The provisions of Chapter 12, Construction, Operation and Maintenance of Retail Food Establishments, of the New Jersey State Sanitary Code are hereby recognized as being of full force and effect in the Township of Montague.

A. 
No person shall operate a retail food handling establishment unless a license or approval of an existing license to operate same shall have been issued by this Board of Health. Such license or approval of an existing license shall be posted in a conspicuous place in such establishment.
B. 
For the purpose of this Section 83-2 only, the term "retail food handling establishment" shall not include civic, religious or charitable organizations to the extent that their food selling activities are limited to no more than five days out of the year.
C. 
Any requirement or exemption contained in Sections 83-2, 83-3 or 83-4, with respect to permits or fees shall not exempt any retail food establishments or temporary retail food establishment from inspection or from any provision of the New Jersey State Sanitary Code.

The following schedule of fees shall apply:
A. 
License for small facilities (1—1,199 square feet) not falling exclusively into one of the categories C through H. below.
$70.00/yr.
B. 
License for large facilities (1,200 square feet and over) not falling exclusively into one of the categories C through H below.
$150.00/yr.
C. 
License for establishment selling pre-packaged food, which has not been prepared on the premises.
$25.00/yr.
D. 
License for seasonal establishment operating four or less months a year.
$25.00/yr.
E. 
Temporary license for establishment operating not more than seven days per year.
$25.00/yr.
F. 
License for an itinerant establishment.
$25.00/yr.
G. 
Fees for reinspection following a failure to meet satisfactory status.
$25.00/yr.
H. 
Civic organizations selling food at more than five days per year.
$1.00/yr.

A. 
All licenses shall expire on June 30 of each year.
B. 
The fee for a license issued after January 1 and prior to June 30 shall be $35.
A person conducting an itinerant retail food handling establishment shall secure a license, or if such person is the holder of a license issued by the Board of Health of another jurisdiction, said license may be approved by this Board of Health; and there shall be a fee of $20 charged for such approval.
A license or approval of an existing license may be suspended or revoked for a violation by the holder of any provision of this chapter or code after an opportunity for a hearing by the Board of Health or its authorized representatives.
A license or approval of an existing license issued by another Board of Health is not transferable.

Any person who violates any provision of, or order promulgated under, this chapter or code established herein shall, upon conviction thereof, be liable to a penalty of not less than $50 nor more than $500 for each violation. Each day a particular violation continues shall constitute a separate offense.
