The fee for a certificate of continued occupancy issued for all uses except R-3 under N.J.A.C. 5:23-2.23c shall be $200.

The fee for a temporary certificate of occupancy shall be $150 for the first 30 days and an additional $150 for each thirty-day renewal thereafter.
(b) 
Variation. The fee for an application for a variation in accordance with N.J.A.C. 5:23-2.10 shall be $594 for Class I structures, $120 for Class II structures, and $65 for Class III structures.
(c) 
Lead abatement clearance certificate: $50.
(d) 
Asbestos abatement certificate of occupancy: $25.
(e) 
Miscellaneous fees.

For cross connections, backflow preventors, public swimming pools, spas and hot tubs that are subject to testing and require annual inspections, the fee shall be $65.

In the case of discontinuance of work, all completed work will be computed. Any excess work will be refunded except 25% of excess for cost of permit fees and refunding upon approval of Mayor and Council.

All suspensions of permits pursuant to N.J.A.C. 5:23-2.16[b] will not be refundable in whole or in part.
(f) 
State training fees. Fees shall be pursuant to current regulations of N.J.A.C. 5:23-4.19.
(g) 
Engineering fees.

(h) 
Special off-hours inspection fees. Fees to be determined by the Construction Official prior to any inspection and to be determined based on request to conduct inspections outside of the inspector's scheduled hours. The minimum special off-hours minimum fee shall be $50 per special inspection.

D. 
Chapter 121, Dogs, Cats and Other Animals.

Inspection and issuance of a certificate of compliance with the Smoke Detector Law, N.J.S.A. 52:27D 198.1 et seq., by the Fire Official: $55. If the application is received four to 10 business days prior to closing, the fee is increased to $90; if received fewer than four business days prior to closing, the fee increases to $200 per inspection.

(b) 
In the event that the Fire Marshal is required to make a reinspection because the premises is not in conformity with N.J.A.C. 5:70-2.3, N.J.A.C. 5:70-4.19 and the New Jersey Uniform Fire Code, a reinspection fee in an amount equal to twice the amount of the fee for the initial inspection shall be charged for each subsequent inspection. The certificate of inspection shall only be issued upon the requisite fees being paid.

Certificate of fire code status. The fee for a certificate of fire code status shall be $50.

Penalties. Penalties for acts or omissions in violation of Chapter 139 shall be in accordance with the penalty provisions of the Uniform Fire Code, N.J.A.C. 5:70 2.12 and N.J.A.C. 5:70 2.12A. The penalty for failure to file a registration or pay when due an annual registration fee for a non-life hazard use shall be the same as is specified for life hazard uses.

Chapter 197, Property Maintenance.

Creditors required to register properties pursuant to chapter are subject to the following fees:
(a) 
A fee of $500 per property annually for any property required to be registered because a summons and complaint have been filed in an action by the creditor to foreclose.
(b) 
An additional fee of $2,000 per property annually if the property is vacant and abandoned, as defined pursuant to § 197-40, when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned at any time thereafter while the property is in foreclosure.
J. 
Chapter 213, Sewers.

