The position of Township Administrator is hereby created in and for the Township of Millstone.

The Township Administrator shall be appointed by the Township Committee. The term shall be at the pleasure of the Township Committee pursuant to law.

The Township Administrator shall receive such compensation as shall be fixed by the Salary Ordinance of the Township Committee.

The Township Administrator shall be selected by the Township Committee on the basis of administrative and technical qualifications with special consideration to training and experience in local government and a background and practical experience in business. The Township Administrator may hold one or more municipal positions in Millstone Township while at the same time carrying out the duties and responsibilities of the Township Administrator.

The Township Administrator shall at all times be under the supervision of the Township Committee for all actions relevant to the duties and responsibilities of said position to the extent not prohibited by law.

a. 
Serve as the Personnel Officer, and have the authority to interview, recommend to the Township Committee the hiring, assign, supervise, evaluate, transfer, recommend the promotion, demote and discharge any employees, except those appointed by the Township Committee. He/she shall develop, recommend and, upon approval by the Township Committee, implement personnel policies, procedures and programs of the Township. Recommend and establish job descriptions, subject to the approval of the Township Committee, and ensure that performance reviews are conducted in accordance with personnel policy and to maintain comprehensive personnel files.
b. 
Be responsible to coordinate interdepartmental operations, and implement and enforce personnel organization policy of the Township.
c. 
Make recommendations to ensure assessment and compliance with PEOSHA standards.
d. 
Have responsibility for staffing and vacation scheduling. Establish backup and cross-training support and implement necessary procedures and programs.
e. 
Ensure safeguards for office systems data backup and computer security. Ensure physical safeguarding of the building.
f. 
In conjunction with the Chief Financial Officer to study, recommend, implement and enforce procedures and policies of the Township and its departments for the requisition, purchase, inspection, receipt, storage, distribution, internal transfer and disposal of and payment for supplies, materials and equipment after consultation with the Purchasing Agent and Township Committee. He/she shall require each department to maintain adequate inventory records of all equipment and materials owned and used by the Township. He/she shall arrange for the disposal of all inadequate or obsolete materials when directed to do so by the Township Committee.
g. 
Receive and reply to inquiries and complaints concerning Township business, provide information and assistance and remedy or cause to be remedied the source of any just complaint.
h. 
Assist the Township Committee in negotiating contracts for the Township as authorized and subject to approval of the Township Committee.
i. 
Study, recommend, implement and enforce administrative procedures and policies of the Township and its departments.
j. 
Within the periodic allotments of budgetary appropriations established by the Chief Financial Officer, Treasurer and Township Committee, with the advice of department heads, plan and administer the expenditure program.
k. 
Assist the Chief Financial Officer and Township Committee in the preparation of proposed Township budget. He/she shall include his/her recommendations with respect to all budget requests.
l. 
Study the governmental and administrative operations and needs of the municipality and recommend to the Township Committee necessary and desirable plans and programs to meet present and foreseeable needs. In this connection, the Township Administrator shall be aware of and, with the Township Committee approval, make application for Federal, State or County financial assistance in support of projects for which the Township may be eligible under law.
m. 
Assist the residents of the Township in matters within his/her jurisdiction by such reports, verbally or written, as he/she deems advisable or as may be requested by the Township Committee; and shall also submit a monthly report of their work accomplished at the request of the Township Committee for the benefit of the public. The report shall consist of the major accomplishments for the past month plus critical Township issues for the Township Committee related to the Township Administrator's responsibilities.
n. 
Attend all executive, special and regular meetings of the Township Committee and such other meetings as directed by the Township Committee, except when excused therefrom by the Township Committee.
o. 
Perform such other duties as may be required by the Township Committee.

The duties and responsibilities of the Township Administrator shall be such that they shall not infringe upon and/or invade and directly interfere with the duties and responsibilities as may be assigned by law to other Township officials.

The Township Administrator may be removed by a majority vote of the Township Committee eligible to vote.

Any vacancy in the position of Township Administrator shall be filled by the Township Committee.

The office of the Township Clerk shall be an appointed position and, unless otherwise provided by law, the term of office shall be three years and shall commence January 1 of the year of appointment. The salary of the Township Clerk shall be as established in the Salary Ordinance.

