a. 
Appointment. The Code Enforcement Officer shall be appointed by the Township Committee for a term of one year from the first day of January in the year in which he is appointed.
b. 
Duties. The Code Enforcement Officer shall perform the following duties:
1. 
Serve as Zoning Enforcement Officer and enforce the provisions of the Township Land Development Regulations (as supplemented and amended) in accordance with the Municipal Land Use Law (N.J.S.A. 40:55D-18) and Section 190 of the Township Land Use Ordinance as supplemented and amended.
2. 
Enforce the provisions of § 3-1 "Litter."
3. 
Enforce the provisions of the Signs Regulation in this code.
4. 
Enforce the provisions of Code Chapter 16 entitled "Property Maintenance Code."
5. 
Enforce such other provisions of the Code of the Township of Long Hill as may be deemed appropriate by the Township Committee or the Administrator.
6. 
Report at least monthly to the Administrator in such form as shall be prescribed by the Administrator.
7. 
The Code Enforcement Officer's salary shall be set by the Township Committee by ordinance.

a. 
Purpose. The purpose of this subsection is to create the administrative mechanisms needed for the execution of Long Hill Township's responsibility to assist in the provision of affordable housing pursuant to the Fair Housing Act of 1985.
b. 
Definitions. As used in this subsection, the following terms shall have the meanings indicated:
ADMINISTRATIVE AGENT
Shall mean the entity responsible for administering the affordability controls of some or all units in the affordable housing program for Long Hill Township to ensure that the restricted units under administration are affirmatively marketed and sold or rented, as applicable, only to low- and moderate-income households.
MUNICIPAL HOUSING LIAISON
Shall mean the employee charged by the Governing Body with the responsibility for oversight and administration of the affordable housing program for Long Hill Township.
c. 
Establishment of Municipal Housing Liaison position and compensation; powers and duties.
1. 
There is hereby established the position of Municipal Housing Liaison for Long Hill Township.
2. 
Subject to the approval of the Council on Affordable Housing (COAH), the Municipal Housing Liaison shall be appointed by the Governing Body and may be a full- or part-time municipal employee.
3. 
The Municipal Housing Liaison shall be responsible for oversight and administration of the affordable housing program for Long Hill Township, including the following responsibilities which may not be contracted out, exclusive of Subsection (f) which may be contracted out:
(a) 
Serving as Long Hill Township's primary point of contact for all inquiries from the State, affordable housing providers, Administrative Agents, and interested households;
(b) 
Monitoring the status of all restricted units in Long Hill Township's Fair Share Plan;
(c) 
Compiling, verifying, and submitting annual reports as required by COAH;
(d) 
Coordinating meetings with affordable housing providers and Administrative Agents, as applicable;
(e) 
Attending continuing education opportunities on affordability controls, compliance monitoring, and affirmative marketing as offered or approved by COAH;
(f) 
If applicable, serving as the Administrative Agent for some or all of the restricted units in Long Hill Township as described in Subsection f below.
d. 
Subject to approval by COAH, Long Hill Township may contract with or authorize a consultant, authority, government or any agency charged by the Governing Body, which entity shall have the responsibility of administering the affordable housing program of Long Hill Township, except for those responsibilities which may not be contracted out pursuant to Subsection c above. If Long Hill Township contracts with another entity to administer all or any part of the affordable housing program, including the affordability controls and Affirmative Marketing Plan, the Municipal Housing Liaison shall supervise the contracting Administrative Agent.
e. 
Compensation. Compensation shall be fixed by the Governing Body at the time of the appointment of the Municipal Housing Liaison.
f. 
Administrative powers and duties assigned to the Municipal Housing Liaison.
1. 
Affirmative Marketing.
(a) 
Conducting an outreach process to insure affirmative marketing of affordable housing units in accordance with the Affirmative Marketing Plan of Long Hill Township and the provisions of N.J.A.C. 5:80-26.15; and
(b) 
Providing counseling or contracting to provide counseling services to low- and moderate-income applicants on subjects such as budgeting, credit issues, mortgage qualification, rental lease requirements, and landlord/tenant law.
2. 
Household Certification.
(a) 
Soliciting, scheduling, conducting and following up on interviews with interested households;
(b) 
