If a majority of the qualified electors of the city voting on the question vote to ratify this charter, this charter shall go into effect for the purpose of election upon approval by the Governor as provided by the state constitution, and the charter shall go into full effect at 7:30 p.m. on the first Monday in May after its adoption and approval in lieu of the old charter. The Commission shall hold its first meeting under this charter at the above time when this charter goes into full effect.
If a majority of the qualified electors of the city voting on a question, vote to amend the existing charter, the amended charter shall go into effect for the purpose of election upon approval by the Governor as provided by the state constitution, and the charter shall go into full effect on the first Monday in May after its adoption.
The incumbent of the offices of the Commissioners and the incumbents of all other offices and positions of employment (including members of boards, commissions, and other plural authorities), under the old charter at the time this charter goes into effect shall continue in their respective offices and positions of employment under this charter until their respective terms expire or until their services are terminated in accordance with the provisions of this charter and ordinances relating to the creation, change, abolition of offices and removal of officers and employees, as the case may be. The incumbent Commissioners shall serve until their terms expire or until their successors are elected and installed.
All ordinances insofar as they are not inconsistent with this charter, shall continue in effect until they are repealed or until they expire by their own limitations.
The adoption of this charter shall not abate or otherwise affect any action or proceedings, civil or criminal, pending when it takes full effect, brought by or against the municipality or any office, department, agency or officer thereof.
