Any person using the City of Owensville Park System shall do so in accordance with the restrictions and prohibitions contained in this Chapter.

No person shall willfully mark, deface, disfigure, injure, tamper with or displace or remove, any building, table, bench, fireplace, railing, paving, water line or other public utility or parts or appurtenances thereof, sign, notice, or placard, whether temporary or permanent, monument, stake, post, or other boundary marker or other structure or equipment, facilities or park property or appurtenances whatsoever, whether real or personal.

No person over the age of four (4) years shall use restrooms and washrooms designated for the opposite sex.

No person shall dig or remove any soil, rock, stone, tree, shrub, or plant, down timber or other wood or materials, or make any excavation by tool, equipment, blasting, or any other means or agency.

No person shall damage, cut, carve, transplant or remove any tree or injure the bark, or pick flowers or seed of any tree or plant, nor shall any person attach any rope, wire, or other contrivance to any tree or plant. No person shall dig in or otherwise disturb grass areas.

No person shall climb any tree nor walk, stand or sit upon a monument, vase, fountain, railing, building, fence or upon any other property not designated or designed for such purposes.

No person shall dump, deposit or leave any bottles, broken glass, ashes, paper boxes, cans, dirt, rubbish, waste, garbage, refuse, or other trash on or in park property, except when same is accumulated in the park itself, when all of the aforementioned rubbish and waste shall be placed in the proper receptacles where they are provided. Where receptacles are not so provided, all of the aforementioned rubbish and waste shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere.

A. 
No person, except authorized park staff, shall drive or operate any motor vehicle upon any walkway or other area, paved or grass, except the paved road or parking areas.
B. 
It shall be unlawful to operate any motor vehicle, except official emergency vehicles, in the City Park System at any time that a park is closed.
C. 
For purposes of this Section, the Parks are closed during such hours daily as the Board of Aldermen shall determine and at such other times as the Board of Aldermen or park staff shall designate.
D. 
For purposes of this Section, a "motor vehicle" shall include any vehicle which is propelled by an engine of any type, whether or not such vehicle is licensed or unlicensed.
E. 
Any person who violates any provision of this Section shall be subject to a fine of not less than twenty-five dollars ($25.00) and not more than five hundred dollars ($500.00). Any vehicle operated in violation of this Section shall be subject to being towed away. Prior to any vehicle which is towed away being returned to the owner, all expenses incurred in towing and storing such vehicle must first be paid.

A. 
No person shall use or operate any riding device upon the paved walking trails within the Owensville City park. Such riding devices include, but are not limited to, skateboards, roller skates, in-line skates, scooters, soapbox derby cars and/or other non-motorized wheeled vehicles.
B. 
The Owensville Park Commission may allow the above-prohibited use during special events sponsored by the City of Owensville or another entity, as recommended by the Park Commission and approved by the Board of Aldermen.
C. 
Violation of this Section shall be an infraction punishable by fine of up to two hundred dollars ($200.00).

No person shall park any vehicle on other than an established parking area or on temporary parking areas established by the Park Commission and all parking shall be in accordance with all other parking ordinances of the City.

No person shall build or attempt to build a fire except in barbecue pits and other areas as may be designated by the Park Commission.

No person shall engage in loud, boisterous, threatening, abusive, insulting or indecent language, or engage in any disorderly conduct or behavior tending to breach the public peace.

No person shall interfere with the use by another of the individual barbecue pits, pavilions, tables and benches the use of which shall be on a "first come, first served," basis or by permit and fee from the Park Commission when applicable.

No person shall leave a picnic area before any fire set or used by him/her is completely extinguished and before all trash and other refuse is placed in the disposal receptacles where provided. If no such receptacles are available, refuse and trash shall be carried away from the park area by the picnicker to be properly disposed of elsewhere.

A. 
As used in this Section, "camp" shall be defined as the activity of spending time living or sleeping in a camp, camper, tent, shack, shelter, or a special vehicle to be used or that could be used for such purposes.
B. 
No person shall camp in any City park outside of the designated camping areas.
C. 
No person shall camp in any City park without having first obtained a permit therefor from a representative of the City. Said permit shall at all times be displayed in a place visible to all representatives of the City.
D. 
No person shall camp in any City park for more than fourteen (14) consecutive nights, unless authorized by the Parks and Recreation Director.
E. 
Check-in is any time after 2:00 P.M. and check-out is before 12:00 P.M.
F. 
The Board of Aldermen, with the recommendation of the Park Commission, is authorized to adopt such additional rules related to camping as it deems appropriate, and such rules will be obtained with the rental agreement/permit.
G. 
All persons shall abide by the requirements of this Section and any additional rules within the rental agreement. Failure to abide by these and any posted rules may result in expulsion or suspension from the park, the issuance of a citation, or other disciplinary measures as may be deemed appropriate.

No person shall ride a horse except on designated bridle trails as recommended by the Park Commission. All horses used on designated bridle trails shall be thoroughly broken and properly restrained, and ridden with due care and shall not be allowed to graze or go unattended, nor shall any horse be hitched to any rock, tree or shrub.

Year round, City Parks shall be open from 5:00 A.M. to 10:00 P.M. and closed from 10:01 P.M. to 4:59 A.M., except that the provisions of Section 210.2240 pertaining to Halloween curfew hours shall take precedence over this provision on October 31 of each year. No person shall remain in any City Park during the closed hours unless participating in an activity which has been authorized in writing by the Parks and Recreation Department to continue into the normally closed hours. Any organization, group or individual who wishes to sponsor an activity that will or may last into the normally closed hours shall obtain a permit therefor from the Parks and Recreation Department and shall provide to the Parks and Recreation Department a list of participants therein if a private function or sponsored by an individual. A list of participants or authorized persons shall also be furnished by an organization or group if practical. Any person remaining in the City Parks after closing hours, except in connection with functions for which an after-hours permit has been issued, shall be deemed to be a trespasser.

A. 
The City golf course shall be open throughout the year from dawn to dusk subject to the following exceptions:
1. 
When notice is posted by park personnel that the course, or portion thereof, is closed due to weather conditions.
2. 
When notice is posted by park personnel that the course, or a portion thereof, is closed for construction or maintenance purposes.
3. 
At such time as permission has been granted by the Park Commission in writing to an organization or individual to play "night golf." In the event such permission is granted, the written permit shall set forth thereon the name of the individual in charge, the time at which play is to commence and end, the number of players who shall participate and an acknowledgment by the individual in charge that appropriate equipment (balls and flashlights) are available and shall be used.
