[HISTORY: Art. I adopted by the Common Council (now the Council) of the City of Perth Amboy 5-16-10 as Ord. No. 695; Art. No person, persons or corporation shall exhibit in the City of Perth Amboy any traveling or other show, circus, menagerie, athletic or scientific exhibition or theatrical or variety performance without first obtaining a license therefor as herein described.
No license shall be granted for any theater, opera house, public hall or moving-picture show unless the same shall be first approved by the Mayor, Chief of the Fire Department and the Director of Police under such rules and regulations as shall be adopted by them.
The license fees to be charged for licenses required by this Article shall be as follows:
A. 
For a license for a circus, two hundred dollars ($200) per day.
B. 
For a license for a concert or entertainment, fifty dollars ($50) per day; provided that this fee shall not apply to a concert or entertainment given for charitable or benevolent purposes.
C. 
For a license for a scientific or athletic performance or exhibition, one hundred dollars ($100) for each performance or exhibition.
D. 
For a license for a theater or moving-picture house, thirty cents ($0.30) per seat.

The Mayor shall have authority to decide whether a license is required under the terms of the preceding section when there is a doubt as to an application, and he shall also have authority to revoke a license for any theater, opera house, public hall or moving-picture show upon its failure to comply with whatever rules and regulations that may be required. Upon the payment of a license fee to the City Clerk and the production of his receipt therefor to the Mayor, he may give to the applicant a license, which shall state the name of the person or persons licensed and the purpose for which it was granted.

Any person or persons who shall make or have any exhibition or show of any kind hereinabove described without first obtaining a license therefor as hereinabove provided shall, upon conviction, be subject to a fine not exceeding five hundred dollars ($500) or imprisonment not exceeding ninety (90) days, or both such fine and imprisonment.

No person or corporation having a license for any of the purposes mentioned in § 371.2 shall present or expose to view any pictures, exhibitions or performances of obscene, immoral, vicious, degrading or demoralizing character.

For the purpose of this Article, the terms used herein are defined as follows:
PERSON
Includes male or female, singular and plural, and also means and includes any person, firm, corporation, club, partnership, society or any other form of association or organization.
It shall be unlawful for the owner, proprietor, lessee or occupant of any premises in the City of Perth Amboy to permit, allow, participate in, give, present, produce or conduct therein any lewd, indecent, obscene or immoral drama, play, exhibition, show, burlesque, vaudeville or other entertainment in the City of Perth Amboy which tends to corrupt or harmfully influence the public morals.
It shall be unlawful for any person, either as owner, manager, producer, director, agent, promoter or actor, or who acts in any other capacity, to give, direct, present, produce, conduct or participate in any lewd, indecent, obscene or immoral drama, play, exhibition, show, burlesque, vaudeville or other entertainment in the City of Perth Amboy which tends to corrupt or harmfully influence the public morals.
Any person who violates any of the provisions of this Article shall, upon conviction thereof, be punished by a fine not exceeding five hundred dollars ($500) or by imprisonment not exceeding ninety (90) days, or by both said fine and imprisonment.
