A. 
There is created the position of deputy Borough clerk pursuant to N.J.S.A. 40A:9-135.
B. 
A deputy Borough clerk shall be appointed by resolution of the governing body in its discretion. Such appointment shall be at will and for a term not to exceed one year, subject to annual reappointment at the discretion of the governing body.
C. 
The position of deputy municipal clerk shall be nontenured and any appointee thereto shall serve only at the pleasure and discretion of the Borough council.

The compensation for the position of deputy Borough clerk shall be as agreed upon and set forth in the appointing resolution or other municipal document setting forth specific municipal official and employee rates. Such compensation shall be within the perimeters of applicable salary ordinances.

In addition to any and all other functions and duties that are or may be legally performed by the person appointed to the office and position of deputy Borough clerk in other capacities, the deputy Borough clerk shall, during the absence or disability of the Borough clerk, have all the powers of the Borough clerk as provided in N.J.S.A. 40A:9-133 and 135 and other applicable laws and shall perform the functions and duties of such office, including without limitation the execution of documents, which such execution of documents shall be in the name of the deputy Borough clerk and shall have all the force and effect of execution by the Borough clerk.

The governing body may in its discretion require an appointee to the office and position of deputy Borough clerk to engage in such training and education, and obtain such certifications and the like as the Borough council may from time to time deem fit. The governing body may, in its discretion, require such activity as a condition of appointment.

Pursuant to N.J.S.A. 40A:60-6b(3), the deputy Borough clerk is exempt from the requirement of residency within the Borough of Ship Bottom.
