This chapter shall be known as the "Groundwater Non-Use Ordinance."
The purpose of this chapter is to prohibit the use of groundwater
for potable and agricultural use within the Municipality of Kingston.
The installation and use of supply wells for potable and agricultural
use within the Municipality of Kingston are prohibited.
A.
Any person who shall violate any provision of this chapter shall,
upon conviction, be sentenced to pay a fine not exceeding $1,000 or,
in default of payment of such fine, then to imprisonment for not more
than 30 days.
B.
Each day's continuance of a violation of this chapter may constitute
a separate offense.
All ordinances or parts of ordinances inconsistent with this
chapter are hereby repealed insofar as they affect this chapter.
If any provision, sentence, clause, section or part of this
chapter is, for any reason whatsoever, determined to be invalid, illegal
or unconstitutional, such determination shall not affect or impair
any of the remaining provisions or parts of this chapter.
The right to amend this chapter or any portion thereof from
time to time, as is deemed advisable for the effective administration
of this chapter, is reserved.
Should the Municipality of Kingston change, amend, repeal or
eliminate this chapter, the Municipality will immediately notify the
Pennsylvania Department of Environmental Protection.