(1) 
The fee to obtain permission to make a four-inch sanitary sewer connection from the sewer main to the curb shall be $1,000.
(a) 
The applicant shall notify the Public Works Department of the intended date and time when such connection is to be made so that the Public Works Department may inspect such connection and approve of same before any backfilling of any excavation shall commence.
(b) 
At the time the applicant receives the permit to make such connection, the applicant shall provide the Borough Clerk with a certificate of insurance evidencing that the applicant has obtained a comprehensive general liability policy, a workmen’s compensation and employer’s liability policy and a commercial automobile policy guaranteeing notification to the Borough of Rockaway in the event of cancellation thereof. All of the policies shall be subject to the approval of the Borough Attorney and shall name the Borough of Rockaway as an additional named insured by endorsement designating the specific project. The comprehensive general liability policy shall have limits of at least $1,000,000 for each occurrence and $2,000,000 general aggregate. The workers' compensation limits shall be $1,000,000 for each accident, $1,000,000 disease-policy limit, $1,000,000 disease, each employee. The commercial automobile policy limit shall be a minimum of $1,000,000 for each accident.
(c) 
The applicant shall post a performance bond with the Borough of Rockaway in an amount of $200 to be retained by the Borough to assure that any repairs to public facilities such as road pavement, curbs, sidewalks and utilities shall be maintained in accordance with the requirements of the Borough Engineer for one year following the completion of such improvements.
(d) 
One year after any improvements are made to pavement, curbing and/or sidewalks or other public utilities or improvements, the applicants shall make an application for the performance bond to be released. The application shall be made to the Public Works Department and upon certification to the Borough Treasurer by the Director of Public Works that the improvements and restoration are in satisfactory condition, the performance bond may be released. Should the applicant fail to properly maintain the improvements, the Borough shall give the applicant notice of such deficiency, and should the applicant fail to correct such deficiency(ies) within 45 days of such notice, the Borough may proceed to have the deficiency(ies) corrected utilizing the performance bond posted with the Borough.
(2) 
The fee to obtain a dye test to determine if a building is connected to the Borough's sanitary sewer shall be $50 per test and shall be payable at the time the application for a dye test is submitted.

(3) 
The annual rate for sewer service outside of the municipal boundaries shall be $250 per unit.

The sanitary sewer user charge for discharging sewage into the sanitary sewer system and subsequently into the Rockaway Valley Regional Sewerage Authority (RVRSA) sewer system shall be based as follows:

First, all costs and expenses, including salaries, charges from RVRSA, other expenses, and capital outlay associated with the Borough sewer system, shall be determined.
(b) 
Second, a flat fee of $50 per quarter per unit will be charged, regardless of water consumption; however, if the water account is inactive, there will be no sanitary sewer user charge.
(c) 
Third, a service charge based upon water consumption of $0.0073 per cubic foot will be charged to pay for all costs determined in Subsection J(4)(a) above.
(d) 
Multiple units on a single meter. The owner of the property shall be charged a minimum quarterly charge of $50, multiplied by the number of units serviced by that one meter.
(5) 
Whenever sewer service commences after the first day of any quarterly period, sanitary sewer user charges for the first quarterly period shall be prorated.

(6) 
If an estimated water bill is charged to any customer for any billing period during which no meter reading could be taken by the Water Department and no customer reading card is returned by the customer, the service charge as determined in Subsection J(4)(c) above shall be based on the average water usage for that customer over the prior four billing periods.

(7) 
Private wells. Residential properties on private wells shall be charged an annual rate of $250 per unit. Commercial properties on private wells shall be charged an annual rate of $500 per unit.

Payment will be required if three hours' minimum notification of cancellation is not given. Unless otherwise prohibited by law, an escrow deposit will be required in an amount to be determined by the Chief Financial Officer.

Article I, General Regulations.
(a) 
Tapping fees for all taps to the municipal water system will be $1,000 per connection. Water main taps up to two inches will be made by the Borough. Water main taps over two inches will be the responsibility of the owner or the owner’s contractor. All such taps shall be subject to inspection by the Borough. All excavation and backfilling are the responsibility of the owner or the owner’s contractor. The owner will supply the Borough with proof of liability insurance insuring against property damage and personal injury, naming the Borough as an additional insured.

Fee to turn water back on after service has been discontinued for nonpayment of water bill: $100.
(c) 
Fee for turning off water service so that property owner may make repairs and then turning service back on: $54 during normal business hours when scheduled with 48 hours' notice. If the request to turn off water service during normal business hours is made with less than 48 hours' notice, the fee increases to $110. If the water service must be turned off and/or on outside of normal business hours and an emergency call-out is required, there will be a charge of $80 per hour per employee with a minimum charge of three hours per employee.

Connection fees. In order to facilitate long-term improvements to the system, a connection fee of $5 per gallon of usage as estimated in accordance with N.J.A.C. 7:10-12.6, will be assessed on all connections.

