[HISTORY: Adopted by the Town Council of
the Town of Smithfield 7-11-2000 (Ch. 16, Art. X, of the 1985 Code of Ordinances). Amendments
noted where applicable.]
A.
In accordance with Home Rule Charter § C-2.12(7), the Town Council hereby authorizes the sale of that certain tract of undeveloped Town property consisting of approximately 2.9 acres situated at the northeasterly corner of the intersection of Routes 7 and 116 and identified as Assessor's Plat 46, Lot 216 to the Credit Union Central Falls for a price of $350,000 in accordance with the terms of the real estate purchase and sale agreement concerning said property dated March 22, 2000. The Town Council President is authorized to sign on behalf of the Town all documents necessary to complete the sale of said Town property.
B.
In accordance with Home Rule Charter § C2.12(7),
the Town Council hereby authorizes the sale of that certain tract
of undeveloped Town property consisting of approximately .038 of an
acre situated at the intersection of Swan Road and Deer Run Trail,
which is identified as Assessor's Plat 18, Lot 47 to Jaswell's Farm
(Richard and Patricia Jaswell) for the price of $1 per square foot.
The sale would be contingent upon the execution of a real estate purchase
and sale agreement. The Town Council President is authorized to sign
on behalf of the Town all documents necessary to complete the sale
of said Town property.

A.
In accordance with Home Rule Charter § C-2.12(7), the Town Council hereby authorizes the transfer of the structure known as the “Waterman Tavern,” located on Assessor's Plat 7, Lot 67, to the Smithfield Historical Society. in addition to the transfer of said structure, the Town Council hereby authorizes the lease of so much of Assessor’s Plat 7, Lot 67, to the Smithfield Historical Society and upon such terms as the Town Council President deems appropriate so that the Waterman Tavern will be accessible to the public.
B.
The transfer and lease hereby authorized shall terminate
and the Waterman Tavern shall revert to Town ownership in the event
the Smithfield Historical Society does not commence renovation work
on said structure within one year from the effective date of this
section or if said structure is moved from its present location.
C.
The Town Council President is authorized to sign on
behalf of the Town all documents necessary to complete the transfer
and lease of said Town property.

A.
In accordance with Home Rule Charter § 2.12(7),
the Town Council hereby authorizes the transfer of the structure known
as the Smithfield Exchange Bank/Waterman Tavern located on Assessor’s
Plat 7, Lot 67, to the Smithfield Preservation Society. In addition
to the transfer of said structure, the Town Council hereby authorizes
the lease of so much of Assessor’s Plat 7, Lot 67, to the Smithfield
Preservation Society and upon such terms as the Town Council President
deems appropriate so that the Smithfield Exchange Bank/Waterman Tavern
will be accessible to the public.
B.
The transfer and lease hereby authorized shall terminate
and the Smithfield Exchange Bank/Waterman Tavern shall immediately
revert to Town ownership in the event the Town Council does not enact
a resolution prior to July 1, 2006, certifying that the Smithfield
Preservation Society has completed substantial renovation work on
said structure. Any such resolution shall be recorded in the Smithfield
Land Evidence Records immediately after passage.
C.
The Town Council President is authorized to sign on
behalf of the Town all documents necessary to complete the transfer
and lease of said Town property.

A.
In accordance with Home Rule Charter § C-2.12(7), the Town Council hereby authorizes the lease to Omnipoint Communications, Inc., of a portion of Lot 5 on Assessor’s Plat 17, being approximately 1,600 square feet and located at 3 Spragueville Road, Smithfield, Rhode Island. The lease will be contingent upon the execution of a formal site lease with option agreement and upon Omnipoint Communications, Inc., obtaining all necessary approvals, including Zoning Board approval.
B.
The Town Council President is authorized to sign on
behalf of the Town all documents necessary to complete and effectuate
the lease of said Town property.

A.
In accordance with Home Rule Charter § C-2.12(7), the Town Council hereby authorizes the conveyance of that certain tract of undeveloped Town property consisting of approximately 5,826.2 square feet identified as a portion of Assessor's Plat 7, Lot 67, to Cumberland Farms, Inc. for $1 and other good and valuable consideration. The purpose of the conveyance is to promote the orderly redevelopment of the Masonic Temple located on Assessor’s Plat 7, Lot 65, and to accommodate an administrative subdivision which will result in Lots 65 and 68 on Assessor’s Plat 7 each being the minimum 20,000 square feet which will conform to the Village Zone. The conveyance is made expressly subject to the granting of a perpetual easement by the owner of Lot 65 Assessor’s Plat 7 over said Lot 65 to the Town of Smithfield, its successors, and assigns for the purpose of ingress and egress by foot, motor vehicle or otherwise to and from Lot 67 on Assessor’s Plat 7. The conveyance is also subject to the granting of a perpetual parking easement for a total of three parking spaces from the owner of Lot 65 Assessor’s Plat 7 to the Town of Smithfield, its successors and assigns. The Town Council President is authorized to sign on behalf of the Town all documents necessary to complete the conveyance of said Town property.

A.
In accordance
with Home Rule Charter § 2.12(5), the Town Council hereby
authorizes the lease to Beverly Tobin, and her heirs, successors and
assigns, of a portion of Island Drive, being approximately 5,491 square
feet of said Island Drive, for a period of 99 years. Said lease shall
be upon such terms as the Town Council President deems appropriate.
B.
The Town
Council President is authorized to sign on behalf of the Town all
documents necessary to complete the lease of said portion of Island
Drive.

