Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle I of Title 39 of
the New Jersey Statutes Annotated shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use in the Township.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in N.J.S.A. 3:4-138, any other New Jersey
Statute or as hereinafter provided.

a.
Upon the declaration of an emergency by the New Jersey State Police,
the Township's Emergency Management Coordinator or, County's
Emergency Management Coordinator or the Township Administrator and
the adoption of a Resolution by the Township Committee, there shall
be no parking upon streets or sections of streets where temporary
EMERGENCY — NO PARKING signs are displayed. Notification that
the EMERGENCY — NO PARKING signs are being or will be posted
shall be given to the operator or owner of any vehicle which has been
parked prior to the posting of the signs.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
c.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

a.
No person shall park a vehicle on, or leave a parked vehicle on,
any snow and/or ice covered street within the Township. Snow and/or
ice covered as used herein shall mean that the snow and ice, in any
combination, shall have accumulated on the paved portion of the street
to form a continuous cover, except where such cover may have been
disturbed by the passage of vehicles, pedestrians or drifting of snow
caused by wind.
b.
"No parking" signs advising the public of the restrictions set forth
in paragraph a above shall be posted on all major highways which provide
access to the Township. If any such highways are under the jurisdiction
of another governmental entity which shall not permit the erection
of such signs, the Township shall be relieved of this posting requirement.
Nothing herein shall be deemed to abrogate the presumption that each
person knows the various laws which apply in this jurisdiction. Failure
of compliance with this subsection shall not provide a defense for
charged violations of this subsection.
c.
Any person convicted of a violation of paragraph a above shall be
liable to a fine of not more than $500 for each offense. In addition,
any vehicle left parked in violation of paragraph a above shall be
liable to be towed upon order of the Township, County or State Law
Enforcement Officer and the owner thereof shall be liable for the
cost of towing and any storage charges accruing.

Unless another penalty is expressly provided by N.J.S.A. 39:4-203,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not less
than $100 nor more than $250 or imprisonment for a term not exceeding
15 days or both.
All former traffic regulations of the Township of Millstone
covered in this Traffic Chapter are hereby repealed to the extent
that they are inconsistent with this chapter, except that this repeal
shall not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any regulation hereby
repealed prior to the taking effect of this chapter.

Now therefore be it ordained that Millstone K.F.C., Incorporated
has filed a written consent with the Township of Millstone that provisions
of Subtitle One of Title 39 of the Revised Statutes of New Jersey
be made applicable to the semi-public roads, streets, driveways and
parking lots at the Millstone K.F.C., Lot 11.01, Block 56, located
in the Township of Millstone, County of Monmouth and the following
regulations shall be enforceable.

Any vehicle parked or standing as to obstruct or impede a normal
flow of traffic, block entrances or exit ways, loading zones, oil
fills, any grass area, pedestrian walkway, or present in any way a
safety or traffic hazard may be removed by towing the vehicle at the
owner's or operator's expense.

All signs, posts, or other necessary materials shall be installed
and paid for by the applicant. All signing shall conform to the current
Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198
and N.J.S.A. 39:4-183.27.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of this section or any supplement
thereto shall be liable to a penalty of not more than $250 or imprisonment
for a term not exceeding 15 days or both.

shall be inspected by the Township Engineer to insure that they meet
State and Federal specifications, and all signing shall conform to
