A. 
The Zoning Law of the Village of Baldwinsville and the map entitled "Village of Baldwinsville Zoning Map" dated November 2011 are hereby amended by changing the following described area as set forth below from the existing unnamed planned development district to a planned development district to be known and described as "Downer Street Planned Development District."
B. 
The area of the Downer Street Planned Development District ("Downer Street PDD") consists of 26.31 acres plus or minus in the Village of Baldwinsville and is bounded and described as set forth on the map entitled "Site & Pavement Marking Plan" dated June 11, 2013, on file with the Village Clerk, and is further described as follows: Unnumbered parcel on Meigs Road (Tax Map No. 022.-01-02.9), 113 Downer Street (Tax Map No. 022.-01-03.2), 131 Downer Street (Tax Map No. 022.-01-02.8), unnumbered parcel on Downer Street (Tax Map No. 022.-01-03.5) and 197 Downer Street (Tax Map Nos. 022.-01-03.3 and 022.-01-03.4).
A. 
The following uses shall be permitted within the area delineated herein as "Planned Development District": high density multifamily residential buildings; retail; business; office; hotel; restaurant/fastfood establishment with outdoor seating; off-street parking and related areas.
B. 
Downer Street Planned Development District shall be developed in the following manner:
(1) 
All permitted uses, building locations and layout, bulk and area requirements, height restrictions, off-street parking requirements, property ingress or egress, on-site roads and pedestrian ways, fire lanes, service drives, signage, green space, and stormwater management infrastructure, shall be as detailed, specified and shown on the approved site development plans for this District, identified as "Baldwinsville Apartments, Site and Pavement Marking Plan," dated June 6, 2013, by Costich Engineering.
(2) 
Before future construction in the Downer Street Planned Development District is started or any building permit is issued relating thereto, final plans and specifications shall be submitted to and approved by the Planning Board of the Village of Baldwinsville and filed with the Village Clerk of the Village of Baldwinsville.
(3) 
During the construction of the Downer Street Planned Development District, there shall be constructed, as set forth as part of the site plan approved by the Planning Board of the Village of Baldwinsville, parking areas providing sufficient parking for all multiple dwelling units.
(4) 
The development of any out parcels within the delineated area, but not associated with the primary multifamily residential development, shall be subject to architectural review and approvals pursuant to the Zoning Code of the Village of Baldwinsville.
C. 
Existing utilities (location, sizes and inverts) shown on the plans are approximate and are not certified as to the accuracy of their location or completeness. The contractor shall be responsible for determining the exact locations and depths of all utilities and structures in the path of, or closely parallel to, or under, the proposed construction. The contractor shall be responsible for any delays or damages occurring as a result of incorrectly located utilities. It is the contractor's responsibility to notify the various utility owners in ample time for them to locate and mark their facilities. The contractor shall also notify underground utility location service at least 48 hours in advance of commencing any work as per the site plan dated June 11, 2013.
