Unless otherwise specifically stated in this article, the following words shall have the meanings herein indicated:
PERSON
A firm, association, organization, partnership, trust, company or corporation, as well as an individual.
RESIDENTIAL OCCUPANCY
The occupancy or use of a building or structure or any portion thereof by persons for whom sleeping accommodations are provided.
SHALL
Is always mandatory; the word "may" is permissive.
SMOKE DETECTOR
A device capable of sensing visible or invisible particles of combustion which, upon such sensing, shall cause the operation of an alarm clearly audible in all portions of the structure in which it is located, in spite of any background noise or in spite of any doors within the structure being closed. To be considered within this definition, the device shall have attached an approved seal of a recognized agency such as the Underwriters Laboratory, the American Insurance Association or Factory Mutual.
USED or OCCUPIED
As applied to any building, shall be construed to include the words "intended, arranged or designed to be used or occupied."
A.ย 
The owner of each existing occupied residential structure used for residential occupancy shall install a smoke detector in each unit intended for residential occupancy. Such installation shall be completed by January 1, 1987.
B.ย 
The owner of any residential structure intended for residential occupancy constructed after June 1, 1986, shall install smoke detectors in each unit intended for residential occupancy. Such installation shall be completed by January 1, 1987.
C.ย 
The owner of each existing guest room, suite, hotel, motel, lodging house, boardinghouse, dormitory, facility for aged or for the physically or mentally infirm intended for residential occupancy shall install smoke detectors in each unit intended for residential occupancy. Such installation shall be completed by January 1, 1987.
D.ย 
The owner of any guest room, suite, hotel, motel, lodging house, boardinghouse, dormitory, facility for the aged or for the physically or mentally infirm constructed after June 1, 1986, and intended for residential occupancy shall install smoke detectors in each unit intended for residential occupancy prior to occupancy.
E.ย 
The owner of all existing multiple occupancy structures, and the owner of all multiple occupancy structures constructed in the future, containing six or more units and exceeding one story in height, shall install a central fire alarm system that transmits its signal to a commercial company or governmental agency established to receive the signal from such system and which is capable of notifying designated fire departments upon receipt of a signal from such system.
A.ย 
At least one smoke detector shall be installed in each sleeping area. A sleeping area shall be defined as the area, or areas, in which the bedrooms are located. Where bedrooms, or rooms habitually used for sleeping, are separated by other use areas, such as kitchens or living rooms (but not bathrooms or closets), they shall be considered as separate sleeping areas for the purposes of this Subsection A.
B.ย 
At least one smoke detector shall be installed at the top of each stairway leading up to an area which is occupied.
As an alternative to self-contained smoke detectors, a fire detection system may be installed, providing it is approved by a recognized agency, such as Underwriters Laboratory, American Insurance Association or Factory Mutual.
A.ย 
It shall be the responsibility of the owner to maintain smoke detectors, such maintenance shall include replacing batteries when necessary or keeping smoke detector units connected to an electrical source so that they remain capable of transmitting an audible signal in the presence of smoke.
B.ย 
The removal, tampering with, destruction, or rendering ineffective of any smoke detector or fire detection system by any person except an owner shall be a violation of this chapter.
A.ย 
The Fire Chief and assistant Fire Chiefs of the Norther Lebanon Fire Emergency Service, located in the Township shall also enforce this chapter and prosecute violations of this chapter.

B.ย 
The Chief and Assistant Chiefs shall advise, without charge, any person who wishes information in regard to smoke detectors and fire prevention, even though such person is not required to install a smoke detector or smoke detectors under this chapter.
Any person who violates any provisions of this chapter shall, upon conviction thereof in a summary proceeding, be sentenced to pay a fine of not more than $300; and/or imprisonment for a term not to exceed 30 days. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense.
If any provision of this chapter is held invalid, this invalidity shall not affect any other provisions of this chapter.

The East Hanover Township hereby adopts in its entirety the International Property Maintenance Code of 2015, as may be amended or revised and as published by the International Code Council, for the regulation of buildings and structures as therein provided, and each and all of the provisions of said International Property Maintenance Code are hereby referred to, adopted, and made a part hereof as though fully set forth in this chapter, except as may be added, deleted or modified as follows:
A.ย 
The following definitions are added to Section 202:
JUNK MATERIALS
Any and all unused or abandoned machinery, equipment or appliances, and all forms of waste and refuse of any type of materials, including but not limited to scrap, metal, glass, industrial waste and other salvageable materials, unless for resale, then can be seen from any public highway, road, street, avenue, lane or alley which is maintained by the Township or Commonwealth of Pennsylvania.
NOXIOUS WEEDS
Those weeds listed by the Pennsylvania Department of Agricultural as being noxious.
B.ย 
In Section 302.4, Weeds, all premises and exterior property shall not maintain weeds or plant growth in excess of 10 inches and the following language shall be added:
"On those properties containing more than three acres and conducting an agricultural use in compliance with the Township's Zoning Ordinance, agricultural fields or pasture areas which are left vacant for crop rotation or special agricultural programs, will be given latitude to allow vegetation growth in excess of 10 inches, provided there are no noxious weeds present."
C.ย 
In Section 304.14, Insect Screens, insect screens shall be provided from May 15 to October 15.
D.ย 
"Junk," as defined in Section 202, shall be included as a prohibited item in Section 308.1, Accumulation of Rubbish or Garbage.
E.ย 
In Section 602.3, Heat Supply, heat shall be supplied from October 1 to May 1.
F.ย 
In Section 602.4, Occupiable Work Space, heat shall be supplied from October 1 to May 1.
The Board of Appeals described by the International Property Maintenance Code of 2015, as may be amended or revised, including its membership and procedures, shall be established from time to time by Resolution by the Board of Supervisors of the Township of East Hanover, and any party appealing to the Board of Appeals a decision by the Enforcement Officer, shall pay to the East Hanover Township such fees and costs as are determined by the East Hanover Township by resolution. The person or persons designated to act as Enforcement Officer for the East Hanover Township with respect to the International Property Maintenance Code shall be established from time to time by resolution of the Board of Supervisors of the East Hanover Township. Fees for any work, permits, charges, activities and services performed by the Enforcement Officer in carrying out his responsibilities shall be established from time to time by the resolution by the Board of Supervisors of the East Hanover Township. Penalties for violation of the International Property Maintenance Code shall also be established from time to time by resolution of the Board of Supervisors of the East Hanover Township. No penalties herein shall prevent the Township from enforcing this chapter by equitable, injunctive and other remedies.
In all matters that are regulated by the laws of the Commonwealth of Pennsylvania, or by regulations of departments or agencies of the Commonwealth of Pennsylvania promulgated by authority of law, such laws or regulations shall control where the requirements thereof are the same as or in excess of the provisions of this chapter. In all matters that are regulated by other ordinances of the Township of East Hanover, such ordinances shall control where the requirements thereof are the same as or in excess of the provisions of this chapter. This chapter shall control in all cases where there are state requirements or the requirements of other ordinances of the East Hanover Township are not as strict as those contained in this chapter.
The provisions of this chapter, so far as they are the same as those of ordinances and/or other Codes in force immediately prior to the enactment of this chapter, are intended as a continuation of such ordinances and/or Codes, and not as a new enactment. The provisions of this chapter shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution pending, or to be instituted to enforce any right or penalty or to punish any offense under the authority of any of the repealed ordinances.
If any sentence, clause, section or part of this chapter is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this chapter. It is hereby declared as the intent of the East Hanover Township Board of Supervisors that this chapter would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section, or part thereof not been included therein.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.
This chapter shall become effective five days after enactment by the Board of Supervisors.
