Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the New Jersey Statutes Annotated shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a.
The
Chief of Police, the Director of the Department of Police or the Mayor,
in his absence, disability or inability to act, then the designee
of the Mayor is hereby authorized to provide by regulation for the
closing of any street or portion thereof to motor vehicle traffic
on any day or days during specified hours or whenever he/she finds
that such closing is necessary for the preservation of the public
safety, health or welfare.
b.
Any regulation
promulgated by the Governing Body and in accordance with paragraph
a, above, shall provide for the posting of proper warning signs of
such closing on any street or portion thereof during the time the
same is closed in pursuance thereof.
c.
Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed $50.
d.
Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the City of Sea Isle City are
hereby repealed, and all ordinances or parts of ordinances in conflict
with or inconsistent with the provisions of this chapter are hereby
repealed, except that this repeal shall not affect or prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other, more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
police officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
b.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

a.
Whenever snow has fallen and the accumulation is such that it covers
the streets or highways, an emergency shall exist and no vehicles
shall be parked on the east or west sides of Landis Avenue between
and including 1st Street and 93rd Street.
The above parking prohibitions shall remain in effect after
the snow has ceased until the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
b.
To allow for street cleaning, no vehicle shall be parked on the following
streets or highways or portions thereof during the so designated times:

No person shall park, or cause to be parked, any commercial motor
vehicle, noncommercial truck, truck, omnibus, school bus, pole trailer,
trailer, or recreational vehicle with a gross vehicle weight of four
tons or any camper, recreational vehicle, boat or utility trailer,
regardless of weight, on any City street at any time.
b.
Exceptions.
1.
The provisions of paragraph a shall not apply to any vehicle which
is parked upon any street for the purpose of loading or unloading
supplies, materials, foodstuffs or other such items or construction
vehicles during construction. The operator, owner, or person in possession
of the vehicle shall be responsible for any violation of this subsection.
2.
The provisions of paragraph a shall not apply to utility trailers
from October 15th to April 30th of each year.

All streets within the City of Sea Isle City shall have a speed
limit of 25 mph (miles per hour), conditions permitting, unless designated
herein as authorized under the provisions of N.J.S.A. 39:4-8 b(1).
Regulatory and warning signs shall be erected and maintained
to effect the below designated speed limits.

No person shall disobey or fail to follow the order, direction
or other signal of any Police Officer, New Jersey State Trooper or
other properly authorized law enforcement official within the City;
nor shall any persons disobey or fail to follow the traffic instructions
on any properly posted traffic control device or traffic signal within
the City.
Any person violating this provision shall, upon conviction,
be punished for each offense by a fine not to exceed $500 or by imprisonment
for any term not exceeding 30 days, or both.

a.
No motor vehicle shall be operated on any public street or roadway
or any portion of the public street or roadway, including any designated
shoulder, where flooding exists at a rate of speed or in a manner
as to cast or discharge a wake that exceeds six feet. For the purpose
of this chapter, "flooding" shall mean the existence of water on the
surface of any portion of the public street or roadway, including
any designated shoulder, which exceeds six inches in depth.

b.
This section shall not apply to the Sea Isle City Police Department
or emergency vehicles and shall not include individuals who are operating
a motor vehicle for the purposes of an emergency or a medical emergency.

Any person violating the provisions of § 7-19.3 shall, upon conviction thereof, be punishable by a fine of not more than $1,250 or by imprisonment for a term not exceeding 90 days, or both. For the purposes of a prosecution under this section, it shall not be a defense that the wave or wake that was created by operation of a motor vehicle on a flooded roadway did not cause actual damage to public or private property.

Streets designated herein are approved for installation of speed
humps in accordance with N.J.S.A. 39:4-8.10 and 39:4-8.11, having
met the following criteria:
a.
The streets are totally self-contained within the municipality and
have no direct connection with any street in any other municipality.
b.
On two-lane residential streets and on one-way residential streets
under municipal jurisdiction.
c.
The streets have a traffic volume under 3,000 vehicles per day.
d.
The streets have a posted speed limit of 30 miles per hour or less.

This section is enacted in accordance with N.J.S.A. 39:4-197,
which does confer upon the City of Sea Isle the right to establish
designated restricted parking spaces for handicapped persons who have
been issued special vehicle identification cards by the Motor Vehicle
Commission. In addition, pursuant to N.J.S.A. 39:4-197.5, any municipality
may by ordinance establish restricted parking spaces in front of residences,
schools, hospitals and other public buildings and in shopping and
business districts for the use by persons who have been issued special
vehicle identification cards by the Motor Vehicle Commission.

As shown in attached Schedule A, those areas shall be designated
as handicapped parking spaces and shall be so marked by signs in conformance
with the current Manual on Uniform Traffic Control Devices for Streets
and Highways and said Schedule is made part of this section.

Notice of this section will be effective by placing its provision
on signs according to specifications contained in the current Manual
on Uniform Traffic Control Devices pursuant to N.J.S.A. 39:4-198.
In addition to the specifications in the Manual on Uniform Traffic Control Devices, any sign erected before and after the effective date of this amendatory and supplementary act to notify the public that parking in a space that is reserved for a handicapped person shall also state the penalties set forth in subsection 7-20.5 of this section which are pursuant to N.J.S.A. 39:4-197 Subsection 3 paragraph c which may be imposed for a violation.

Upon passage of any necessary amendments to the Revised General
Ordinances of the City of Sea Isle City ("The Code") using measurements
taken by the City Engineer to designate handicapped spaces, and the
designation of the handicapped spaces listed on the attached Schedule
A, the Sea Isle City Police Department shall enforce parking restrictions
on all designated handicapped parking spaces in the City of Sea Isle
City.
Pursuant to N.J.S.A. 39:4-207.7, an eligible handicapped person
may request a law enforcement officer to arrange for the removal and
storage of a motor vehicle which is unlawfully parked in a parking
space or zone which is restricted for use by a handicapped person.
It shall be the obligation of the owner of the motor vehicle to pay
the reasonable costs for the removal and for any storage which may
result from the removal.

For a violation of any provision of this section, the minimum
mandatory fine shall be $250 for the first offense and for subsequent
offenses, the penalty shall be a fine of at least $250 and up to 90
days of community service on such terms and in such form as the Court
shall deem appropriate, or any combination thereof.

It shall be unlawful for the operator of any commercial vehicle/boat
at any dates/times to cause the loading or unloading of any goods
and materials whatsoever from/to a boat on all City-owned Bay Street
curbs, upon all sides, from or to the Bay, the curbs adjacent to,
or in the general proximity of Bay Street curbs or any other place
on, at, or near the Bay Street curbs.
This section and provision shall be enforced by the Sea Isle City Police Department or any other law enforcement agency having jurisdiction to enforce traffic provisions of the State of New Jersey. Violations of this section shall be punishable as set forth in Chapter 1, § 1-5, in the discretion of the Municipal Court Judge.