A.
In accordance
with Home Rule Charter § 2.12(5), the Town Council hereby
authorizes the lease to the Greenville Water District of a parcel
of land as described in the attached lease[1] for a period of 99 years. Said lease shall be in the form
which is attached hereto.

The Town

A.
In accordance
with Home Rule Charter § 2.12(5), the Town Council hereby
authorizes the conveyance to the Smithfield Land Trust of a certain
parcel of land containing 15.35 acres of land, more or less, that
is further described on Document No. 20090016, Ridgeland Hills Subdivision
- Open Space, as recorded in the Land Evidence Records of the Town
of Smithfield.
B.
The Town
Council President is authorized to sign on behalf of the Town all
documents necessary to complete the conveyance of said parcel.

A.
In accordance with Home Rule Charter § 2.12(5), the Town
Council hereby authorizes an amendment to its lease with the Greenville
Water District dated September 7, 2012. Said lease amendment shall
be in the form which is attached hereto.[1]

The Town Council President is hereby authorized to sign on behalf
of the Town all documents necessary to complete the amendment of the
lease described herein.

A.
In accordance
with Home Rule Charter § 2.12(5), the Town Council hereby
authorizes and approves the lease to Cellco Partnership d/b/a Verizon
Wireless of a portion of that certain parcel of property located at
607 Putnam Pike as described in the attached land lease agreement
for a period of five years, together with an option to extend for
four additional five-year terms. Said lease shall be in the form which
is attached hereto.[1]

B.
The Town
Manager is hereby authorized to sign on behalf of the Town all documents
necessary to complete the lease of the property described herein.

In accordance with Home Rule Charter § 2.12(5), the Town
Council hereby authorizes the conveyance to Alexander Tavakalian of
a certain parcel of land containing 3,280± square feet of land,
more or less, which is shown as Parcel "B" on an administrative subdivision
plan entitled "Administrative Subdivision for the Town of Smithfield,
Plat 22 Lot 1 and Joseph Casali, AP 22 Lot 2C on Stillwater Road in
Smithfield, RI, Revision 3," dated December 28, 2016 and recorded
as Document No. 2017-0001 in the Smithfield land evidence records.
This conveyance is to be made at the request of the Smithfield Conservation
Commission which has determined that the subject parcel is surplus
and a potential liability risk to the Town.
B.
The Town Council President is authorized to sign on behalf of the
Town all documents necessary to complete the conveyance of said parcel.

A.
In accordance with Home Rule Charter § 2.12(5), the Town
Council hereby authorizes the conveyance to Alexander Tavakalian of
a certain parcel of land containing 0.60± acres of land, more
or less, which is shown as AP 22 Lot 2C New Area on an administrative
subdivision plan entitled "Administrative Subdivision for the Town
of Smithfield, AP 22 Lot 1 and Joseph Casali, AP 22 Lot 2C on Stillwater
Road in Smithfield, RI" revision 3 dated December 28, 2016, and recorded
as Document No. 2017-0001 in the Smithfield land evidence records.
This conveyance is to be made since the subject parcel was inadvertently
included in the conveyance to the Town of Smithfield by deed dated
January 11, 2017, and recorded in the Smithfield land evidence records
in Book 1088 at pages 131 through 135.
B.
The Town Council President is authorized to sign on behalf of the
Town all documents necessary to complete the conveyance of said parcel.

A.
In accordance with Home Rule Charter § 2.12(5), the Town
Council hereby authorizes the conveyance to A.G. Realty Incorporated
of a certain utility and driveway easement on Tax Assessors Plat 06,
Lot 044 shown on plan entitled "Record Plan, West Cottage Avenue Easement,
Assessors Plat 06, Lot 044A" in Smithfield, Rhode Island. Said easement
area contains approximately 3,174 square feet more or less.
B.
The Town Council President is authorized to sign on behalf of the
Town all documents necessary to complete the conveyance of said easement.
C.
This section will take effect 30 days after passage.

A.
In accordance with Home Rule Charter § 2.12(5), the Town
Council hereby authorizes the conveyance to William R Hickey of a
certain utility and driveway easement on Tax Assessors Plat 44, Lot
70 shown on plan entitled "Survey & Easement Plan, prepared International
Mapping & Surveying Corp., Dated 12-27-2017." Said easement area
contains approximately 16,000 square feet more or less.
B.
The Town Council President is authorized to sign on behalf of the
Town all documents necessary to complete the conveyance of said easement.
C.
This article will take effect 30 days after passage.

A.
In accordance with Home Rule Charter § 2.12(5), the Town
Council hereby authorizes the conveyance to Appian Way Property, LLC,
of a certain parcel of land containing 5,850 ± square feet
of land, more or less, which is shown on an administrative subdivision
plan entitled "Administrative Subdivision Plan, AP 46 Lot 287, Town
Of Smithfield & AP 46, Lot 288 Appian Way Property, LLC," dated
November 16, 2020, and which is attached hereto as Exhibit "A."[1] The intent of said administrative subdivision is a like-kind
exchange of portions of the abutting lots owned by the Town of Smithfield
and Appian Way Property, LLC and is done with favorable recommendation
of the Smithfield Conservation Commission.
