This Book shall be known as the "Revised General Ordinances of the Board of Health of the Township of Frankford, 2004" or the Frankford Health Code.

a. 
Meetings.
1. 
The Board of Health shall meet on the second Tuesday of every month (unless the second Tuesday is a holiday, and in that case an alternate date will be scheduled and published) at 7:30 p.m.
2. 
During the regularly scheduled meetings of the Board of Health, the Board shall not hear any new testimony after 9:30 p.m. on any matter, whether new or pending, which has not been addressed or started previously during that meeting by the Board of Health. The Board of Health, based on an emergency situation, may waive this requirement.
b. 
Applications. To allow for the proper review of all applications and supporting documents by the Board and its health officers, all applications and any and all documents supporting the same shall be submitted in written form to the Secretary of the Board of Health located at the Frankford Municipal Building, 151 U.S. Highway 206, Frankford Township, New Jersey (mailing address: Post Office Box 179, Augusta, New Jersey 07822), at least two weeks prior to the date of the regularly scheduled Board of Health meeting at which the applicant wishes to be heard. Failure to supply the said information will result in the application being carried to the next regularly scheduled meeting of the Board of Health. The Board, based on an emergency situation, may waive this requirement.

This Board of Health Code incorporates herein by reference the following existing ordinances as if set forth at length:
a. 
An ordinance providing for the adoption of the "Trailer Court Code of New Jersey (1956)" (adopted October 11, 1966).
b. 
An ordinance establishing a Code regulating the location, construction, alteration, use and supervision of public noncommunity and nonpublic water systems, requiring certain permits and the fixing of fees (adopted September 9, 1986).
c. 
An ordinance establishing a Code regulating the manner in which refuse shall be stored, collected, and disposed of; declaring and defining certain conditions as nuisances; fixing the responsibilities and duties of persons, storing, collecting and/or disposing of refuse, and providing penalties for violation thereof (adopted March 10, 1987).
d. 
An ordinance establishing a Code to regulate and control the location, construction, use, maintenance, and method of emptying or cleaning individual sewage disposal systems, or other places used for the reception or storage of human excrement, the issuance of (licenses) (permits) and providing penalties for the violation thereof.
e. 
An ordinance establishing a Code regulating and controlling the construction and operation of campgrounds.
f. 
Ordinance rescinding an ordinance dated March 10, 1981 regarding licensing of retail food establishments and further adopting by reference Chapter XII of the New Jersey State Sanitary Code, Sanitation in Retail Food Establishment and Food and Beverage Vending Machines.

This section adopts by reference pursuant to N.J.S.A. 26:3-69.1 et seq., what is described and commonly known as the Public Health Nuisance Code of New Jersey. Three copies of the Code have been placed on file in the office of the Secretary of the Frankford Township Board of Health and shall remain there on file for the use and examination of the public.

a. 
Board of Health Code Violations.
1. 
Any person who violates any section of this Board of Health Code shall be fined not less than $5 nor more than $500 for each separate violation. Each day a particular violation continues shall constitute a separate and distinct violation of this ordinance. A court, upon convicting a person of a continuing violation, shall impose a separate fine for each day and may not order that each fine be made concurrent with any other.
2. 
The court may cause a defendant who refuses or neglects to pay the amount of a judgment rendered against him and all costs and charges incident thereto, to be committed to the County jail for a period not exceeding 90 days.
3. 
In case a defendant shall have been twice convicted within the space of six months of the violation of the same health ordinance or Code, and due proof of such fact is made, the court may, in addition to the imposition of the fines prescribed above, cause the defendant to be imprisoned in the County jail for a period not to exceed 90 days.
4. 
All fines recovered in any prosecution for a violation of this Code shall be paid into the treasury of the Township.
b. 
Violations of the State Sanitary Code.
1. 
Any person who violates any provision of the State Sanitary Code shall, upon conviction, be fined not less than $50 nor more than $1,000 for each separate violation.
(a) 
Each day a particular violation continues shall constitute a separate and distinct violation of the State Sanitary Code.
(b) 
A court, upon convicting a person(s) of a continuing violation(s), shall impose a separate fine for each day, and may not order that each fine be made concurrent with any other fine(s) or violation(s).
2. 
The court may cause a defendant who refuses or neglects to pay the amount of a judgment rendered against him, all costs and charges incident thereto, to be committed to the County jail for a period not exceeding 90 days.

All ordinances, Codes or parts of ordinances or Codes inconsistent with any of the provisions of the Township of Frankford Board of Health Code are hereby repealed to the extent of such inconsistency.
This section rescinds, repeals and supersedes in its entirety the prior "Sanitary Code of the Township of Frankford" adopted on August 9, 1988, as further amended by the Board of Health.

In the event that any section, sentence or clause of this Code shall be declared unconstitutional by a court of competent jurisdiction, such declaration shall not in any manner prejudice the enforcement of the remaining provisions.

The titles, headings and section numbers used in this Code and the classification and arrangement of the several sections of this Code have been made and used for the purpose of convenience, reference and orderly arrangement and no implication or presumption of a legislative construction is to be drawn therefrom and shall not be deemed part of the ordinance for the purposes of construction.
