Editor's Note: This local law was passed at referendum at the general election held 11-4-1980.
The term of office of the Town Clerk of the Town of Amherst shall be four years.
A. 
Upon filing of an application for a marriage license, the applicant shall pay a fee of Forty Dollars ($40) to the Town Clerk. Such fee is due and payable before at the time the license shall be issued.
B. 
When either of the parties applying for such marriage license is an active member of the Armed Forces of the United States, the Town of Amherst shall not collect that portion of the fee which would otherwise be transmitted to the New York State Commissioner of Health pursuant to Section 15 (4) of New York's Domestic Relations Law.
C. 
When either of the parties applying for such marriage license is an active member of the Armed Forces of the United States, the Town of Amherst shall waive the portion of the fee to which it is entitled.
D. 
When either of the parties applying for such marriage license is an active member of the Armed Forced of the United States, the Town of Amherst shall also waive the Ten Dollar ($10) Clerk's Office Preservation Fee to which it is entitled.
E. 
This law shall take effect January 1, 2020.