(f) 
At the time the applicant receives the permit to make such connection, the applicant shall provide the Borough Clerk with a certificate of insurance evidencing that the applicant has obtained a comprehensive general liability policy, a workmen’s compensation and employer’s liability policy and a commercial automobile policy guaranteeing notification to the Borough of Rockaway in the event of cancellation thereof. All of the policies shall be subject to the approval of the Borough Attorney and shall name the Borough of Rockaway as an additional named insured by endorsement designating the specific project. The comprehensive general liability policy shall have limits of at least $1,000,000 for each occurrence and $2,000,000 general aggregate. The workers' compensation limits shall be $1,000,000 for each accident, $1,000,000 disease-policy limit, $1,000,000 disease, each employee. The commercial automobile policy limit shall be a minimum of $1,000,000 for each accident.

(g) 
Fee to repair or replace a damaged water hydrant, water main, pipe, or service connection: the actual cost of materials plus labor. If work is performed outside of normal business hours, there will be an additional charge of $80 per hour per employee, with a minimum charge of three hours per employee.

(h)

Any consumer may have his/her meter tested upon application and upon agreeing to pay $125 if the meter is found to register more than 3% more water than actually passes through it, it will either be replaced or repaired and no fee will be charged.

The nonrefundable application fee to apply for allocation of water capacity for nonmunicipal purposes shall be $100.
(b) 
Nonrefundable fee to reserve allocated water capacity for nonmunicipal purposes: $5 per gallon per day of usage as estimated in accordance with N.J.A.C. 7:10-12.6, payable in five installments of 20% as determined by the Borough Engineer as follows:

The first installment of the nonrefundable reservation fee shall be due within 30 days of the Mayor and Council resolution approving the application for reserved water capacity.
[2] 
An additional 20% of the nonrefundable reservation fee shall be due each year thereafter on the anniversary date of the approval until it is paid in full; provided, however, that if the applicant applies for a construction permit for the proposed project, the entire reservation fee shall be paid in full before such permit shall be issued. It is the applicant's responsibility to make all installment payments in a timely manner.

Special service charges.
(a) 
Where the nature, format, manner of collation or volume of printed matter is such that it cannot be reproduced by ordinary document-copying equipment in ordinary business size or where such record requires an extraordinary expenditure of time and effort to accommodate a request for inspection or copying of documents, a special service charge shall be imposed in addition to the actual costs of duplicating the record. A special service charge will also be applied when the custodian must change the medium in which the record is normally kept in order to comply with the request.
(b) 
The special service charge shall be paid to the Borough of Rockaway at the following rates:

For all services performed by employees of the Borough, the actual hourly rate of compensation for each clerical and supervisory employee performing the service plus the copying or reproduction cost and actual mailing cost, when applicable.
[2] 
For all services performed by the Borough's paid professionals, the rate paid by the Borough for said services.
[3] 
The requestor shall have the opportunity to review and object to the special service charge prior to the production of documents.
(4) 
Postage will be added to the fee for records requested by mail.
(5) 
All fees must be paid prior to the release of any copies. The custodian of the records may require a deposit of all or part of the fee prior to copying or producing any documents for inspection where it is estimated that the records requested will cost in excess of $5 to reproduce.
(6) 
For reasons of security, the use of a CD, videotape or audiotape provided by the requestor is prohibited. All electronic reproduction materials shall be supplied by the Borough of Rockaway.
(7) 
If the request for access to a government record would substantially disrupt municipal operations, the custodian of the records may deny access to the record after attempting to reach a reasonable solution with the requestor that accommodates the interests of the requestor and the municipality.
(8) 
In the event that the requestor of the documents objects to any charges permitted by this section and no resolution of the objection may be reasonably accomplished, the custodian of records shall not incur any charges on behalf of the Borough to fulfill the document request.
(9) 
Nothing in this section or any other ordinance of the Borough shall be construed as requiring the Borough of Rockaway to furnish copies of any privileged documents or other documents which have been determined to be exempt from the requirements of the Open Public Records Act or otherwise nondisclosable in accordance with any provision of law.
(10) 
Notwithstanding the foregoing, pursuant to N.J.S.A. 47:1A-5 et seq., if the Borough of Rockaway can demonstrate that its actual costs for duplication of a government record exceed the foregoing rates, the Borough of Rockaway shall be permitted to charge the actual cost of duplicating the record.
(11) 
Municipal Court discovery. All requests for discovery in matters pending in the Borough of Rockaway Municipal Court shall be addressed pursuant to New Jersey Court Rule 7:7-7, and the fees for same shall be as set forth in that rule.
(12) 
Recordings of Borough proceedings. The cost to duplicate the recording shall be charged for each recording of the Borough proceedings.
(13) 
Records not subject to examination or copying. Notwithstanding the provisions of this chapter, where it shall appear that the record or records which are sought to be examined and of which copies are requested shall pertain to an investigation in progress by the Borough of Rockaway or by any board, department or official appointed by or existing under its authority, or where the publication of such records by such department or official is expressly forbidden by statute, proclamation or regulation, or is otherwise exempt from the requirement that copies thereof be furnished upon request, or such publication would be inimical to public interest, the request for the same may be refused or denied.
(14) 
Copying by person requesting documents permitted. Where the document in question is more than 100 pages in length, the Clerk may permit the person requesting copies to use his own copying machine, provided that there is no risk of damage or mutilization of the documents and that it would not be incompatible with the transaction of public business. Such determination shall be completely within the discretion of the Clerk.
(15) 
Notary services.
(a) 
The following fee is established for the use of notary services provided by employees of the Borough of Rockaway:

Notary services: $5 per document.
(b) 
Fees for notary services will not be charged to Borough of Rockaway residents upon proof of residency.
Q. 
Application fee and escrow for requests for street vacations. Upon making a request to the Mayor and Council to vacate any portion of a public street, the applicant shall pay a fee to cover the cost of the administration thereof in the amount of $500. Additionally, the applicant shall post with the Borough Treasurer an escrow in the amount of $1,200 to be applied against the professional fees of the Borough professionals, including but not limited to the Borough Attorney, Borough Engineer and Borough Planner, as well as the costs associated with the recording of the formal ordinance vacating said public street. Any excess monies left over after all fees and costs have been paid shall be refunded to the applicant. In the event it shall appear that the escrow shall be insufficient to cover all such fees and costs, the Mayor and Council shall not finally enact the ordinance unless and until the applicant shall have paid an amount equivalent to the total amount of fees and costs charged to the Borough in connection with the street vacation.

Chapter 217, Streets and Sidewalks.

The fee to obtain permission to open, dig up, excavate, or disturb any street or portion thereof shall be $100 for any residential property and $400 for any commercial property.

For all openings from 100 square feet to 1,000 square feet: $1,000.
(c) 
For all openings greater than 1,000 square feet, the escrow fee will be determined based upon location of the work, construction schedule, restoration cost estimate, and the scope of work proposed. Full-time construction observation and reimbursement will be required for all projects determined to be of a nature that could impact the infrastructure of the Borough of Rockaway. This determination will be based upon the recommendation of the Borough Engineer after careful review of the application and concurrence by the Borough Administrator and the Superintendent of the Department of Public Works.

The fees set forth in Subsection Y(1) through (3) shall be waived when filming is done by a student in a grade school, middle school, high school, college, university or other bona fide educational institution upon receipt by the Borough Clerk of a written certification from a teacher or administrator at the school attended by the student stating that the filming is for educational purposes only and is not intended for commercial use.

Preapplication sketch reviews and postapplication technical reviews:
(a) 
There shall be no application fee for preapplication sketch plan review. However, applicants will be required to provide fees equal to charges by outside professionals for services rendered in connection with review of submitted materials. Initial deposits shall comply with the following schedule:
Single- to two-family residential and minor subdivision
$500
Mixed use or nonresidential on less than either 0.25 acre or 5,000 gross square footage
$750
Mixed use or nonresidential on less than either 0.5 acre or 15,000 gross square footage
$1,000
All other
$3,500
(b) 
All other fees and procedures shall comply with those established in § 169-52 of this Code. If technical review fees and/or escrows are insufficient to enable additional reviews or meetings, applicants will be notified of insufficient deposit balance and shall be required to remit additional funds. Unused balances will be returned to the applicant.
