It shall be unlawful for any property owner in the Township of Plumsted to sell and/or transfer title to any real property containing a residential building or structure thereon or lease, let or rent a structure or building to a lessee or tenant for a term in excess of one (1) year without said structure or building containing the requisite number of smoke and fire detectors as required for new construction under applicable state building and fire codes and/or, at a minimum, at least one (1) smoke and fire detector on each floor or story of the structure used as living space.

The Township of Plumsted Inspection Department is hereby authorized to charge a thirty dollar ($30) inspection fee and a twenty dollar ($20) certification fee in accordance with the time, efforts and costs involved in completing said smoke detector inspection and in issuing said certifications. There shall be an additional charge of twenty-five dollars ($25) for each reinspection.

The Plumsted Township Inspection Department is empowered to administer and enforce the requirements of this chapter.
Any person violating any provision of this chapter shall, upon conviction thereof, be punished by a fine of not more than five hundred dollars ($500) or imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment, in the discretion of the court; and each day such violation shall be continued shall be deemed and taken to be a separate and distinct offense.
