As used in this chapter, the following terms shall have the meanings indicated:
ACCIDENTAL FALSE ALARMS
Any false alarm which is not an intentional false alarm as defined herein, or which sounds when intrusion, crime, fire or other emergency has not actually occurred.
ALARM
An audible signal emitted by a warning device indicating that a crime, fire or other emergency situation warranting immediate action by the Police and/or Fire Departments has occurred or is occurring. This definition shall include, but shall not be limited to, those alarm devices which provide for a telephoned warning message to the control center.
ALARM SYSTEM/DEVICE
An electrical (or electronic) or mechanical device designed to automatically transmit an alarm by wire, telephone, radio or other means to a person who is instructed to notify the Control Center of the alarm or to activate a bell or sounding device to be heard outside a building which is intended to alert the police or fire company or others to the existence of a crime, fire or other emergency situation warranting Police and/or Fire Department action.
BOROUGH
East Stroudsburg, Monroe County, Pennsylvania, and its duly authorized agents, servants or employees.
CONTROL CENTER
The Monroe County Control Center.
FALSE ALARM
An alarm to which the Police and/or Fire Departments respond resulting from the activation of an alarm device when a crime, fire or other emergency warranting immediate action by the Police and/or Fire Department has not in fact occurred.
FIRE DEPARTMENT
The Acme Hose Company No. 1 and all the members thereof, or any other Fire Department authorized to act within the Borough of East Stroudsburg.
INTENTIONAL FALSE ALARM
A false alarm resulting from the intentional activation of an alarm by an individual under circumstances where that individual has no reasonable basis to believe that a crime, fire or other emergency warranting immediate action by the Police and/or Fire Departments has occurred or is occurring.
PERSON
An individual, corporation, partnership, incorporated association or other similar entity.
POLICE DEPARTMENT
The Stroud Area Regional Police Department and/or police officers of that Department, or any other police officer authorized to act within the Borough of East Stroudsburg.

TELEPHONE DIALER ALARM DEVICE
An alarm device designed to transmit a notice over regular telephone lines to a person who is instructed to notify the Monroe County Control Center or directly to the Control Center.

A. 
Every property owner wishing to install an alarm on premises they own situated in the Borough of East Stroudsburg shall file with the Borough Manager's Office, on forms provided by the Borough:
(1) 
A written application stating the name, address and telephone number of the property owner/applicant;
(2) 
Address and telephone number of at least two persons who can be contacted other than the property owner/applicant;
(3) 
A description of the property or properties where the proposed alarm system shall be installed;
(4) 
The location and street address of the property; a description of the type or types of alarm systems to be used, including the alarm model number and name of the manufacturer;
(5) 
The name of the person or company who will install the alarm system at the location; and
(6) 
The name, address and telephone number of any person or company who will be available to be contacted in the event of an alarm activation.
B. 
In the case of more than one building site in which the alarm systems shall be installed, the applicant must provide the Borough with information concerning how the alarm for each building shall be distinguishable from the other alarms in said buildings. In the event the name, mailing address, or telephone number of the person to be contacted changes, the applicant shall supply corrected information to the central monitoring station and the Borough Manager's Office within five days of the change. Failure to comply with this section shall be deemed a violation and subject to applicable penalties. The property owner or his designee, upon the request of the Borough Manager's Office, shall be required to be present at the alarm location within a reasonable length of time after being advised that the police or other emergency departments have received any signal or message of an alarm activation.

A. 
Alarm permits shall not be transferable from one individual to another, or from one location to another, without the express written authorization from the Borough Manager's Office. In the event that the premises in which the alarm system has been installed is to be conveyed or transferred to another individual, it shall be the responsibility of the permittee to notify the Borough Manager's Office of the name and telephone number of the other person to be contacted in the case of the alarm activation.
B. 
Any individual who obtains title to premises in which an alarm system has been installed and a permit issued by the Borough Manager's Office shall notify the Borough Manager's Office and make application for registration specifying all information necessary for the Borough Manager's Office or other emergency departments to respond to the alarm activation.

A. 
Every person applying for an alarm permit under the provisions of this part shall obtain an alarm permit prior to the installation of the new alarm system on the premises.
B. 
Any individual who presently owns or obtains title to premises in which an alarm system has already been installed shall register their name, address, telephone number, and individual to be contacted in case of the activation of the alarm system.
C. 
An alarm user shall obtain a user permit each calendar year.
D. 
All fees shall be made payable to the Borough of East Stroudsburg.
E. 
The Borough Council of East Stroudsburg shall by resolution set the alarm permit fees.

A. 
Intentional false alarms. No person shall create an intentional false alarm.
B. 
Accidental false alarm. For the purpose of defraying the costs to the Borough of responding to an accidental false alarm, the owner, lessee or user of an alarm system/device shall pay to the Borough a charge for each and every false alarm originating from the owner's premises to which the Police and/or Fire Department responds, that has not been activated by some force of nature or means beyond the owner, lessee or user's control, in each calendar year, as follows:
(1) 
Residential.
(a) 
First to second alarm each year: no charge.
(b) 
Third alarm and thereafter shall pay a false alarm fee.
(2) 
Commercial and industrial.
(a) 
First to second alarm each year: no charge.
(b) 
Third alarm and thereafter shall pay a false alarm fee.
(3) 
When a false alarm occurs, the Police Department shall record date and time of such false alarm and the location of each false alarm. The Borough shall within 15 working days of such false alarm contact the owner of such alarm for the purpose of notification of a false alarm. Such notice by the Borough to the owner of the alarm from which a false alarm emanated shall be in writing and mailed to the owner of said alarm at his/her/its last known mailing address. Included with this written notice shall be a bill in the prescribed amount as outlined above should a false alarm charge be due. Failure on the part of the Borough to provide such notice to the owner of the alarm device, within 15 working days after the date of such false alarm, shall preclude the Borough from assessing a false alarm charge for said false alarm.
C. 
A false alarm charge shall be due and payable at the Borough Office 30 days from the date of mailing of such notice of assessment of a charge. All fees collected for a false alarm shall be distributed to the responding entity.
D. 
Failure of the owner of an alarm device having caused a false alarm or of a person, other than the owner, causing a false alarm, to pay a false alarm charge on or before the date due shall constitute a violation of this chapter, and shall subject said person to the penalties set forth in § 64-6 hereof.

The fees pursuant to Chapter 64 of the East Stroudsburg Code shall be established by resolution of the Borough Council.

Any person, firm or corporation who shall violate or fail to meet any of the provisions of this chapter shall, upon conviction before a District Justice be punishable by a fine of not more than $600, together with the costs of prosecution, and in default thereof shall undergo imprisonment for a period not to exceed 30 days.

The information furnished and secured pursuant to this chapter shall be confidential in character and shall be so kept in order that the contents thereof shall not be known except to persons charged with the administration of this chapter.

This chapter shall become effective five days from the date of its adoption. Owners of such alarm systems existing at the time of the adoption of this chapter shall have a period of 60 days to comply with all provisions hereof.
