The City of Davenport administers cigarette, tobacco, alternative
nicotine and vapor products permits on the behalf of the State of
Iowa. No person shall engage in the business of a retailer of cigarette,
tobacco, alternative nicotine and vapor products at any place or business
without first having received a permit as a cigarette, tobacco, alternative
nicotine and vapor products retailer. No permit shall be issued for
the sale of cigarette, tobacco, alternative nicotine and vapor products
at retail in the City except to applicants who shall be engaged in
one or more of the following listed occupations and shall be so engaged
otherwise than incidentally or as an adjunct to some other occupation
not so listed:
A.
The retail grocery business;
B.
The retail drug store business;
C.
The retail cigarette, tobacco, alternative nicotine and vapor products
business;
D.
The sale of malt beverages under a class B license;
E.
The restaurant business;
F.
The hotel business;
G.
The operation of a private club;
H.
The operation of a gasoline filling or service station;

It shall be provided, nevertheless, that nothing contained in
this chapter shall prevent the issuance of a permit for the sale of
cigarette, tobacco, alternative nicotine and vapor products at retail
to any applicant who is now the holder of any such permit or who shall
purchase the goodwill of any business conducted by any person who
is the present holder of such a permit.
