A. 
The City of Perth Amboy, having accepted responsibility for the administration and enforcement of the New Jersey Uniform Construction Code Regulations,[1] hereby establishes its local enforcing agency to be known as the "Office of Construction and Fire Prevention." The Office of Construction and Fire Prevention, as it pertains to enforcement of the Uniform Construction Code,[2] shall consist of the Construction Official, who shall be the chief administrator, a Building Subcode Official, a Plumbing Subcode Official, an Electrical Subcode Official, an Elevator Subcode Official, a Fire Protection Subcode Official and such other subcode officials for such official subcodes as the Commission of the New Jersey Department of Community Affairs shall hereinafter require pursuant to applicable law and regulations.

B. 
Each subcode position required by the New Jersey Uniform Construction Code[3] shall be filled by a person qualified and licensed pursuant to N.J.S.A. 52:27D-119 et seq., as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site third-party inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. The same person may hold more than one (1) subcode position, provided that such person is qualified and licensed in each subcode.

C. 
The public shall have the right to do business with the enforcing agency at one (1) office location, except for emergencies and unforeseen or unavoidable circumstances.

The Building Subcode fees shall be as follows:
(1)
New Construction: up to 100,000 cubic feet, the fee shall be computed by volume multiplied by 0.040.
(2)
New Construction over 100,000 cubic feet the fee shall be computed by volume multiplied by 0.037.
(3)
The unit rate for large, open volume single story spaces in buildings, such as barns, silos, greenhouses, warehouses, distribution centers and other storage-use occupancies, shall be calculated at 0.035 per cubic root of volume to a maximum height of 20 feet even though the actual height of the space may be greater.
New Construction: Commercial farm building and structure on farms. The fee shall be computed by volume multiplied by 0.0011 to maximum of $1,145.

Plumbing UCC in-house fees and definitions. Plumbing for the following terms shall apply herein.
Plumbing appliance means and includes, but shall not be limited to, hot water heaters, tank-less heater units, water conditioners and similar equipment.
Plumbing appurtenance means and includes but shall not be limited to devices, be the device a manufactured device or an on-the-job assembly on component parts, which device is an adjunct to the basic piping system and plumbing fixtures. Plumbing appurtenances shall include but be limited to pressure-reducing valves, backflow prevention, back water valves, vacuum breakers, grease traps, interceptors and similar devices.
Plumbing fixtures means and includes but shall not be limited to stacks, lavatories, kitchen sinks, stop sinks, urinals, water closets, toilets, bathtubs, shower stalls, laundry tubs, floor drains, washing machine connections, hose bibs and similar devices.

B. 
In the event that the city contracts with a private on-site inspection and plan review agency to carry out the enforcement of one or more of the subcodes, the amount charged for work done by the private agency shall be the uniform percentage bid, by the successful bidder, of the fee set forth in N.J.A.C. 5:23-4.20 and 5:23-12.6(a) and (b) as of the date on which the bids are open plus a forty percent (40%) administrative fee pursuant to N.J.A.C. 5:23-4.18(j). Such fees shall be in effect during the entire contract period and shall not be affected by any increase in fees during the contract term.

Editor's Note: Former Subsection C, which set a fee for a certificate which set a fee for a certificate of approval when a certificate of occupancy was not required by law or regulation, was repealed 2-25-1988 by Ord. No. 933-98. This fee applied to private on-site agencies whose bid proposal was opened prior to 1-1-1996.
D. 
In accordance with N.J.A.C. 5:23-4.19, in order to provide for the training, certification and technical support programs required by the State Uniform Construction Code Act, the enforcing agency shall collect a surcharge fee based on the volume of new construction within the city. Said fee shall be in accordance with the provisions as set forth in N.J.A.C. 5:23-4.19(b)1 through 6. The surcharge fees identified in the section shall be remitted to the Bureau of Regulatory Affairs as prescribed for in N.J.A.C. 5:23-4.19(c)1.

A. 
Permit required. No person or persons, firm or corporation shall move or cause to be moved or aid or assist in moving any building into, along or across any street, highway, public lane or alley in the City of Perth Amboy unless a permit shall be previously obtained from the Director of Municipal Utilities and Public Works and the Construction Official of the City of Perth Amboy.
B. 
Application for permit. No permit shall be issued for the moving of any building into, along or across any street, highway, public lane or alley in the City of Perth Amboy unless the owner of the building and the person or persons, firm or corporation about to move the same shall present an application, in writing, addressed to the Director of Municipal Utilities and Public Works and the Construction Official describing in detail the building to be moved, including its dimensions, present and proposed locations and the streets, highways, public lanes or alleys along and across which the building is intended to be moved.
C. 
Width of building restricted. No permit shall be issued as aforesaid unless such building shall be less than 60% in width of any street, highway, public lane or alley into, along and across which the building shall be moved.
Violations of this chapter shall be punishable pursuant to N.J.A.C. 5:23-1 et seq.
