The Township Committee after consultation with the Affordable Housing Committee and the Affordable Housing Officer[1] shall adopt affordable housing rules and regulations by resolution.

The Township shall monitor the income of all affordable housing tenants in a manner consistent with the income verification procedures set forth by COAH. If at any time a household's income exceeds the maximum allowable income for a unit of that bedroom size by more than 20%, a rental surcharge will be imposed in accordance with the following schedule:

Proceeds collected as a rental surcharge shall be shared equally by the Township and the owner of the low/moderate income rental unit. If the tenant's income is increased to the point where a surcharge will be imposed, the tenant will be notified by the Long Hill Township Affordable Housing Officer.
If, after an increase in income, a formerly low income household becomes a moderate income household, then the moderate income rental guidelines shall apply and no surcharge shall be imposed.

The subletting, leasing or renting of any affordable housing unit to a household which has not been qualified as a low or moderate income household by the Township Affordable Housing Officer in accordance with the provisions of this chapter is hereby prohibited. Any person who violates this section shall be subject to the penalties set forth hereinbelow.

If any owner, tenant, licensee, agent or other person violates any of the provisions of this chapter or any provisions of the affordable housing rules and regulations adopted by resolution of the Township Committee, or fails to submit documentation required by the Affordable Housing Officer, or submits false or misleading information to the Affordable Housing Officer shall be liable to the penalty stated in Chapter 1, Section 1-5. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as set forth hereunder.
Any landlord of an affordable housing unit who does not file the annual report and all required documentation with the Township Affordable Housing Officer in compliance with the affordable housing rules and regulations, shall be subject to the penalties set forth above.
In addition to the penalties set forth hereinabove, any tenant who does not complete the required forms and submit the documentation requested by the Affordable Housing Officer in order to qualify as a low or moderate income household on an annual basis shall be subject to the rental surcharge set forth in Section 15-2 of this chapter.
