Borough of Manasquan, NJ Chapter 7 Traffic

Editor's Note: Chapter 7, Traffic, was adopted by Ordinance No. 1951-05 on April 18, 2005. The New Jersey Department of Transportation in their letter dated July 29, 2005 issued approval for Ordinance No. 1951-05 and the codification of Chapter 7, Traffic.

§ 7-1 DEFINITIONS.

§ 7-1.1 Words and Phrases.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used therein.

§ 7-1.2 Official Time Standard.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

§ 7-2 CLOSING OF STREETS.

§ 7-2.1 Authorization for the Closing of Any Street.

a. The Chief of Police or, in his absence, disability or inability to act, the Deputy Chief of Police, and in the event of his absence, disability or inability to act, then the Shift Commander of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.

b. Any regulations promulgated by the Chief of Police and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.

c. Any violation of this regulation promulgated hereunder shall be punished by a fine not to exceed $50.

d. Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

§ 7-2.2 Closing of Certain Streets When School Is in Session.

a. Virginia Avenue between Union Avenue and Mount Lane.

1. Virginia Avenue, between the easterly side of Route NJ 71 (Union Avenue) and the westerly side of Mount Lane, shall be closed between the hours of 11:45 a.m. and 12:30 p.m. on any days when the St. Denis School is in session to permit the use of that portion of Virginia Avenue for ingress and egress to the St. Denis School and for use by the pupils of the St. Denis School for recreational purposes, pursuant to N.J.S.A. 40:67-16.7.

2. Proper warning signs indicating that the above described portion of Virginia Avenue is closed during 11:45 a.m. until 12:30 p.m. shall be posted as required by law.

§ 7-2.3 Temporary Closing of Riddle Way.

Riddle Way between 2nd Avenue and 3rd Avenue shall be temporarily closed from May 1st through September 30th annually. The detour route for traffic shall be along the municipal streets of Main Street and 3rd Avenue. Any and all properties which have residential driveway access between 2nd and 3rd Avenues shall be exempted during the enforcement of this subsection.

§ 7-3 TOW-AWAY.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

§ 7-4 PENALTIES.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to the penalty stated in Chapter 1, Section 1-5.

§ 7-5 EFFECT OF ORDINANCE.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

§ 7-6 REPEAL.

All former traffic ordinances of the Borough of Manasquan that are contained in this chapter are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

§ 7-7 PARKING.

§ 7-7.1 Regulations Not Exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

§ 7-7.2 Parking Prohibited During State of Emergency.

a. Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

b. The effectiveness of this subsection is contingent upon the signs being erected as required by law.

§ 7-7.3 Temporary Parking Prohibition for Snow Plowing and Removal.

a. Whenever snow has fallen and the accumulation is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated.

The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

b. Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

§ 7-7.4 Stopping and Standing Prohibited During Certain Hours on Certain Streets.

No person shall stop or stand a vehicle between the hours specified on any day upon any of the streets or parts of streets described.

§ 7-7.5 Parking Time Limited on Certain Streets.

No person shall park a vehicle for longer than the time limit between the hours listed on any day upon any of the streets or parts of streets described. The time limitations set forth in subsections "a" through "d" shall not reset or start over if the vehicle is moved to a different parking spot on the same street or if the vehicle leaves and returns at a later time during the specified hours on the same day.

The two-hour parking restriction applicable to any street "when public school is in session" shall not apply to any motor vehicle whose license plate is registered with the New Jersey Motor Vehicle Commission to a property address or bona fide resident of a property address that is located within the restricted bounds of those streets as long as the license plate registration number has been properly filed with the Manasquan Police Department for this purpose.

§ 7-7.6 Parking Prohibited for Street Cleaning.

No person shall cause or permit to be parked any motor vehicle upon any designated street between the specified hours and days described.

§ 7-7.8A Parking by Permit During Certain Hours on Certain Days on Certain Streets.

No person shall park a vehicle on streets or parts of streets as described within the following sections unless an appropriate and current parking permit as issued by the Borough of Manasquan is displayed on said vehicle for those streets or parts of streets as described or listed within the following sections.

§ 7-7.8B Parking Restricted to Fire Department Personnel.

No person, other than Fire Department personnel, shall cause or permit to be parked any motor vehicle upon any of the streets or parts of streets.

§ 7-7.9 Restriction on Parking of Boat Trailers, Recreational Trailers, Utility Trailers or Similar Vehicles.

a. Commercial and Noncommercial Motor-Drawn Vehicles. No commercial or noncommercial motor-drawn vehicle, such as a boat trailer, recreational trailer, utility trailer or similar vehicle may be parked on any street in the municipality excluding State Highways between the hours of 6:00 p.m. and 6:00 a.m., except for vehicles making deliveries or services to or for residents or occupants of structures on the street.

b. Commercial and Noncommercial Motor-Drawn Vehicles Detached from a Motor Vehicle. No commercial or noncommercial motor-drawn vehicle, such as a boat trailer, recreational trailer, utility trailer or similar vehicle, may be parked on any street in the municipality excluding State highways when the same is detached from a motor vehicle.

§ 7-7.10 Head-In Angle Parking.

§ 7-7.11 Restriction for Omnibus or Limousine Parking.

