A Code entitled "New Jersey State Housing Code," promulgated by the New Jersey Department of Community Affairs and establishing standards for use in determining the fitness of a building for human habitation or occupancy or use, is hereby adopted pursuant to R.S. 26:3-69.1 et seq. A copy of the Code is annexed to this chapter and made a part hereof without the inclusion of the text herein.

Three copies of the New Jersey State Housing Code have been placed on file in the offices of the Secretary of the Board of Health and the Township Clerk and will remain on file in those offices for the use and examination of the public.

a. 
Notices to Property Owners and Occupants to Comply with Housing Standards. Whenever the Board of Health of the Township of Chatham shall determine that a building or any part thereof fails to meet the standards established by the New Jersey State Housing Code hereby adopted, the Board shall cause notice thereof to be served personally or by registered mail upon the owner and any occupant of such building or part thereof. Every such notice shall set forth the specific conditions complained of and shall require the correction of such conditions within a reasonable time specified in the notice. The notice shall also state that unless the conditions complained of are corrected within the time specified the Board may declare the building or any part thereof unfit for human habitation or occupancy or use pursuant to the provisions of Section BH8-3b of this chapter, which declaration may subject the owner or occupant to penalties pursuant to Section BH8-4 of this chapter, a copy of which shall be attached to the notice.
b. 
Declaration of Unfitness for Human Habitation or Occupancy or Use. In the event that the specific conditions complained of in any notice served pursuant to Section BH8-3a of this chapter are not corrected within the time specified in the notice, the Board may adopt a resolution declaring that the building or any part thereof is unfit for human habitation or occupancy or use. Every such resolution shall set forth the specific conditions upon which the determination is based.
Copies of every resolution adopted pursuant to the provisions of this Section BH8-3b shall be served personally or by registered mail upon the owner and any occupant of the building or part thereof subject to the declaration of unfitness.
A copy of every resolution adopted pursuant to the provisions of this Section BH8-3b shall be forwarded to the Housing Officer of the Township of Chatham as a complaint pursuant to the provisions of Ordinance 16-61 entitled "An Ordinance of the Township of Chatham Relating to the Repair, Closing and Demolition of Buildings Unfit for Human Habitation or Occupancy or Use and Providing for Remedies and Procedures in Connection Therewith," adopted by the Township Committee of the Township of Chatham on October 5, 1961, as may be amended and supplemented. The Health Officer of the Board of Health of the Township of Chatham shall appear before the Housing Officer of the Township of Chatham in all proceedings pursuant to Ordinance 16-61[1] concerning any building or part thereof which has been declared by the Board of Health to be unfit for human habitation or occupancy or use.

No person shall maintain, inhabit, occupy or use, or permit another person to inhabit, occupy or use any building or any part thereof which has been declared by the Board of Health of the Township of Chatham to be unfit for human habitation or occupy or use pursuant to the provisions of Section BH8-3b of this chapter. Any person convicted of a violation of this chapter shall be subject to a penalty not exceeding $200.

No provision of this chapter shall be construed as precluding the enforcement of other ordinances adopted by the Board of Health or as precluding the exercise of other powers of the Board of Health to correct or abate nuisances or conditions adversely affecting the public health, safety and general welfare.
