It is the purpose of this Part to regulate various mechanical,
electronic or video gambling devices to promote the health, safety
and general welfare of the citizens of the Borough of Thornburg, and
to establish reasonable and uniform regulations governing such activities
within the Borough. It is not the intent of the Borough of Thornburg
to regulate private residential use of such devices. It is further
not the intent of the Borough of Thornburg to condone, tolerate, or
otherwise allow these types of devices to be used for illegal gambling
purposes under the laws of the Commonwealth of Pennsylvania.

The installation, use, operation, leasing, purchase or sale
for commercial purposes of any video poker machines, mechanical poker
machines or any other mechanical, video or electronic gambling devices
within the Borough of Thornburg is hereby prohibited unless undertaken
in compliance with the terms of this Part and in compliance with the
laws of the Commonwealth of Pennsylvania.

Any commercial or recreational establishment seeking to make
any use whatsoever of any video, mechanical or electronic poker machine
or other gambling device within the confines of the Borough of Thornburg
must first obtain and complete a permit form from the Borough Secretary.
Such permit application shall be made prior to the proposed use in
any fashion of such devices and thereafter annually so long as such
devices are used in any fashion whatsoever for commercial purposes
within the confines of the Borough.

Each applicant seeking to use in any fashion any such device
regulated pursuant to this Part shall pay an annual license fee in
an amount as established from time to time by resolution of Borough
Council to the Borough of Thornburg for each such machine, device
or game proposed to be used or used within the confines of the Borough
of Thornburg.

Upon receipt of the properly completed application and the payment
of the necessary fee per number of devices, machines or games to be
utilized, the Borough Secretary shall issue an annual license to each
commercial or recreational establishment which has properly applied
to the Borough of Thornburg for such use pursuant to the requirements
of this Part.

Any annual license held by any commercial or recreational establishment
shall not be transferable without the advance written permission of
the Borough of Thornburg.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof, shall be sentenced to pay a
fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 30
days. Each day that a violation of this Part continues shall constitute
a separate offense.

The Ordinance Officer of the Borough of Thornburg shall have
the power to make periodic inspections at reasonable times of all
premises where machines or devices subject to regulation by this Part
are operated for the purpose of enforcing this Part.
