It shall be unlawful for any person to sell, display, or to shoot fireworks in the City. However, the Mayor, by and with the consent of the Board of Aldermen, may give written permission to organizations for display and discharge of fireworks in connection with festivals, picnics, celebrations and other public gatherings within the City of Owensville. Violation of any provision of this Section shall be an offense.

A. 
It shall be unlawful for any person to possess lighted smoking materials in any form, including, but not limited to, the possession of lighted cigarettes, cigars, pipes or other tobacco products within any enclosed building, structure or vehicle, as defined in Section 300.010, owned by the City of Owensville.
B. 
Violation of this Section shall be punishable by a fine of not more than two hundred dollars ($200.00).

Every person who shall place any cord of wood, lumber, brick, stone, boxes or any other obstruction in any street gutter within the City and being required by the Public Works Director to remove the same, shall permit such obstructions to remain for a longer period of time thereafter than twenty-four (24) hours, shall be deemed guilty of an offense.

A. 
Possessing Dangerous Or Damaging Substances. It shall be unlawful for any person, firm, partnership, or corporation knowingly to possess any egg, rock, firecracker, bottle rocket, missile, paint, paraffin, wax, aerosol can containing paint, shaving cream or a soap solution, or any other similar article readily capable of or adaptable to being used as a thrown projectile or explosive or as a means of writing or marking upon or defacing property within the City of Owensville between the hours of 3:00 P.M. on Halloween and 6:00 A.M. on the following day, except within the confines of a person's own residence, and except as follows:

Eggs may be possessed and/or used as a food item within restaurants and other places that commonly purvey prepared foods, provided that any person so in possession is the owner or proprietor of such premises or is the lawful agent of such person.
2. 
Any of the above named or described articles may be possessed and held for resale within the confines of any retail store that normally sells such items, if not otherwise prohibited by law.
3. 
Any of the above named or described articles may be possessed by a producer or wholesaler thereof solely within the confines of the premises of the producer or wholesaler or solely within the confines of any vehicle ordinarily used for the delivery of such articles or during transfer from such delivery vehicle to such wholesaler or retailer.
4. 
For the purposes of this Section, it shall be a rebuttable presumption that any such prohibited article found within a motor vehicle is in the possession of all occupants thereof, unless any such person establishes by a preponderance of the evidence that he/she had no knowledge of the presence of such articles within the motor vehicle.
B. 
Authority Of Law Enforcement Officers. It shall be lawful for any Law Enforcement Officer to confiscate and destroy, or retain for evidence, at such Officer's discretion, any such prohibited article found in the possession of any person in violation of Subsection (A) hereof.
C. 
Unlawful To Throw, Smash, Etc., Objects Of Any Type. It shall be unlawful at any time for any person to throw, hurl, drop, or smash any article or object of any type at or upon any person, motor vehicle, structure, or property of any type within the City of Owensville, or to act in concert with any other person doing any such act, or to encourage, aid, or abet any such act.
D. 
Face Masks, Etc., Concealing Identity Prohibited. It shall be unlawful for any person over the age of twelve (12) years to enter or remain upon any street, sidewalk, public place or exterior portion of any private property not the residence of such person within the City of Owensville while wearing a face mask, camouflage, paint or any other garment, device, or covering which obscures any part of his/her face or which conceals the identity of such person at any time between the time of sunset on Halloween and 6:00 A.M. of the following day.
E. 
Curfew Hours. It shall be unlawful for any person to remain in or upon the public streets, highways, alleys, sidewalks, parks, playgrounds, public grounds, places or buildings, or vacant lots in the City of Owensville between the hours of 9:00 P.M. on Halloween, October 31st, of each year and 5:00 A.M. of the following day, except for the limited and legitimate purpose of traveling by the most direct lawful route between a school, church, social club or other private organization then having a scheduled activity or program, a private residence at which such person is or will be an invitee, a licensed business establishment then legally open for business, or such person's home. Any person found remaining in or upon any of the restricted places or locations described above for more than five (5) continuous minutes shall be presumed to be in violation of this Section, and the burden of injecting the issue of being engaged in a lawful purpose, as provided herein, shall rest upon such person.
F. 
Violation. Any person who violates any provision of this Section shall be guilty of an offense.
