For the purposes of this chapter, the following words as used herein shall be considered to have the meanings ascribed thereto:
MOTORCYCLE
Includes motorcycles, motor bikes, bicycles with motor attached and all motor operated vehicles of the bicycle or tricycle type, except motorized bicycles as defined in this section, whether the motive power be a part thereof or attached and having a saddle or seat with the driver sitting astride or upon it, or a platform on which the driver stands.
MOTORIZED BICYCLE
A pedal bicycle having a helper motor characterized in that either the maximum piston displacement is less than 50 cubic centimeters, or said motor is rated at no more than 1.5 brake horsepower and said bicycle is capable of a maximum speed of not more than 25 miles per hour on a flat surface.
A. 
No person shall operate a motorcycle or a motorized bicycle on the privately owned property of another without receiving the consent of the owner of the property or the person who has a contractual right to the use of such property.
B. 
No person shall continue to operate a motorcycle or motorized bicycle on the privately owned property of another after consent, as provided in Subsection A above, has been withdrawn.
The failure of any person operating a motorcycle or motorized bicycle on the privately owned property of another to produce written consent of the owner or lessee so to do shall be prima facie proof that such person was forbidden to do so.
Any person violating any provision of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $500 or a sentence not exceeding 90 days in the county jail, or both.
The constable or constables of the Township of Montague shall have the authority to enforce this chapter; however, this section shall not preclude any person from filing a complaint for a violation of this chapter.
