In accordance with the provisions of N.J.S. 39:4-197, the following on-street locations are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special vehicle identification cards or plates or placards by the New Jersey Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

In accordance with the provisions of N.J.S. 40:48-2.46, the following off-street parking yards are designated as handicapped parking areas. Such spaces are for use by persons who have been issued special vehicle identification cards, plates or placards by the New Jersey Division of Motor Vehicles or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.
Each handicapped parking space shall be marked by a vertical sign indicating that it is a handicapped parking space and shall contain the penalty for violation in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways, adopted March 20, 1973, and filed with the New Jersey State Department March 21, 1973:
a. 
Definitions. Terms used in this section shall have the meanings ascribed to them in Title 39 of the New Jersey Statutes.
b. 
Designation of Parking Spaces Reserved for the Vehicles of Handicapped Persons. In accordance with the provisions of N.J.S. 40:48-2.46 relating to parking facilities open to the public or to which the public is invited, those parking spaces enumerated in subsection 7-60.2 of this section are hereby set aside and reserved for the vehicles of handicapped persons.
In accordance with the provisions of N.J.S. 39:5A-1, an owner of private property may request that certain parking spaces be set aside and reserved for the vehicles of handicapped persons, and in the event that such a request is approved by an amendment or supplement to this section and by the New Jersey Commissioner of Transportation, then the provisions of this section, including the penalties for violations, shall apply to such parking spaces.
c. 
Signing Requirements. Each parking space set aside and reserved for the vehicles of handicapped persons pursuant to this section shall be marked with the required New Jersey designation sign (MUTCD R7-8) and the required penalty sign.
The owners of properties to which the public is invited shall be responsible for erecting and maintaining the required signs.
d. 
Restrictions on Use of Parking Spaces Reserved for Motor Vehicles of Handicapped Persons. No person shall park a motor vehicle in any parking space which is duly designated and marked in accordance with the provisions of this section as being set aside and reserved for the vehicles of handicapped persons unless:
1. 
The vehicle shall have affixed thereto special license plates bearing the national wheelchair symbol, or the vehicle shall display a handicapped placard issued by the Director of the Division of Motor Vehicles or a currently valid temporary handicapped placard issued by a Municipal Chief of Police, and
2. 
A handicapped person is either the driver or a passenger in the vehicle.
e. 
Penalties. Any person parking a motor vehicle in a parking space set aside and reserved for the vehicles of handicapped persons in violation of the provisions of this section shall be liable to a fine of $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
In accordance with the provisions of N.J.S. 39:5A-1, the following off-street parking yards are designated as handicapped parking areas. Such spaces are for use by persons who have been issued special identification cards, plats or placards by the New Jersey Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual of Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.
