The following residency requirements are established for initial appointment for employment by the Municipality.
a. 
Unless otherwise provided by law, all applicants for positions designated as career service by the Department of Personnel shall be bona fide residents of the Borough of Manasquan as of the date of appointment for employment, subject to the exceptions of N.J.S.A. 40A:9-1 et seq. Legal residence shall be determined by the standards established in N.J.A.C. 4A:4-2.11.
b. 
Unavailability of Qualified Residents.
1. 
When the appointing authority of the Borough of Manasquan has determined that there cannot be recruited a sufficient number of qualified residents for available specific positions or employments, the appointing authority shall advertise for other qualified applicants. Classification of qualified applicants in such instances shall be determined in the following manner:
(a) 
Other residents of Monmouth County.
(b) 
Other residents of counties contiguous to Monmouth County.
(c) 
Other residents of the State.
(d) 
All other applicants.
All appointments shall be made in the order of preference established above, except subject to preferences granted pursuant to any other provisions of the law.
c. 
Special Talent Positions.
1. 
Whenever the appointing authority shall determine that there are certain specific positions and employments requiring special talents or skills which are necessary for the operations of the Borough of Manasquan and which are not likely to be found among the residents of the municipality, such positions or employments so determined shall be filled without reference to residency.
2. 
These provisions shall set forth the formal criteria pursuant to which such positions and employments shall be so determined. The criteria shall be established by the appointing authority as the need shall so exist from time to time.
d. 
Provisions Applicable to Initial Appointment. The above provisions shall apply only to initial appointments and not to promotional appointments.

a. 
Classification of Applicants.
1. 
Before any person shall be appointed as a member of the Manasquan Police Department, the appointing authority shall classify all the duly qualified applicants for the position or positions to be filled in the following classes:
(a) 
Class I: Residents of Manasquan.
(b) 
Class II: Other residents of Monmouth County.
(c) 
Class III: Other residents of the State.
(d) 
Class IV: All other qualified applicants.
2. 
All appointments shall be made in the order of preference established above, except subject to preferences granted pursuant to any other provision of the law.
b. 
Appointments by Classification. In making appointments, the appointing authority shall first appoint all those in Class I and those in each succeeding class in the order above listed and shall appoint a person or persons in any such class only to a vacancy or vacancies remaining after all qualified applicants in the preceding class or classes have been appointed or have declined an offer of appointment.
c. 
Lists to Be Separate and Successive. The classes of qualified applicants defined above shall be considered as separate and successive lists of eligibles, and the Department of Personnel shall, when requested to certify eligibles for positions specified in this section, make such certifications from said classes separately and successively and shall certify no persons from any such class until all persons in the preceding class or classes have been appointed or have declined offers of appointment.
d. 
Provisions Applicable to Initial Appointments. This above provision shall apply only to initial appointments and not to the promotional appointments.

The salaries and compensation of all officers and employees of the Borough of Manasquan shall be as set forth in the annual Salary Ordinance.[1]

There is hereby adopted for the purpose of establishing personnel policies and procedures for the operation and government of the Borough a manual entitled "Borough of Manasquan-Personnel Policies and Procedures." The manual is incorporated by reference in this section, and three copies of the manual are on file in the Office of the Municipal Clerk.

The personnel policies and procedures contained in the manual may be changed, altered, supplemented, and amended by resolution duly adopted by the Borough Council.

The Borough Council shall by ordinance establish titles for public employment by the Borough of Manasquan and salary ranges for municipal employees. The titles shall conform to the New Jersey Civil Service Act and regulations promulgated by the New Jersey State Department of Personnel.

The Borough Council shall by resolution adopt and amend from time to time personnel policies and procedures including rules concerning the hiring and termination of employees, terms and conditions of employment, and regulations required to comply with applicable Federal and State employment related law. The personnel policies and procedures adopted pursuant to said resolution(s) shall be applicable to all officials, appointees, employees, prospective employees, volunteers and independent contractors of the Borough of Manasquan.

The Municipal Administrator shall be responsible to implement and enforce the personnel practices adopted by ordinance or resolution authorized pursuant to this section. If there is a conflict between said personnel practices and any duly adopted and lawful collective bargaining agreement, personnel services contract or Federal or State law, the terms and conditions of that contract or law shall prevail. In all other cases, the practices adopted pursuant to this ordinance shall prevail.
