No gasoline shall be dispensed by any service station located in the City of Perth Amboy except into the fuel tanks of operating motor vehicles or motorcycles when such tanks are connected with the carburetion system of such vehicle or cycle; provided, however, that individual sales up to one (1) gallon may be made in metal receptacles when painted red and labeled in full conformity as an approved safety can by Underwriters' Laboratories, Inc. or the National Board of Fire Underwriters. Such individual sales are limited to one (1) gallon to any one (1) person.
No gasoline shall be stored in any residential, commercial or industrial building within the City of Perth Amboy in excess of one (1) gallon except in an approved safety can or while contained in the gasoline tank of an operating motor vehicle, motorcycle, lawn mower, tractor, generator or other similar mechanical implement.
Any person, individual, firm or corporation who shall violate any provisions of this chapter shall, upon conviction, be punished by a fine of not to exceed five hundred dollars ($500) or by imprisonment in the county jail for a period of not to exceed ninety (90) days, or by both such fine and imprisonment, and each violation of any of the provisions of this chapter and each day the same is violated shall be deemed and taken to be a separate and distinct offense.
The penalty set forth in § 246-3 shall not be deemed to be in lieu of any provision of any ordinance of the City of Perth Amboy which provides for revocation or suspension of any license or permit issued thereunder.
