For the purpose of this Regulation, certain terms or words herein
shall be interpreted or defined as follows:
A. Words in the present tense include the future tense.
B. Words in the singular include the plural.
C. Word in the masculine include the feminine and neuter.
D. The word "shall" is to be interpreted as mandatory.
E. The word "may" is discretionary.
F. Words not specifically defined herein shall be used as defined in
the latest edition of Webster's New Collegiate Dictionary.
As used in this chapter, the following terms shall have the
meanings indicated:
APPLICATION
An application for subdivision or resubdivision or lot line
change contains information and supporting documentation as required
by these regulations.
ARTERIAL STREETS
Streets that receive traffic from collector, residential
collector, or residential streets. They serve to convey traffic to
destinations within Town, to destinations in neighboring towns or
in the next county or region, or to convey traffic to a freeway or
limited access highway. Arterial streets are sometimes regional two-lane
roadways owned by the state and usually contain the Town's signalized
intersections. These roads usually serve to provide the major routes
out of or through Town.
BOULEVARD STREET
A street consisting of two one-way lanes divided by a landscaped
or natural median strip. A boulevard street may be categorized as
a residential street (light or standard), collector street, or arterial
street. A boulevard that does not otherwise form a loop shall not
constitute a loop street.

COLLECTOR STREETS
Streets that receive traffic from residential and residential
collector streets and serve to convey traffic to the arterial streets.
These streets may have residential homes abutting each side, but may
also have large tracts of open space suitable for future development
or subdivision resulting in several neighborhoods.
COMMERCIAL STREETS
Streets that receive and distribute traffic for a commercial
complex or center. They provide direct access to parking lots in commercial
or business centers and can also be designed to provide additional
curbside parking.
COMMISSION
The Planning Commission of the Town of Marlborough.
COMMUNITY SEWAGE SYSTEM
A waste disposal system as defined by Section 7-245 of the
Connecticut General Statutes, as amended.
COMMUNITY WATER SYSTEM
Any subdivision application which proposes the use of a water
company as that term is defined in Section 16-262m(a) of the Connecticut
General Statutes, as amended.
COMPLETED SUBDIVISION
A subdivision is completed when all public improvements have
been installed, inspected by the Town Engineer or other appropriate
authorities in accordance with the approved plan, these regulations
and the Town of Marlborough Highway Construction and Design Standards
and an as-built plan has been approved by the Commission.
CUL-DE-SAC
A temporary dead-end street having only intersection with
another street and terminating in a vehicular turnaround area with
the ability for a future connection of the street to an existing or
proposed through street.
CURBLINE
Is the edge of the paved portion of the travel way or the
backside of any curbing.
DATE OF SUBMISSION
Date established by the authorized representative for the
Commission upon acceptance of a signed application form, the appropriate
fee and supporting materials. Date of submittal must be at least four
days prior to a regularly scheduled meeting in order to be scheduled
on the agenda and received by the Commission.
DEAD-END STREET
A street that has one outlet onto a through street and terminates
in a circular turnaround or closed loop without the ability for an
extension to an existing or future through street.
DEVELOPER
The person, persons, corporation, partnership or firm proposing
a subdivision, either for themselves or as an agent for others.
DEVELOPMENT
Any construction or grading activities to improved or unimproved
real estate.
DISTURBED AREA
Any area where the ground cover is modified, regraded or
removed leaving the land subject to accelerated erosion.
EASEMENT
A right established in a real estate deed, or otherwise,
to permit the use of land or to place limitations on the use of land
by the public, a corporation, or particular persons for specified
uses and activities.
EROSION
The detachment and movement of soil or rock fragments by
water, wind, ice or gravity.
FINAL APPROVAL OF SUBDIVISION OR RESUBDIVISION
An official act of the Commission which entitles the subdivider
to file a signed Mylar copy of the subdivision plan with the office
of the Town Clerk and to proceed with the subdivision plan under provisions
cited in these regulations.
GRADING
Any excavating, grubbing, filling (including hydraulic fill)
or stockpiling of earth materials or any combination thereof, including
the land in its excavated or filled condition.
H.C. AND D.S.
The Highway Construction and Design Standards which are detailed
as Appendix IV of these regulations.
IMPROVEMENT
Any change or alteration to the existing conditions of the
subdivision site for the purpose of complying with these regulations
or rendering the site more suitable for development and/or habitation.
