Whereas, the Township of Plumsted has carefully reviewed the provisions of N.J.S.A. 2C:7-1, commonly referred to as "Megan's Law" and concurs with the findings and declarations of the State Legislature that the danger of recidivism posed by sex offenders and offenders who commit other predatory acts against children, and the dangers posed by persons who prey on others as a result of mental illness and/or capacity requires a system of registration and other restrictions in order to adequately protect the health, safety and welfare of the residents of the Township of Plumsted; and
Whereas, there currently does not exist any state laws which concern or touch upon the prohibition of certain convicted sex offenders from residing in or living near or adjacent to areas where children regularly meet and congregate; and
Whereas, the Township Committee of the Township of Plumsted believes that is in the best interest of its residents to adopt additional regulations regarding convicted sex offenders so as to better protect the health, safety and welfare of the children of the municipality.
Now, therefore, be it ordained, by the Mayor and Township Committee of the Township of Plumsted, County of Ocean, State of New Jersey as follows.

A. 
No person over the age of eighteen (18) who has been convicted of a violation of any crime against a minor as listed in N.J.S.A. 2C:7-2, and who as a result of said conviction is required to register with the proper authorities to N.J.S.A. 2C:7-1 et seq. Registration and Notification Release of Certain Offenders shall be permitted to reside or live within two thousand five hundred (2,500) feet of any school, park, playground or day care center in the Township of Plumsted.
B. 
A person who resides or lives within two thousand five hundred (2,500) feet of any school, park, playground or day care center in the Township of Plumsted shall have sixty (60) days from receipt of written notice of the prohibition set forth herein to move. Failure to move to a location, which is in compliance with this section within that time period, shall constitute a violation of this section.
C. 
This section shall not apply to a person who established a residence prior to July 14, 2005.
D. 
Any violation of this section shall be punishable by a fine not exceeding one thousand two hundred fifty dollars ($1,250.); imprisonment for a term not exceeding ninety (90) days, a period of community service not exceeding ninety (90) days.