The Township Clerk shall:
a. 
Perform all of the functions required of municipal clerks by the General Election Law (Title 19 of the Revised Statutes) and any other State Law or Township ordinance, and receive the fees prescribed therefor for the use of the Township.
b. 
Until such time as a separate Alcoholic Beverage Control Board may be established pursuant to law, issue such licenses as may be authorized by the Township Committee pursuant to the State Alcoholic Beverage Control Law (N.J.S.A. 33:1-1 et seq.) and ordinances of the Township.
c. 
Keep all records, resolutions, ordinances and minutes of the meetings of the Township Committee.
d. 
Issue all licenses required by law or ordinance, faithfully make all reports required by law or ordinance to the Township Committee and account monthly for all fees received by the Office of the Township Clerk.
e. 
See to it that all ordinances and notices of the Township of Millstone are properly advertised.
f. 
Take care of all correspondence of the Township and of the Township Committee.
g. 
Administer oaths.
h. 
Have such other, different and additional functions, powers and duties as may be prescribed by law, ordinance or regulation.

The Township Committee may appoint a Deputy Township Clerk. The Deputy Clerk shall have the powers and perform all the duties of the Clerk during such times and specific periods as the Clerk shall be absent, on vacation or on leave of absence granted by the Township Committee. The Deputy Township Clerk shall assist the Clerk in the performance of his/her duties as the Clerk may from time to time prescribe and as approved by the Township Committee. The Deputy Township Clerk shall serve for a term of one year.

There is hereby created the office of Purchasing Agent in the Township of Millstone.

a. 
Duties. The position shall be a part-time position, and a Purchasing Agent will:
1. 
Attend, when required, meetings of Township agencies.
2. 
Submit reports of all purchases made by the Township to the Mayor and Township Committee on a quarterly basis.
3. 
Keep an accurate and current record of all purchases made by the Township.
4. 
Receive all requisitions for purchases from all departments.
b. 
Procedure. Each requisition shall be forwarded to the Purchasing Agent, whose duty it shall be to solicit bids on quotation forms, by telephone or otherwise, for nonemergency, nonrecurring requisitions for purchases the cost of which is less than the bid threshold, but 15% or more of that amount as established by N.J.S.A. 40A:11-3. For example, given a bid threshold of $17,500, the Purchasing Agent shall follow this procedure if the cost is between $2,625 and $17,499. Purchases exceeding the bid threshold established pursuant to N.J.S.A. 40A:11-3 will be made in accordance with the Local Public Contracts Law N.J.S.A. 40A:11-1 as authorized by the Township Committee. The Purchasing Agent shall then tabulate bids and prepare purchase orders to the vendor offering the lowest responsible bid. Copies of the purchase orders are to be distributed to the Treasurer, who shall then encumber the appropriation of the requisitioning department. After purchase, the requisitioning department shall check the material upon delivery and submit delivery slips to the Purchasing Agent. The Purchasing Agent shall then check the report of goods received and send a copy of the purchase order to the Treasurer, with a delivery slip annexed. The Treasurer shall then authorize payment and notify the Township Clerk.
The following are the qualifications for the position of Purchasing Agent:
a. 
Graduation from high school or an equivalency diploma.
b. 
A thorough knowledge of the method of achieving and maintaining liaison with relevant inspection agencies and health, welfare and Township agencies so as to assure their continuing cooperation on those aspects of his work for which he requires their assistance.
c. 
The ability to read specifications for materials to be purchased.
d. 
The ability to work harmoniously with other municipal department heads.
e. 
The ability to take a firm stand where necessary.
f. 
The ability to prepare clear, concise and accurate reports and maintain records.
g. 
The ability to act as a witness in court.
h. 
The ability to speak effectively before community groups.

a. 
The salary for the Purchasing Agent shall be fixed annually by the Mayor and Township Committee in the Township's Salary Ordinance.
b. 
Adequate and competent secretarial help will be available to said Purchasing Agent by the Township in order for him to properly carry out the duties set forth herein.
c. 
The Purchasing Agent will be appointed annually by the Mayor with the consent of the Township Committee to serve at the pleasure of the Mayor and Township Committee.

