown B (Business) Zone extending generally from the intersection of Morris Avenue and the railroad tracks near Kent Place Boulevard to Broad Street at Park Place or PL (Public Lands) Zone in the City of Summit, shall be issued identification, to be determined by the City to park an automobile or other vehicle in a designated parking lot on any day between the hours of 5:00 a.m. and 6:00 p.m., except on Saturdays, Sundays or legal holidays.
2. 
The Parking Services Agency, or its designated agents, shall provide Summit residential digital parking/disposal permits and downtown employee digital parking permits and daily visitor passes based upon receiving the appropriate information and payment as described below:
(a) 
Resident Digital Parking/Disposal Permit:
(1) 
Must complete the required application with name, Summit address, with home and business phone numbers and an email address (for future parking announcements or renewal notices).
(2) 
Summit address is the physical address located in Summit and the resident being a Summit taxpayer.
(3) 
Must provide a copy of a current vehicle registration displaying a residential Summit address with the vehicle license plate, make, model, and color.
(4) 
If vehicle is leased, resident must provide a copy of the current vehicle registration as well as a copy of a current insurance card displaying a residential Summit address.
(5) 
If vehicle is company owned or leased, the resident must provide a letter from that company stating such as well as a current home, cable or internet bill displaying a Summit address.
(6) 
Fee. A ten ($10.00) dollar administration fee for each residential digital parking/disposal permit is due with the application for a permit.
(7) 
Senior Discount Fee. A five ($5.00) dollar senior (for those sixty-two (62) years of age or older) administration fee for each digital residential/disposal parking permit is due with the application for a permit. Proof of age is required in order to receive discount.
(8) 
Permit holders are responsible to notify the Parking Services Agency by 9:00 a.m. either by phone or email on the day if said permit holder is using another household vehicle or rental vehicle for a short-term special circumstance to avoid receiving a ticket. If notification is not received the permit holder is responsible for payment of the parking violation.
(9) 
The Residential parking/disposal permit allows access into designated parking lots for Summit Residents as well as access to Summit's Recycling and Disposal Area; however, does not cover the daily parking fee.
(10) 
Permit holders are expected to park in the designated lots and ensure payment for daily parking.
(11) 
The Parking Services Agency reserves the right to reject an application or void an existing permit if said application or permit does not comply with the regulations prescribed above at any time and without notice.
(b) 
Downtown Employee Digital Parking Permit:
(1) 
Must complete the required downtown employee parking permit application and supply the required proof of being currently employed in a business located in Summit's Business District with the business name, address, phone number and email address (for future parking announcements or renewal notices).
(2) 
Part of the application will include the employee's home address, daytime phone number if different from employer's main number.
(3) 
Must provide a copy of a current vehicle registration with the vehicle license plate, make, model, and color.
(4) 
If vehicle is leased, downtown employee must provide a copy of the current vehicle registration as well as a copy of a current insurance card displaying employee's home address.
(5) 
If vehicle is company owned or leased, the downtown employee must provide a letter from that company stating such as well as the copy of vehicle registration.
(6) 
Fee. A ten ($10.00) dollar administration fee for each digital downtown employee parking permit is due with the application for a permit.
(7) 
Senior Discount Fee. A five ($5.00) dollar senior (for those sixty-two (62) years of age or older) administration fee for each digital downtown employee parking permit is due with the application for a permit. Proof of age is required in order to receive discount.
(8) 
The digital downtown employee permit allows access into downtown employee designated parking lots but does not cover the daily parking fee.
(9) 
Permit holders are expected to park in the designated lots and ensure payment for the daily parking.
(10)

(c) 
Daily Visitor Parking Passes:
(1) 
In order to accommodate visitors to businesses in the Central Retail Business District, the Parking Services Agency, or its designated agent, will sell daily visitor parking passes.
(2) 
Daily visitor parking passes displaying the current month, day and year each time vehicle is parked can be used in any long term parking lots.
(3) 
Contractors working in the Central Retail Business District must purchase daily visitor passes and park their vehicles in long term lots not at downtown street meters or in Lots #1-6 and #16.
(4) 
Approval to purchase a daily visitor parking pass is at the sole discretion of the Parking Services Agency with also the right to limit the number of visitor passes being sold to a particular individual and/or organization at any given time.
(5) 
Fees for daily visitor parking passes are as follows:
(i) 
Bulk rate of ten (10) daily visitor parking passes: $50.00.
(ii) 
Individual rate of one (1) daily visitor parking pass: $6.00.
i. 
Leasing of Parking Spaces in Parking Lot 10 (Tier Garage) by Certain Business Owners.
1. 
Lease of Spaces. Spaces in the Municipal Parking Lot No. 10 (Tier Garage), 200 Alley, and 400 Alley may be leased to owners of businesses located adjacent or close to the parking space.
2. 
Fees.
(a) 
Each lessee will pay a quarterly leased space permit fee of four hundred thirteen ($413.00) dollars to the City of Summit, effective January 1, 2005.
(b) 
Each lessee will pay a quarterly leased space permit fee of five hundred ($500.00) dollars to the City of Summit effective January 1, 2006.
(c) 
Each lessee will pay a quarterly leased space permit fee of six hundred ($600.00) dollars to the City of Summit effective January 1, 2009.
(d) 
The quarterly fee must be received by the first day of the month preceding the start of a calendar quarter. Failure to do so will result in the loss of the leased space.
In accordance with the provisions of N.J.S.A. 40:48-2.46, the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.
The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the current Manual On Uniform Traffic Control Devices (MUTCD). The cost of signs and installations shall be the responsibility of the owner of said property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the City of Summit.
The penalty for a violation and conviction of this section shall be not less than fifty ($50.00) dollars nor more than one thousand ($1,000.00) dollars and/or imprisonment in the County jail for a term not to exceed ninety (90) days, or by a period of community service not to exceed ninety (90) days.

The owners of the premises referred to in Sections 7-27 and 7-28 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the City of Summit. The owner shall be responsible for the repair and restoration or replacement of same.
