In addition to the requirements of Section 115.010 hereof, no person shall be eligible to the office of Prosecuting Attorney who is not learned in the law and a licensed and practicing attorney in the State of Missouri at the time of his/her appointment.

The Prosecuting Attorney shall be appointed by the Mayor with the advice and consent of a majority of City Council.

The Prosecuting Attorney shall receive such compensation as may be determined by the City Council. He/she will attend Municipal Court and perform services in connection therewith; and may upon request attend regular and special meetings of the City Council.

A. 
Assistant Prosecuting Attorney. The Prosecuting Attorney shall have the authority to appoint an Assistant Prosecuting Attorney, with consent and approval of the Mayor, as he or she may deem necessary for furtherance of the duties of the Prosecuting Attorney so long as such Assistant Prosecuting Attorney meets the qualifications stated in Section 115.300. The Assistant Prosecuting Attorney may exercise any of the powers of the Prosecuting Attorney under the direction and sole discretion of the Prosecuting Attorney. The Assistant Prosecuting Attorney is not a permanent position, and would only be utilized in situations where the Prosecuting Attorney may be unavailable. If the Prosecuting Attorney should utilize an Assistant Prosecuting Attorney for any matter, the Prosecuting Attorney is responsible for compensating the Assistant Prosecuting Attorney as agreed to between the Prosecuting Attorney and the Assistant Prosecuting Attorney.
B. 
Special Prosecuting Attorney. Upon the recommendation of the Prosecuting Attorney, or whenever in their judgment the same may be necessary, the City Council may, by resolution, employ a Special Prosecuting Attorney. The counsel so employed shall be entitled to receive a reasonable fee for services. Nothing in this Subsection (B) shall be construed to authorize the employment of additional counsel in prosecutions before the Municipal Judge.