a. 
There shall be a Municipal Court Public Defender appointed by the Township Committee. The Municipal Court Public Defender shall serve for a term of one year from the date of appointment and until the successor shall be appointed and qualifies. The Municipal Court Public Defender shall be an attorney at law of the State of New Jersey and shall provide all necessary and desirable legal counsel and advice required for the defense of cases in the Municipal Court of the Township on behalf of those indigent defendants who are entitled by law to appointment of counsel.
b. 
A person applying for representation by the Municipal Court Public Defender shall be required to pay an application fee of $200. The Municipal Court may waive the required application fee, in whole or in part, if the Court determines, in its discretion, upon a clear and convincing showing by the applicant, that the application fee represents an unreasonable burden on the person seeking representation.

There is hereby created the position of Code Enforcement Officer. The position of Zoning Officer and Code Enforcement Officer may be held simultaneously by the same individual.

The Code Enforcement Officer shall be appointed by a simple majority of the Township Committee for a term of one year. The Code Enforcement Officer shall receive such compensation as is fixed annually by the Mayor and Township Committee in the Township's Salary Ordinance and any implementing resolution.

The position shall be a part-time position. The Code Enforcement Officer shall have the following duties:
a. 
Enforce the municipal ordinances and Code of the Township, including, but not limited to, the issuing of summonses in such circumstances as, in his or her discretion, is warranted;
b. 
Periodically review and submit reports to the Township Administrator recommending amendments and revisions to the Code;
c. 
Investigate, serve violation notices, make and process complaints for violations of the ordinances and the Code, and make necessary court appearances or appearances before appropriate boards and agencies to obtain compliance with all laws and regulations;
d. 
Submit monthly reports to the Township Administrator of inspections made, including the name and address of owners, occupants or lessees of the premises, dates of inspection, code violations found, if any, notices of violations served, complaints filed with the courts or agencies, and dates of compliance or disposition of each case;
e. 
Attend, when required, meetings of municipal agencies as requested;
f. 
Perform such other duties as may be assigned by the Township Committee or Township Administrator.

The Code Enforcement Officer shall have the following qualifications:
a. 
High school diploma or equivalent thereof;
b. 
Thorough knowledge of the ordinances and Codes of the Township;
c. 
Working knowledge of construction practices and procedures;
d. 
Valid New Jersey's driver license.

Pursuant to N.J.S.A. 4:19-15.16b, there is hereby created the position of Certified Animal Control Officer.

The Certified Animal Control Officer shall be appointed by a simple majority of the Township Committee for a term of one year. The Certified Animal Control Officer shall receive such compensation as fixed annually by the Mayor and Township Committee in the Township's Salary Ordinance and any implementing resolution.

The position shall be a part-time position. The Certified Animal Control Officer shall have the following duties:
a. 
Enforce all laws and ordinances enacted for the protection of animals, including, but not limited to, animal control, animal welfare and animal cruelty laws of the State and ordinances of the Township and the issuing of summonses in such circumstances as, in his or her discretion, is warranted;
b. 
Investigate and sign complaints concerning any violation of an animal control, animal welfare or animal cruelty laws of the State or ordinances of the Township;
c. 
Act as an officer for the detection, apprehension and arrest of offenders against the animal control, animal welfare or animal cruelty laws of the State and ordinances of the Township;
d. 
Submit monthly reports to the Township Administrator of investigations and complaints made, including the name and address of owners, occupants or lessees of the premises, dates of investigation or complaint, code violations found, if any, notices of violations served, complaints filed with the courts or agencies, and dates of compliance or disposition of each case;
e. 
Attend, when required, meetings of municipal agencies as requested;
f. 
Perform such other duties as may be assigned by the Township Committee or Township Administrator.

The Certified Animal Control Officer shall have the following qualifications:
a. 
Hold a certified Animal Control Officer's certificate from the State of New Jersey;
b. 
Thorough knowledge of the ordinances and Codes of the Township;
c. 
Valid New Jersey's driver license.

Nothing herein shall be deemed to prevent the Township, in its discretion, from entering into an Interlocal Service Agreement to provide for the services of an Animal Control Officer. Notwithstanding the entry into such an Agreement, the person(s) fulfilling the position of Animal Control Officer under the Agreement shall have the powers and duties specified in subsection 2-9.3.
