Pursuant to N.J.S.A. 52:270-202 of the Uniform Fire Safety Act
(P.L. 1983, c. 383) the New Jersey Uniform Fire Code shall be locally
enforced in the municipality of Warren.
The local enforcing agency shall be the bureau of fire prevention
of the Warren Township Volunteer Fire Department.
The local enforcement agency shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of Warren
Township, other than owner-occupied one and two family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.
The local enforcing agency established by subsection 10-8.1 of this section shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the commissioner of the department of community affairs.
The local enforcing agency established by subsection 10-8.1 of this section shall be a part of the Warren Township Volunteer Fire Department and shall be under the direct supervision and control of the Warren Township Fire Marshal who will keep the chief of the Warren Township Fire Department advised of his activities.
a.
Appointment of Fire Marshal. Each local enforcing agency shall be
under the direct supervision of a fire marshal who shall be appointed
by the Warren Township Committee which shall consider the recommendation
of the chief of the Warren Township Volunteer Fire Department. The
Warren Township Committee shall not be bound to follow the said chiefs
recommendation, but shall consider it along with whatever other items
it chooses.
b.
Term of Office. The fire marshal shall serve for a term of one year,
said term to run from January 1 to December 31 of the year of appointment.
c.
Inspectors and Employees. Such inspectors and other employees as
may be necessary in the local enforcing agency shall be appointed
by the Warren Township Committee which shall consider the recommendation
of the chief of the Warren Township Volunteer Fire Department. The
Warren Township Committee shall not be bound to follow the said chiefs
recommendation, but shall consider it along with whatever other items
it chooses.
d.
Removal from Office. The fire marshal, inspectors and other employees
of the enforcing agency shall be subject to removal by the Warren
Township Committee for inefficiency or misconduct. Each inspector
or employee to be so removed shall be afforded an opportunity to be
heard by the appointing authority or a designated hearing officer.
Pursuant to N.J.A.C. 5:70-2.19, any person aggrieved by any
order of the local enforcement agency shall have the right to appeal
to the construction board of appeals of the County of Somerset.

In addition to the inspections and fees required pursuant to
the Act and the regulations of the department of community affairs,
the following additional inspections and fees shall be required:
For inspections of all buildings and tenant areas, other than
one and two family residences, that do not fall into the categories
of "Life Hazard Uses" established in the Uniform Fire Safety Act,
the annual inspection fee shall be based on the square footage as
follows:

The charge set forth herein may be waived by the fire marshal
if the inspection is of public facilities, charitable facilities or
nonprofit facilities.

The permit fees established by the Uniform Fire Code shall be
those presently established by the State of New Jersey as follows:

The Warren Township Attorney is hereby appointed as legal counsel
to local enforcing agency established herein.

All ordinances of the Township of Warren which are inconsistent
with the provisions of this section are hereby repealed to the extent
of such inconsistency.

This section shall be effective immediately upon final passage
and publication according to law.

The Warren Township Clerk is hereby directed to provide a certified
copy of the within section to the State of New Jersey, Department
of Community Affairs, Division of Housing and Development, Bureau
of Fire Safety, 3131 Princeton Pike, CN 809, Trenton, New Jersey 08625-0809
within two days of its final passage.

Pursuant to the provisions of N.J.A.C. 5:71-1.4 entitled "Definitions" (Chapter 71 of the Code entitled "Fire Code Enforcement") the term "fire official" as used in this Chapter 10 and in other ordinances of the Township of Warren shall include the term "fire marshal."