Conducting interviews and obtaining sufficient documentation of gross income and assets upon which to base a determination of income eligibility for a low- or moderate-income unit;
(c) 
Providing written notification to each applicant as to the determination of eligibility or ineligibility;
(d) 
Requiring that all certified applicants for restricted units execute a certificate substantially in the form, as applicable, of either the ownership or rental certificates set forth in Appendices J and K of N.J.A.C. 5:80-26.1 et seq.;
(e) 
Creating and maintaining a referral list of eligible applicant households living in the housing region and eligible applicant households with members working in the housing region where the units are located; and
(f) 
Employing the random selection process as provided in the Affirmative Marketing Plan of Long Hill Township when referring households for certification to affordable units.
3. 
Affordability Controls.
(a) 
Furnishing to attorneys or closing agents forms of deed restrictions and mortgages for recording at the time of conveyance of title of each restricted unit;
(b) 
Creating and maintaining a file on each restricted unit for its control period, including the recorded deed with restrictions, recorded mortgage and note, as appropriate;
(c) 
Ensuring that the removal of the deed restrictions and cancellation of the mortgage note are effectuated and properly filed with the appropriate county's register of deeds or County Clerk's office after the termination of the affordability controls for each restricted unit;
(d) 
Communicating with lenders regarding foreclosures; and
(e) 
Ensuring the issuance of Continuing Certificates of Occupancy or certifications pursuant to N.J.A.C. 5:80-26.10.
4. 
Resale and Rental.
(a) 
Instituting and maintaining an effective means of communicating information between owners and the Administrative Agent regarding the availability of restricted units for resale or rental; and
(b) 
Instituting and maintaining an effective means of communicating information to low- and moderate-income households regarding the availability of restricted units for resale or rerental.
5. 
Processing Request from Unit Owners.
(a) 
Reviewing and approving requests from owners of restricted units who wish to take out home equity loans or refinance during the term of their ownership;
(b) 
Reviewing and approving requests to increase sales prices from owners of restricted units who wish to make capital improvements to the units that would affect the selling price, such authorizations to be limited to those improvements resulting in additional bedrooms or bathrooms and the cost of central air conditioning systems; and
(c) 
Processing requests and making determinations on requests by owners of restricted units for hardship waivers.
6. 
Enforcement.
(a) 
Securing annually lists of all affordable housing units for which tax bills are mailed to absentee owners and notifying all such owners that they must either move back to their unit or sell it;
(b) 
Securing from all developers and sponsors of restricted units, at the earliest point of contact in the processing of the project or development, written acknowledgement of the requirement that no restricted unit can be offered, or in any other way committed, to any person, other than a household duly certified to the unit by the Administrative Agent;
(c) 
The posting annually in all rental properties, including two-family homes, of a notice as to the maximum permitted rent together with the telephone number of the Administrative Agent where complaints of excess rent can be made;
(d) 
Sending annual mailings to all owners of affordable dwelling units, reminding them of the notices and requirements outlined in N.J.A.C. 5:80-26.18(d)4;
(e) 
Establishing a program for diverting unlawful rent payments to the municipality's affordable housing trust fund or other appropriate municipal fund approved by the DCA;
(f) 
Creating and publishing a written operating manual, as approved by COAH, setting forth procedures for administering such affordability controls; and
(g) 
Providing annual reports to COAH as required.
7. 
The Administrative Agent shall have authority to take all actions necessary and appropriate to carry out its responsibilities hereunder.

a. 
The employment of immediate family members will not be approved if one member would have practical authority to appoint, supervise, evaluate or discipline the other.
b. 
For purposes of this section, immediate family shall mean spouse, mother, father, brother, sister, brother-in-law, sister-in-law, mother-in-law, father-in-law, child, grandparent or grandchild.
c. 
This policy shall not affect the status of any current employee nor deprive an employee of any promotional right in normal career development.
d. 
This policy is not intended to deprive anyone of any equal opportunity for a municipal position; rather, it is intended to eliminate the possibility of favoritism or the appearance of favoritism.

