Pursuant to Section II of the Uniform Fire Safety Act (P.L. 1983, c. 383)[1] the New Jersey Uniform Code shall be locally enforced in the Borough of Mount Arlington, New Jersey.

The local enforcing agency shall be the Bureau of Fire Prevention in the Mount Arlington Fire Department.

The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all building, structures and premises within the established boundaries of Mount Arlington, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 91-2 of this Article shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcing agency established by § 91-5 of this Article shall be a part of Mount Arlington Fire Department and shall be under the direct supervision and control of the Borough Fire Official of the Mount Arlington Fire Department.

A. 
Appointment of Fire Official. The local enforcing agency shall be under the direct supervision and control of the Chief of the Bureau of Fire Prevention in the Fire Department who shall be the Chief Inspector and who shall also be known as the "Borough Fire Marshal" and/or "Fire Official."
B. 
Term of office. The Chief of the Bureau of Fire Inspection shall serve for a term of one year.
C. 
Inspectors and employees. Such inspectors and other employees as may be necessary in the local enforcing agency shall be appointed by the governing body of the Borough of Mount Arlington upon the recommendation of the Chief Inspector and the Fire Chief of the Borough of Mount Arlington.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of Morris County.

In addition to the inspection and fees required pursuant to the Act and the regulations of the Department of Community Affairs, the following additional inspections and fees shall be required:

Certificate of approval for sprinkler system as mandated by the Uniform Fire Code: $15 annually.
The permit fees established by the Uniform Fire Code shall be amended to be as follows:

Type l: $25.
B. 
Type 2: $100.
C. 
Type 3: $200.
D. 
Type 4: $300.
E. 
Type 5: $1,000.[1]

Pursuant to N.J.S.A. 52:27D-198.1 et seq., a fee of $35 shall be paid by the owner prior to each inspection. If the inspection is requested within 10 days of the change of occupancy or ownership, a fee of $70 shall be paid. If the inspection is requested within four days of the change of occupancy or ownership, a fee of $140 shall be paid.

The Tax Collector of the Borough of Mount Arlington shall provide to each person requesting a tax search from his or her office a statement calling attention to the provisions of this chapter, including the requirement that smoke detectors and carbon monoxide detectors be installed and the necessity of obtaining a certificate of smoke detector and carbon monoxide detector compliance prior to each change of occupancy.

Notwithstanding the provisions of this chapter, an owner who sells, leases or rents or otherwise permits to be occupied for residential purposes any premises subject to the provisions of this section shall be subject to a fine of not more than $500 which may be collected and enforced by the Fire Official through summary proceedings pursuant to the penalty enforcement law, N.J.S.A. 2A:58-1 et seq.