INDUSTRIAL STREET
Streets that receive and distribute traffic for industrial
zones, parks or subdivisions, generally carrying heavy truck traffic
with no street parking allowed.
LOOP STREET
A street which doubles back and intersects with itself, creating
an area of land encircled by the double portion of the street. The
land area encompassed by the loop shall either contain four acres
in area, or contain no fewer than four lots. A loop street may consist
of a boulevard or a single pavement street.
LOT
The unit or units into which land is divided with the intention
of offering such units for sale, either as undeveloped or developed
sites, regardless of how they are conveyed. Lot shall also mean parcel,
site or any similar term.
OWNER
Is the person(s) or legal entity owning the property as listed
in the Land Records of the Town of Marlborough.
PLAN OF CONSERVATION AND DEVELOPMENT
A master plan adopted by the Planning Commission pursuant
to the C.G.S. for the most desirable use of land for residential,
recreational, commercial, industrial and other purposes containing
the Commission's recommendations for population density, streets
and other public ways, municipal development, public utilities, public
housing and redevelopment.
RECEIVING APPLICATION FOR SUBDIVISION OR RESUBDIVISION
An application for subdivision or resubdivision shall be
received by the Commission at the next regularly scheduled meeting
of the Commission immediately following the date of submission to
the Commission or its authorized representative of the completed application
form, the appropriate fee, and supporting materials or 35 days after
such submission, whichever is sooner.
RESIDENTIAL COLLECTOR STREET
Streets that receive more traffic activity than residential
streets, serving to collect traffic from residential streets and convey
it to the major street system (collector and arterial streets). These
streets provide direct access to neighborhoods, often serving several
neighborhoods up to about 300 homes. Residential collectors may have
residential homes abutting each side, but may also have open space
suitable for future neighborhood development.
RESIDENTIAL STREET
Streets that are relatively short and generally serve a neighborhood,
often ending in a cul-de-sac or at another residentia street. These
streets usually service up to 150 homes and sometimes have a subclassification
of light residential which services fewer than 50 homes.
RESUBDIVISION
A change in a map of an approved or recorded subdivision
or resubdivision if such change:
A.
Affects any street layout shown on such map;
B.
Affects any area reserved thereon for public use; or
C.
Diminishes the size of any lot shown thereon and creates an
additional building lot, if any of the lots shown thereon have been
conveyed after the approval or recording of such map.
SEDIMENT
Solid material, either mineral or organic, that is in suspension,
is transported, or has been moved from its site of origin by erosion.
SOIL
Any unconsolidated mineral or organic material of any origin.
STEM STREET
The portion of a dead-end or cul-de-sac street prior to the
arc and the portion of the loop street intersected by the loop.
STREET
An improved public right-of-way that has been accepted by
the Marlborough Board of Selectmen, a state road, a proposed street
in an approved subdivision if a performance bond has been accepted
by the Town or a private right-of-way that has been approved by the
Marlborough Planning or Zoning Commission. Street shall include and
mean streets, avenues, lanes or any right-of-way dedicated to and
legally accepted for the purpose of public travel and which shall
have at least one intersection with another Town street.
STREET HIERARCHY
The conceptual arrangement of streets based upon function.
A hierarchical approach to street design classifies streets according
to function, from high traffic arterial roads down to streets whose
function is light residential.
STREET LINE
The dividing line between the street right-of-way and private
property. Where such a line has not been established and no existing
evidence exists, such as stone walls, fence lines or other features,
it is deemed for purposes of these Regulations to be a line parallel
to the centerline of the traveled surface with a distance of 25 feet
between said lines.
SUBDIVISION
The division of a tract or parcel of land into three or more
parts or lots, made subsequent to the adoption of subdivision regulations
by the Commission, for the purpose, whether immediate or future, of
sale or building development, expressly excluding development for
municipal, conservation or agricultural purposes, and includes resubdivision.
SUBDIVISION EXPIRATION DATE
A subdivision shall be completed within five years from the
date of final approval or within a shorter period of time if established
by the Commission or final approval expires, becoming null and void
and of no legal standing. When a subdivision approval expires, the
Commission may take actions as specified in Section 8-26c of the Connecticut
General Statutes.
SUBSURFACE SEWAGE DISPOSAL SYSTEM
A waste disposal system consisting of a house sewer, a septic
tank followed by a leaching system, and necessary pumps and siphons,
and any groundwater control system on which the operation of the leaching
system is dependent.