Vehicles with omnibus or limousine license plates issued by the State of New Jersey or by any other state, territory or country shall be restricted to a 20 minute parking limitation whenever said vehicles are parked or placed or caused to be parked or placed on any street or municipal parking lot within the Borough of Manasquan other than for the purpose of picking up or discharging passengers. All ordinances or provisions of any other ordinance inconsistent with this provision are hereby repealed only to the extent of those inconsistencies.

§ 7-8 VEHICLES IN EXCESS OF DESIGNATED WEIGHT.

§ 7-8.1 Parking Prohibited for Certain Types of Vehicles and Equipment in Residential Zones.

a. No person shall park or place or cause to be parked or placed any vehicle, truck, tractor, trailer, tractor-trailer, construction vehicle or construction equipment, or any vehicle of any description which weighs over 12,000 pounds registered gross weight on any street or on any lot in a residential zone for more than one hour. This prohibition shall not apply to any vehicle being used to provide services or delivery to any residence, or any public utility vehicle servicing a residence or residences, except that these vehicles shall be removed as soon as such services or deliveries are completed.

b. No construction vehicle or equipment, such as bulldozers, tractors, cement mixers or similar equipment shall be parked or placed on any lot in a residential zone except for immediate and continued use for construction purposes on that lot, and such vehicle or equipment must be removed as soon as construction is completed or terminated.

§ 7-8.2 Parking of Trucks Over 8,000 Pounds Registered Gross Weight During Certain Hours.

No person shall park a truck over 8,000 pounds registered gross weight on any street between 9:00 p.m. and 6:00 a.m., excluding State highways.

§ 7-8.3 Vehicles Over Four Tons Excluded from Certain Streets.

a. Vehicles Over Four Tons. Vehicles over four tons registered gross weight are hereby excluded from the streets or parts of streets described except for the pick-up and delivery of materials on such streets and for trucks of public utilities and governmental agencies.

b. Parking of commercial vehicles over 8,000 pounds registered gross weight on private property in any residential area. No person shall park more than one commercial vehicle over 8,000 pounds gross vehicle weight on any property in a residential zone between 9:00 p.m. and 6:00 a.m.

§ 7-16.3 Fines and Penalties.

a. Any person violating; § 7-16.1, Taxi Stand Established, and § 7-16.2, Active Pickup and Drop-Off Zone, upon conviction, is subject to fine not to exceed $54; any person violating any provision other than § 7-16.1, Taxi Stand Established, and § 7-16.2, Active Pickup and Drop-Off Zone, of this section shall, upon conviction of a first offense, be subject to a fine of not to exceed $250; on conviction of a second offense, be subject to a fine of not to exceed $500; and for a third or subsequent offense, be subject to a fine of $1,250, and/or be subject to a term of imprisonment not exceeding 90 days in the county jail, or in any other place provided by the municipality for the detention of prisoners, or both.

b. Any corporation violating any of the provisions of this section other than § 7-16.1, Taxi Stands Established, and § 7-16.2, Active Pickup and Drop-Off Zone, shall, upon conviction, pay a fine of not less than $500 nor more than $1,250.

c. Nothing herein shall preclude the prosecution of any such violation under Title 48 and/or Title 2C of the New Jersey Statutes nor restrain or prohibit the Mayor and Council from suspending or revoking any license issued hereunder in accordance with the provisions of this section.

§ 7-31.1 Regulations for the Movement and the Parking of Traffic on Municipal Property and Board of Education Property.

In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education Property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.

a. MANASQUAN MUNICIPAL COMPLEX, 201 East Main Street.

REGULATIONS:

1. General Parking:

A. All vehicles must park in designated areas and between the lines provided.

B. No person shall park a vehicle for longer than the time limit upon any of the streets or parts of streets described below.

REGULATIONS

1. General Parking.

A. All vehicles must park in designated areas and between the lines provided.

B. No commercial or noncommercial motor-drawn vehicle, such as a boat trailer, recreational trailer, utility trailer or similar vehicle, may be parked on this lot between the hours of 6:00 p.m. and 6:00 a.m. except for vehicles making deliveries to or performing services for residents or occupants of structures on the street.

C. No commercial or noncommercial motor-drawn vehicle, such as a boat trailer, recreational trailer, utility trailer or similar vehicle, may be parked at any time on this lot when the same is detached from a motor vehicle.

2. Permit Parking. No person shall park a vehicle on the parking lot during times indicated unless the vehicle shall have a valid permit displayed.

3. Handicapped Parking. All stalls shall be 12 feet wide and signed with the R7-8 and R7-8P (Reserved Parking Sign and Penalty Plate), in the designated parking areas for persons who have been issued the handicapped parking permit by the Motor Vehicle Commission.

§ 7-31.2 Regulation for the Movement and the Parking of Traffic on Private Property Open to the Public and to Which the Public Is Invited (Retail Business).

In accordance with the provisions of N.J.S.A. 40:48-2.46, the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.

§ 7-31.5 Regulation for the Movement and the Parking of Traffic on United States Post Office Property.

In accordance with 40 U.S.C. 318B and a written request from the Postmaster, the following Various Traffic Regulations are hereby made applicable to the properties listed below as follows. No person shall operate or park a vehicle in violation of the regulations listed below.

§ 7-31.6 Signs, Pavement Markings, Installation and Maintenance.

The owners of the premises referred to in subsections 7-31.2, 7-31.3 and 7-31.5 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the most current edition of the "Manual on Uniform Traffic Control Devices." The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property.

The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Manasquan. The owner shall be responsible for the repair and restoration or replacement of same.