a. 
There is hereby established the administrative position of Public Safety Director.
b. 
In its sole discretion, the Township Committee may appoint a Public Safety Director.
c. 
The Public Safety Director shall serve for a term established by the Township Committee at the time of appointment.
d. 
The person appointed to the position of Public Safety Director shall be qualified by training and experience for the duties of the position. The person shall not be appointed unless he or she meets the following minimum qualifications:
1. 
A bachelor's degree (master's degree preferred) from an accredited college or university in public safety administration, police science or a related field.
2. 
A minimum of 10 years experience as a member of a police department or other law enforcement agency, five years of which shall have been in a command level (captain, deputy chief or chief) and administrative capacity.
3. 
The Public Safety Director shall be designated as the "appropriate authority" in accordance with the provisions of N.J.S.A. 40A:14-118. Under the general direction of the Township Administrator, the Public Safety Director shall have control over the Police Department in such manner as may be consistent with all applicable statutes, ordinances and regulations. The Public Safety Director shall be responsible for the administration, regulation and discipline of the Police Department. All officers of the Police Department shall perform their duties subject to the supervision and control of the Public Safety Director.
4. 
The duties of the Public Safety Director shall include but not be limited to the following:
(a) 
Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the force and its officers and personnel.
(b) 
Prescribe the duties and assignments of all subordinates and other personnel, subject to the provisions of N.J.S.A. 40A:14-118.
(c) 
Delegate authority as he or she may deem necessary for the efficient operation of the force to be exercised under his or her direction and supervision.
(d) 
Report at least monthly to the Administrator in such form as shall be prescribed by the Township Committee on the operation of the force during the preceding month, and make such other reports as may be requested by the Township Committee.
(e) 
Provide the Administrator and Township Committee with recommendations related to conditions of the Police Department and its improvements and needs.
(f) 
Obtain and maintain State and National accreditation of the Police Department.
(g) 
Examine all applicants for positions on the police force and recommend candidates for appointment by the Township Committee.
(h) 
Prefer charges against and in his or her discretion, pending a final hearing on the charges, suspend any officer or member of the force and otherwise exercise control over all subordinates, subject to law.
(i) 
Employ special police in emergencies and discharge them at the expiration of the emergency.
(j) 
Establish performance criteria for the Police Department as a whole as well as its individual members and conduct periodic evaluations to assure compliance with those criteria.
(k) 
Keep abreast of the public safety requirements of the Township and formulate policies, plans and procedures responsive to determined needs.
(l) 
Develop organization, manpower and resource recommendations and upon approval of same by the Township Committee, effect their implementation.
(m) 
Establish and maintain relations with school, civil and private organizations to assure a full understanding of the public safety effort.
(n) 
Conduct public relations and public information programs on behalf of the Police Department in order to maintain the required relationship between the Police Department and the citizens of the Township.
(o) 
Promote a close liaison with the various agencies of the Township, and to attend all meetings of the Township Committee, when necessary, to better coordinate the functioning of the Police Department with the work of all municipal agencies.
(p) 
Regularly review the ordinances of the Township dealing with public safety to assure their propriety with the prevailing public safety needs of the Township.
(q) 
Annually prepare a budget request for the Police Department and administer same.
(r) 
Plan and implement an ongoing program of training and education, subject to the approval of the Township Committee for all members of the Police Department, so that they will be fully apprised of current developments in law enforcement.
(s) 
Otherwise function in an executive coordination capacity in evaluating, planning, organizing, and assisting the Police Department.

The State Legislature recently adopted Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) to create the Defined Contribution Retirement Program to provide retirement benefits to various County and municipal officials.
N.J.S.A. 43:15C-2 requires the Governing Body of each County, municipality, and other local entity to adopt, as appropriate, either a resolution or ordinance to determine the positions that are substantially similar in nature to the advice and consent of the Senate for appointments by the Governor of the State, pursuant to guidelines or policy that shall be established by the Local Finance Board in the Department of Community Affairs, and for which officials appointed to such positions shall be eligible for and shall participate in the Defined Contribution Retirement Program, subject to the provisions of law.
The Township Committee of the Township of Long Hill has considered the guidelines issues by the Local Finance Board.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
a. 
Township Administrator;
b. 
Director of Community Development;
c. 
Recreation Director;
d. 
Supervisor of Waste Water Treatment Facility;
e. 
Township Attorney;
f. 
Township Engineer;
g. 
Municipal Prosecutor;
h. 
Municipal Court Judge.

Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
a. 
Tax Collector;
b. 
Chief Financial Officer;
c. 
Construction Code Official;
d. 
Qualified Purchasing Agent;
e. 
Tax Assessor;
f. 
Registered Municipal Clerk;
g. 
Licensed Uniform Subcode Inspector;
h. 
Principal Public Works Manager.

If an individual is appointed to one of the positions listed in Subsection 2-24.2 and the individual is not serving in a position as described in Subsection 2-24.3 above, the Pension Certifying Officer of the municipality may determine that the individual is not required to join the Defined Contribution Retirement Program if that individual; (1) was an active participant in the Public Employee Retirement System on July 1, 2007 and continuously since that time; or (2) has been appointed pursuant to a valid promotional process; or (3) is appointed on a temporary, interim, or "acting" basis to a position requiring State Certification as set forth in Subsection 2-24.3 herein, and is in pursuit of the required certification; or (4) meets such other exceptions that may be approved by the Local Finance Board or the Division of Pensions and Benefits.

This section shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.

There is hereby created the position of Purchasing Agent for the Township of Long Hill. This position may be filled in the sole discretion of the Township Committee, or it may remain vacant. If the position is vacant, the Township shall be subject to the statutory bid threshold set forth in N.J.S.A. 40A:11-3.

The Purchasing Agent shall be appointed by the Township Committee.

The Purchasing Agent is required to possess a valid qualified Purchasing Agent certificate as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.

The Purchasing Agent shall have, on behalf of the Township Committee, the authority, responsibility and accountability for the purchasing activity pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.); to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to recommend to the governing body the awarding of contracts pursuant to New Jersey law in accordance with the regulations, forms and procedures promulgated by State regulatory agencies and to award specific contracts when that authority is delegated to the Purchasing Agent by the governing body.

When a qualified purchasing agent has been appointed and if the Township desires to take advantage of the supplemental authority of N.J.S.A. 40A:11-3 and 40A:11-4.3, the Township Committee shall pass a resolution in accordance with N.J.A.C. 5:34-5.2 authorizing the amount of a higher bid threshold, the amount of which shall not exceed the statutory maximum bid threshold. In such case the Township Clerk shall file a certified copy of the resolution with the Director of Community Affairs and enclose:
a. 
A certification from the Mayor that the Purchasing Agent of the contracting unit exercises the duties of a Purchasing Agent pursuant to N.J.S.A. 40A:11-2(30), with specific relevance to the authority, responsibility, and accountability of the purchasing activity of the contracting unit; and
b. 
A copy of the Purchasing Agent's qualified purchasing agent certification.

The position of Long Hill Township Planning and Zoning Coordinator is hereby created.
The Planning and Zoning Coordinator shall be appointed by the Township Committee and shall serve at the pleasure of the Township Committee. The Planning and Zoning Coordinator's hours and compensation shall be set by the Township Committee.
The Planning and Zoning Coordinator shall be appointed on the basis of administrative abilities and qualifications with special regard to education, training and experience in planning and zoning, and familiarity with affordable housing, zoning ordinance enforcement, and the operations of municipal planning boards and zoning boards of adjustment. A person appointed as the Planning and Zoning Coordinator need not be a resident of the Township.

The Planning and Zoning Coordinator shall:
a. 
Supervise the staff of the Planning and Zoning Department.
b. 
Supervise the activities of the Township Zoning Officer and coordinate enforcement activities between and among the Zoning Officer, the Construction Office and the Fire Official.
c. 
Be the staff liaison to the Planning Board, the Zoning Board of Adjustment and the Environmental Commission, and work with the members of the boards.
d. 
Interface with consulting planners and engineers employed by the Township Committee, the Planning Board and the Zoning Board of Adjustment.
e. 
Act as the Municipal Housing Liaison in accordance with the provisions of N.J.A.C. 5:95-16.1, et seq., for the purpose of administering the Township's Affordable Housing Program.
f. 
Be the "Administrative Officer" (as defined in Section 111 of the Township Land Use Ordinance) charged with reviewing development applications and requests for administrative waivers and determining whether they are complete in accordance with the provisions of N.J.S.A. 40:55D-10.3.
g. 
(Reserved)
h. 
Serve as the "Board Secretary" as that term is defined in Section 111 of the Township Land Use Ordinance, for the sole purpose of signing off on subdivision and site plans.
i. 
Serve as recording secretary to both the Planning Board and the Zoning Board of Adjustment; attend all regular and special meetings of the boards and draft minutes for every meeting.
j. 
Perform such other duties as may be requested by the Township Committee.
